Employees at the Public Works Department and the Senior Custodian
of the Borough of Peapack and Gladstone are required to hold a Commercial
Driver's License (hereinafter "CDL"). Effective January 1, 1996, the
Borough is required to comply with the Omnibus Transportation Employee
Testing Act of 1991 (hereinafter "Act") and rules mandated by the
Federal Highway Administration (hereinafter "Rules") regarding policies
and procedures for Borough employees who are required to hold and
maintain a CDL. The aforementioned Act and Rules require certain policies
and testing procedures implemented by the Borough for those employees
who possess a CDL. The County of Somerset (hereinafter "County") has
already implemented the required policies and testing procedures mandated
by the Act and Rules. The New Jersey Interlocal Service Act, N.J.S.A.
40:8A-1 et seq. provides for agreements for the provisions of joint
services between counties and municipalities for the sharing of costs.
Such costs would include the implementation of programs for those
employees required to have a CDL. The Borough and the County have
determined that it is their mutual best interest to share the costs
and responsibilities for the implementation of the policies and procedures
required by the Act and Rules for those employees required to possess
a CDL. The terms of sharing said costs and responsibilities is set
forth in an Interlocal Services Agreement between the Borough of Peapack
and Gladstone and the County.

The Mayor and Borough Clerk, pursuant to N.J.S.A. 40:8A-1 et
seq., are hereby authorized to execute the aforementioned Agreement
between the Borough of Peapack and Gladstone and the County of Somerset,
which Agreement is incorporated herein by reference and shall remain
on file in the office of the Borough Clerk, 1 School Street, Peapack,
NJ 07977, where same shall be available for public inspection.

This section shall take effect pursuant to N.J.S.A. 40:8A-4.
