The general standards herein set forth shall be applied within
90 days after notification by the Borough. Within such time, the owners
and/or occupants of each property, dwelling, and building shall post
the address identification number assigned by the Borough.
The Borough Council or its nominee is hereby authorized to give
written notice by personal service to the owner or occupant of any
premises not in conformance with this chapter. Such written notice
shall advise the owner or occupant of the provisions of this chapter
and set forth the violation that exists. The violator shall be given
15 days after the issuance of such written notice to conform to the
requirements of this chapter. In the event any owner, owners, or occupants
shall fail to comply with such notice within the period of time stated
herein, the Borough may post an identification number on the premises
and collect the cost thereof together with any additional penalty
authorized by law provided by this chapter.
Upon the determination of a violation by the Magisterial District
Judge in a civil enforcement proceeding commenced by the Borough,
any owner or occupant who willfully violates any of the provisions
of this chapter shall pay a judgment fine of not more than $500. Each
day of violation shall be considered a separate and distinct offense.
All judgments, costs and reasonable attorney fees collected for the
violation of this chapter shall be paid over to the municipality whose
chapter has been violated.
In the event that any section, paragraph, sentence, clause,
or phrase of this chapter be declared unconstitutional or invalid
for any reason, the remainder of such ordinance shall not be invalidated
by such action.
