No person being the owner or having charge of cattle, sheep, geese, ducks, turkeys, chickens or other fowl or animals shall permit them to run at large upon any public place or upon any unenclosed lands or upon the premises of another.

A. 
No person being the owner of or having charge of any dog, whether wearing a registration tag or not, shall permit it to run at large upon any public place or upon the premises of another.[1]

B. 
No owner, keeper or harborer of any female dog shall permit such dog to go beyond the premises of such owner or keeper at any time such dog is in heat, unless such dog is properly in leash.
C. 
The owner or keeper of every dog shall at all times keep such dog either confined upon the premises of the owner or keeper or under reasonable control of some person.
D. 
It shall be illegal within the Borough of Evans City for any person or persons to own, possess, harbor or control any animal or bird which makes any noise continuously and/or incessantly for a period of 10 minutes or makes such noise intermittently for 1/2 hour or more to the disturbance of any person any time of the day or night regardless of whether the animal or bird is physically situated in or upon private property, said noise being a nuisance, provided that at the time the animal or bird is making such noise, no person is trespassing or threatening to trespass upon private property in or upon which the animal or bird is situate, nor is there any other legitimate cause which justifiably provoked the animal or bird.

The running at large of any such animal in or upon any of the places mentioned in this chapter is prima facie evidence that it is running at large in violation of this chapter.

Except as otherwise provided in 3 P.S. § 495-101 et seq, any person, firm or corporation violating any of the provisions of this chapter shall, upon conviction thereof, be sentenced to pay a fine in an amount established from time to time by resolution of Borough Council, plus costs of prosecution, including reasonable attorney’s fees and costs.
