There is hereby established the Affordable Housing Board of
the Borough of Fairview, consisting of five members appointed as hereinafter
provided, to serve without compensation. The Affordable Housing Board
shall not serve as a Municipal Housing Authority as defined by statute.

The Affordable Housing Board shall consist of the Mayor, one
member of the Borough Council, designated by the Mayor, and three
citizens, who shall be residents of the Borough, appointed by the
Mayor.

The terms of the Mayor on the Affordable Housing Board shall
run concurrently and coterminous with his or her term of office. The
term of the Councilmember shall be for one year. The terms of the
three citizen members shall be for a period five years, with the initial
appointments being staggered terms of one, two and three years.

The Affordable Housing Board shall be the designated authority
for the purpose of monitoring the construction, reconstruction, rehabilitation,
occupancy, resale and rental restrictions of low and moderate income
housing units and, in that capacity, shall have all the powers and
duties of an authority as provided by N.J.A.C. 5:92-1.1, et seq. In
addition, the Affordable Housing Board shall have the following powers
and duties:
a. To advise and make recommendations to the Borough Council, Planning
Board and other boards and agencies relating to matters involving
affordable housing within the Borough.
b. To monitor the implementation of low and moderate income housing
development within the Borough and to recommend municipal action if
low and moderate income developments are not constructed, reconstructed,
rehabilitated or operated under the terms of approval.
c. To receive and deposit development fees collected by the Borough
under a mandatory development fee ordinance, and to disburse the fees
pursuant to a spending plan approved by the Council on Affordable
Housing, in accordance with N.J.A.C. 5:93-8 et seq.
d. To administer, operate and manage all municipally owned low and moderate
housing projects within the Borough of Fairview.
e. To evaluate the housing needs of the Borough and the region and specifically
to evaluate the existing low and moderate income housing programs
within the Borough and to make periodic reports to the Borough Council
and Planning Board regarding these evaluations at least annually.
f. To act as liaison between the Borough and any other governmental
or private agencies seeking to provide affordable housing within the
Borough.
g. To provide public relations, counseling and outreach services for
affordable housing opportunities within the Borough.
h. To recommend changes to the Planning Board and the Borough Council
regarding modifications of the Municipal Housing Plan, Master Plan,
or Land Use Regulations so as to meet the Municipal Housing Plan goals.
i. To administer any Regional Contribution Agreement (RCA) Program.

The affordable Housing Board shall recommend to the Mayor and
Council the appointment of an Administrator, Attorney, Planner and
such other employees as it may deem necessary. The Board shall also
recommend to the Mayor and Council, the administrators' and employees'
qualifications, salary and terms of employment.
a. The inspection of properties upon which is proposed the construction,
reconstruction, development or provision of low and moderate housing
within the Borough.
b. The receipt and evaluation of applications for low and moderate housing
units within the Borough in accordance with the Borough's Affordable
Marketing Ordinance, including the financial information submitted
by the applicant(s) and recommending to the Affordable Housing Board
the approval or denial of each application.
c. The Administrator shall be responsible for complying with all applicable
Federal and/or State monitoring and reporting requirements, including
but not limited to, the monitoring and reporting requirements of N.J.A.C.
5:93-11.6 and 12.1.

The Affordable Housing Board shall, annually, designate the
official depository for any and all funds received and/or disbursed
by the Affordable Housing Board.

The Affordable Housing Board shall, within 30 days of effective
date of this article, adopt bylaws and provide same to the Mayor and
Council for its review and approval. If the Mayor and Council shall
fail to act within 30 days of receipt of the proposed bylaws from
the Affordable Housing Board, same shall be deemed to have been approved.
