A. 
A person who violates a provision of this chapter will be guilty of a civil infraction and will be subject to a fine up to the amount enumerated in the table below. If an offense does not have a fine enumerated elsewhere, the fine schedule is $100 for a first offense; $500 for a second offense within one year of a first offense; and $1,000 for a third or subsequent offense within one year of a first offense. Each day the violation continues will be a separate violation.

B. 
Animal Control Officers and other appropriate law enforcement officers are authorized to issue citations for civil infractions of this chapter.

D. 
Abatement of certain violations; boarding costs.

(1) 
An owner charged with a subsequent violation of § 133-13, 133-23 or 133-26 shall not have the animal returned until the owner abates the violation. The owner shall be responsible for the cost of boarding the animal until the owner abates the violation.
(2) 
Under Subsection D(1), an owner's corrective action to have the animal returned is not an admission of a violation of the statute. If the owner contests a citation, and is found to not have been in violation of the Code, any boarding costs shall not be imposed on the owner. If the owner contests a citation, and is found to have been in violation of the Code, any boarding costs shall be imposed in addition to the fine and court costs.
