As used in this chapter, the following terms shall have the
meanings indicated:
ALCOHOLIC BEVERAGE
Any liquor, wine, spirit, or malt or brewed beverage as defined
by the Liquor Code of the Commonwealth of Pennsylvania, 47 P.S. § 1-102,
as amended.
CIVIC CENTER
Any portion of the structure located at 118 Park Drive for
which an occupancy permit under the assembly use classification was
granted.
COMMUNITY ROOM
A room in the lower level of the Brentwood Borough Library,
which is located at 3501 Brownsville Road, that is accessible from
a separate exterior entrance.
OPEN CONTAINER
An unsealed receptacle or vessel containing any amount of
alcoholic liquid, regardless of whether or not said receptacle or
vessel has been placed in any wrapping, bag, or other device so as
to be concealed from view.
PUBLIC FACILITY
Any real property, right-of-way, or other entity owned by
the Borough of Brentwood, including, but not limited to, buildings,
lands, parks, swimming pools, playgrounds, stadiums, streets, alleys,
parking lots, or vehicles.
Brentwood Borough Council may, by resolution, authorize the sale or consumption of alcoholic beverages at public facilities in conjunction with a special event that is sponsored and organized solely by the Borough. Said permits shall not be valid for more than one calendar day. Under no circumstances shall such permit be authorized in conjunction with any special event for which the Borough is a co-sponsor, except as provided under §
70-3 herein.
In the event that any type of disturbance requiring the attention
of the Brentwood Police Department is caused at an event for which
an alcoholic beverage permit issued, the permit may be revoked by
the police officer thereof and costs associated with the Brentwood
Police Department shall go against the lessee's security deposit.
The Borough shall, by resolution, establish a fee and require a security deposit for a permit granted in accordance with §
70-3 herein.
Any person who shall violate any provision of this chapter shall,
upon conviction thereof, be sentenced to pay a fine of not more than
$600 and costs of prosecution or, in default of payment of such fine
and costs, to undergo imprisonment for not more than 30 days.
