There is hereby created the office of the Borough Administrator in accordance with N.J.S.A. 40A:9-136 et seq.

The Administrator shall have executive and administrative abilities and is to develop, promulgate and implement with the approval of the Mayor and Council, sound administrative personnel and purchasing practices and procedures for all departments and offices and boards of the Borough and such other duties as shall be prescribed and fixed by the Mayor and Council. The Administrator shall also be the Chief Administrative Officer of the Borough; shall supervise all department heads and manage the business operations of the Borough.

The Deputy Borough Administrator shall serve as the Acting Borough Administrator in the Borough Administrator's absence.

Pursuant to N.J.S.A. 40A:9-146, the Mayor and Council shall appoint the Tax Assessor and, by ordinance, determine the amount of compensation.

Pursuant to N.J.S.A. 40A:9-148, the Municipal Tax Assessor shall hold office for a term of four years from the first day of July next following his appointment. Vacancies other than due to expiration of term shall be filled by appointment for the unexpired term.

Pursuant to N.J.S.A. 40A:9-148.1, a Municipal Tax Assessor shall hold a tax assessor certificate provided for in P.L. 1967, c44 (C.54:1-35.25 et seq.) and shall have the duty of assessing property for the purpose of general taxation.

Pursuant to N.J.S.A. 40A:9-141 et seq., the Mayor and Council shall appoint the Municipal Tax Collector/Treasurer, who shall be charged with the duty of collecting taxes upon real property in the Borough and who shall perform the duties of Municipal Treasurer.

The Municipal Tax Collector/Treasurer shall hold office for a term of four years from January 1 next following his appointment. Vacancies other than those due to expiration of term shall be filled by appointment for the unexpired term.

No person shall be appointed or reappointed as Municipal Tax Collector/Treasurer unless he shall hold a Tax Collector certificate issued by the Director of the Division of Local Government Services.

A Tax Collector certificate shall be obtained upon qualification and successful completion of the examination given by the Director of the Division of Local Government Services. Qualifications for certification shall be in accordance with N.J.S.A. 40A:9-140.4 and N.J.S.A. 40A:9-145.4. Revocation or suspension of any certificates shall be in accordance with N.J.S.A. 40A:9-140.8, N.J.S.A. 40A:9-140.9 and N.J.S.A. 40A:9-145.5.

The position of Property Maintenance/Recycling Enforcement Officer shall be modified to henceforth be only Recycling Enforcement Officer.

The Recycling Enforcement Officer shall be appointed by the Administrator.

a. 
It shall be the responsibility of the Recycling Enforcement Officer to enforce the Recycling Ordinance, (Section 16-3) as set forth in the Code of the Borough of New Milford as well as such other ordinances as may be in this discipline.
b. 
The following duties shall hereinafter be performed by the Police Department, the Department of Public Works, the Zoning Officer or the Construction Official.
1. 
Dumping regulations (Section 16-2).
2. 
Garbage, ashes and rubbish (Section 16-2).
3. 
Lot maintenance (Section 12-1).
c. 
Although the above entities are designated as having primary responsibility to enforce the above enumerated regulations, other municipal employees and officials may also enforce the regulations and the delegation of this enforcement duty shall not preclude others from enforcing the regulations.

The salary, working hours and schedule of the Recycling Enforcement Officer shall be fixed by the Administrator.

The governing body of the Borough of New Milford hereby creates a position of Deputy Borough Clerk and provides for an appointment thereto.

This section will provide for:
a. 
Terms. The term of the Deputy Municipal Clerk shall be for two years, in the event of a vacancy the term of Deputy Municipal Clerk shall be made for a new term and not for the unexpired term.
b. 
Powers, Duties and Responsibilities of Such Office. During the absence, illness, or disability of the Municipal Clerk, the Deputy Municipal Clerk shall have all the responsibilities and powers of the Municipal Clerk and shall perform the functions and statutory duties of such office N.J.S.A. 40A:9-133.

Must be a high school graduate;
b. 
Must be at least 21 years of age;
c. 
Must be a citizen of the United States;
d. 
Must be of good moral character;
e. 
Must have completed at least two years of education in an institute of higher education of recognized standing. An applicant who does not meet this requirement may substitute on a year for year basis full-time experience in Federal, State or local government in the performance of duties relative to those performed by a municipal clerk;
f. 
Must be computer proficient;
g. 
Must be willing to attain a Registered Municipal Clerk's certification within two years;
h. 
Must have previous municipal experience.

The Borough of New Milford recognizes the position of Director of Public Works/Principal Public Works Manager.

