Zoning — See Ch. 375.
This chapter shall be known and may be cited as the "Fence Ordinance."
As used in this chapter, the following terms shall have the meanings indicated:
FENCE
Any freestanding structure, including a wall, which is designed to confine, restrict, enclose or delineate a particular lot, yard or area.
A fence, or like divisional structure, not to exceed six feet in height may be erected and maintained at any point on any lot in the Borough, with the exception of § 154-4, below.
On a corner lot in any residential district, nothing shall be erected, placed, planted, or allowed to grow in such a manner as to materially impede vision between a height of three and 10 feet above the center line grades of the intersecting streets in the area bounded by the street lines of such corner lots and a line joining points along said street lines 25 feet from a point of the intersection. Further, no fence shall be erected within the front yard area or in violation of any front yard setback as defined in Chapter 375, Zoning.
Any permanently constructed swimming pool, or any temporary or inflatable swimming pool which can be filled to a depth in excess of 18 inches (457 mm), shall be enclosed by a fence or other structure not less than four feet (1,219 mm) high which can be locked to prevent accidental or unauthorized entry.
No person shall erect, reconstruct or structurally alter a fence in the Borough unless there has been duly issued to such person a building permit by the Building Inspector; provided, however, that no permit shall be required for the erection or structural alteration of a fence not exceeding three feet in height, or of an ornamental fence of a reasonable height so long as the ratio of the solid portion of such ornamental fence to the open portion shall not exceed one to four.
The Building Inspector shall charge such fees for the issuance of building permits as shall be, from time to time, directed by resolution of the Borough Council.
It shall be unlawful to locate, erect, construct, reconstruct, maintain or use a fence in violation of any regulation in or any provision of this chapter. Any person, firm or corporation who shall violate any provision of this chapter shall, upon conviction thereof, be sentenced to pay a fine of not more than $1,000, plus costs, and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation continues shall constitute a separate violation.
