The purpose of this chapter is to provide a means for persons
to travel from a residence or lodging establishment within the limits
of the Town of Wescott, Shawano County, Wisconsin, for the shortest
distance that is necessary for a person to operate a snowmobile to
the snowmobile trail or route that is closest to that residence or
lodging establishment.
This chapter is adopted as authorized under § 350.18(3)(a),
Wis. Stats.
No person shall operate a snowmobile on a roadway or shoulder of a highway unless posted as a designated snowmobile route, except for access as described in §
244-1.
This chapter designates the roadways and/or shoulders of specific
highways for snowmobile travel by persons residing in or staying at
a lodging establishment within the limits of the Town of Wescott,
Shawano County, Wisconsin, to travel for the shortest distance that
is necessary to reach the snowmobile trail or route that is closest
to that residence or lodging establishment subject to the following
conditions:
A. Snowmobiles
shall be operated on the extreme right side of the roadway and travel
with the flow of traffic and in single file.
B. Snowmobile
operators shall yield the right-of-way to other vehicular traffic
and pedestrians, and shall operate in a careful and prudent manner
at all times.
C. Snowmobile
headlights shall be on at all times.
A snowmobile operated on a portion of the roadway or shoulder
of a highway pursuant to this chapter shall observe roadway speed
limits.
This chapter shall be enforced by any local law enforcement
officer, which includes but is not limited to of the Shawano County
Sheriff's Department and Wisconsin DNR.

Wisconsin State snowmobile penalties as found in §§ 350.11(1)(a)
and 23.33(13), Wis. Stats., are adopted by reference. Any person who
violates this chapter shall, upon conviction, be subject to the forfeiture
amount in the Fine and Forfeiture Schedule of the Town of Wescott
that shall be as set from time to time by resolution by the Town of
Wescott.
The provisions of this chapter shall be deemed severable and
it is expressly declared that the Town Board would have passed the
other provisions of this chapter irrespective of whether one or more
provisions may be declared invalid. If invalid, the remainder of the
chapter and the application of such provisions to other persons or
circumstances shall not be affected.
This chapter will be become effective upon passage and publication.
This chapter repeals Ordinance No. 97-02, adopted February 11,
1997, and Ordinance No. 2004-04, adopted March 9, 2004.
