The force of special police officers provided for herein shall
collectively, along with the Police Chief, the assistant Police Chief
and the sergeant, be referred to as the police department of the City
of Le Roy, or as the Le Roy City police, which collective reference
and title is utilized for administrative purposes.

A.
Appointment: The Police Chief shall be appointed by the Mayor, by
and with the advice and consent of the City Council, on the first
Monday in May or as soon thereafter as practicable, annually.
B.
Residency Requirement: The Police Chief may reside outside of the
corporate limits of the City so long as the premises on which he shall
reside in such instance shall be adjacent to and adjoining the municipal
limits of the City.
C.
Oath And Bond: Before entering upon the duties of the office, the
Police Chief shall take the oath prescribed for City officers and
enter into a bond in the penal sum of $5,000, with good and sufficient
sureties to be approved by the City Council, conditioned for the faithful
discharge of the duties of the office.
D.
Powers And Duties: The Police Chief shall:
1.
Devote Entire Time; Report Offenders: Devote his time during such
hours of the day as the City Council may, by resolution, provide,
and shall see that the laws and ordinances of the City are enforced
as far as possible by the force under his command. It shall be his
duty to report all offenders to some proper tribunal for punishment.
2.
Attend Council Meetings: When requested so to do by the Mayor or
any member or committee of the City Council, attend meetings of the
City Council, execute orders of said body, and serve all warrants
or other legal processes necessary or proper to be served within the
City.
3.
Records And Reports: Keep or cause to be kept books of record of
the police department, which shall include all persons arrested by
the police, showing the time and place of each arrest, the offense
for which the same was made, the court before whom such person was
tried, and the disposition of each case.
4.
Care Of Property: Have the care, custody and control of all books,
records, equipment and other property belonging to the police department,
and of all stolen goods seized and retained by police authorities.
5.
Books And Records To Successor: Upon the expiration of his term of
office or his resignation or removal from office, upon demand, surrender
to his successor in office all such books, records, equipment and
other property in his possession belonging to the City or appertaining
to his office.

A.
Office Created: There is hereby created the office of assistant Police
Chief. The City Council is authorized to hire an assistant Police
Chief who shall be a special police officer of the City and a member
of the police department.
B.
Bond And Oath: The assistant Police Chief shall, before entering
upon the duties of the office, take the oath prescribed for City officers
and enter into a bond in the penal sum of $5,000, with good and sufficient
sureties to be approved by the City Council, conditioned for the faithful
discharge of the duties of the office.
C.
Powers And Duties: The assistant Police Chief shall:
1.
Answer to the Police Chief at all times, but shall, in the absence
of the Police Chief, act as the Police Chief. Absence of the Police
Chief shall be determined by the City Council either prior to such
absence taking place, or during the course of such absence, or by
agreement of the Police Chief and assistant Police Chief in regard
to policy or standards set forth by the City Council as to an appropriate
time to determine the Police Chief to be absent.
2.
Devote his full time and efforts during such hours of active duty
time for which he may be scheduled and shall further devote such additional
time as may be required to carry out the duties and responsibilities
of assistant Police Chief, including devoting such time as may be
necessary to assuming the responsibilities and duties of the Police
Chief on a temporary basis as may be required by the City Council.
The City Council may, by resolution, provide for the normal hours
of active duty, as well as "on call time" and other aspects of the
duties of the assistant Police Chief.
3.
See that the laws and ordinances of the City are enforced as far
as possible by the force under his command, and it shall be his duty
to report all offenders to some proper tribunal for punishment.
4.
Attend meetings of the City Council in the absence of the Police
Chief, or otherwise when required to do so.
5.
Execute orders of the City Council and serve warrants or other legal
processes necessary or proper to be served within the City, all at
the direction of the Police Chief, when not absent, or at the direction
of the City Council when the Police Chief shall be absent.
