Preparation and approval of a master plan as a guide for development
within the City subject to the requirements of the Michigan Planning
Enabling Act (Act 33) of 2008),[3] as amended.
Preparation and delivery of an annual written report to City Council
concerning its operation and the status of planning activities, including
recommendations to the City Council for actions relating to planning
and development.
The Citizens Planning Commission shall consist of seven members.
Members shall be appointed by the Mayor and approved by a majority
vote of the City Council. The Director of the Department of Community
Development and Planning and the Chairperson of the Citizens Planning
Commission shall be consulted prior to appointments regarding their
recommendations. Of the seven members:
There shall be at least one member representing each City Precinct
as a resident of such precinct. Any additional members shall be residents
of the City appointed on an at-large basis.
The membership of the Citizens Planning Commission shall be representative
of important segments of the City, such as the economic, governmental,
educational, and social development of the local unit of government,
in accordance with the major interests as they exist in the local
unit of government, such as agriculture, natural resources, recreation,
education, public health, government, transportation, industry, and
commerce.
It is strongly recommended that one member currently serving on another
commission, committee or authority with a willingness and ability
to serve, including, but not limited to, members of the Port Commission,
Downtown Development Authority, or Brownfield Redevelopment Authority,
be reviewed for appointment.
There shall be no compensation for a member of the Citizens Planning
Commission, except that reasonable expenses may be allowed in the
case of necessity.
Commencing with any terms already commenced on February 1, 2019,
or any terms commenced thereafter, members shall serve no more than
three consecutive terms, including the completion of any unexpired
terms. Any terms served prior to February 1, 2019, shall not be considered
when determining a member's qualification to serve under this section.
For any members disqualified from service by this section, following
a period of at least one year of non-service to the Citizens Planning
Commission, a member may be reappointed to the Citizens Planning Commission
for an additional term or terms not to exceed three consecutive terms.
Reappointment to the Citizens Planning Commission shall be based
upon individual interest in Citizens Planning Commission affairs,
rate of absenteeism and individual contribution. All appointments
shall commence on the second Monday in January.
Members may be removed by a majority vote of the City Council for
misfeasance, malfeasance, or nonfeasance in office upon written charges
and after a public hearing.
Vacancies occurring otherwise than through the expiration of term
shall be filled for the unexpired term by the Mayor, with recommendations
from the Director of the Department of Community Development and Planning
and the Chairperson of the Citizens Planning Commission and approval
of the City Council by a majority vote.
Before casting a vote on a matter on which a member may reasonably
be considered to have a conflict of interest, the member shall disclose
the potential conflict of interest to the Citizens Planning Commission.
The member is disqualified from voting on the matter if so provided
by the bylaws or by a majority vote of the remaining members of the
Citizens Planning Commission. Failure of a member to disclose a potential
conflict of interest as required by this subsection constitutes malfeasance
in office.
The Commission is hereby authorized to draw on the City staff and
citizens within the community for support and assistance in its tasks.
City staff shall provide appropriate training opportunities through
the Michigan Municipal League, Michigan Association of Planning, the
Michigan State University Extension and other organizations for new
and existing members of the Citizens Planning Commission regarding
planning, zoning, economic development, parliamentary procedure and
other topics deemed applicable. Failure to participate in training
opportunities may be deemed nonfeasance by the City Council.