The person serving the Borough of New Milford in this dual capacity shall be eligible for the right of tenure in his or her capacity as Director of Public Works, as specifically described in N.J.S.A. 40A:9 154.6.
a. 
To acquire tenure the person must serve the Borough of New Milford exclusively.
b. 
Said person must satisfy the statutory criteria to be Director of Public Works and meet the requirements of N. J. Stat. 40A:9 154.6. He or she must:
1. 
Be employed on a full-time 40 hour per week basis; and
2. 
Have held said position, continuously, for a period of five years; and
c. 
Said person must also satisfy the criteria to be Principal Public Works Manager and meet the requirements of N. J. Stat. 40A:9 154.6a. He or she must:
1. 
Hold and maintain a public works manager's certificate as defined by N.J.S.A. 40A:9 154.6(c); and
2. 
Also serve the Borough as the Principal Public Works Manager.
d. 
Said person shall acquire the right of tenure as Director of Public Works and shall upon meeting the requirements of subsections 2-16.2b and c above, retain that right until he or she attains the age of 70 after which should he or she continue to serve the Borough of New Milford he or she shall resume employment as an employee at-will and may be removed from the position of Director of Public Works at the election of the Mayor and Council, without regard for cause.
e. 
Said person shall remain as the tenured Director of Public Works so long as he or she serves the Borough of New Milford in a full time capacity as both Director of Public Works and Principal Public Works Manager, or is otherwise removed from the position of Director of Public Works, for good cause, based upon written charges filed with the Borough Clerk and after a public, fair and impartial hearing before the Mayor and Council, until he or she attains the age of 70 years.

The Borough of New Milford recognizes the position of Superintendent of Public Works.

The Superintendent of Public Works, shall act at the direction of the Director of Public Works/Principal Public Works Manager, and shall assist the Director of Public Works/Principal Public Works Manager in the administrative and supervisory duties and the planning, organizing and directing all programs relating to a public works activity and such other duties as shall be prescribed or fixed by the Director of Public Works/Principal Public Works Manager. The Superintendent of Public Works shall serve as the Director of Public Works/Principal Public Works Manager in his/her absence. The Superintendent of Public Works shall hold and maintain a public works manager's certificate as defined by N.J.S.A. 40A:9 154.6(c).

There is hereby, established the office of Emergency Management Coordinator (EMC) pursuant to the provisions of Executive Orders, Directive, and State statute.
The EMC shall be appointed by the Mayor with the advice and consent of the Borough Council for a term of three years.
The EMC shall comply with all the training requirements as set forth in Directive number 102 issued on March 15, 1990 by the State Director of the Office of Emergency Management and as supplemented and amended hereafter. Failure to so comply shall result in termination.
The EMC may be removed for just cause upon a majority vote of the Council.
The duties of the EMC shall be those as set forth in Directive number 102 as it is presently constituted or hereafter amended or supplemented:
a. 
The EMC shall be responsible for planning, activating, coordinating and conducting Emergency Management operations within the municipality.
b. 
The EMC shall be a member of, and shall serve as chairman of the local Emergency Management Council.
c. 
Each EMC shall appoint one, and may appoint more than one, Deputy Emergency Management Coordinator(s) with the approval of the Mayor. Wherever possible, such Deputies shall be appointed from among the salaried officers of the Borough of New Milford.
The qualifications of the EMC shall be those as set forth in Directive 102 or as it is hereafter amended or supplemented.
The Borough has determined that the EMC should provide a summary of activity every six months or as directed by the Administrator or Council majority.
The EMC shall provide 30 days' notice prior to resignation.
The EMC shall be compensated as set forth in the Borough's current Salary Ordinance.

The Mayor and Council of the Borough of New Milford create the position, appointment and term of an Emergency Management Coordinator.

a. 
The position of Municipal Humane Law Enforcement Officer(s) (MHLEO) be and hereby is established.
b. 
The MHLEO may be employed by an outside contractor and it must be the appointment of the individual, not the company. The appointment is null and void if the individual leaves the employment of the company.
c. 
Each County Prosecutor must issue directives concerning Municipal Humane Law Enforcement Officers. While these directives have not yet been issued, the BCPO Animal Cruelty Task Force is being used as the Statewide Model.
d. 
While no State funds are being provided to accomplish any of this State mandate all summonses issued for State Animal Cruelty Laws will be heard in Municipal Court and the fines, less the State of New Jersey's portion, will go to the Municipality.
e. 
A basic background investigation will be required for the MHLEO and there shall be proper identification issued to each MHLEO.
f. 
The Borough of New Milford may designate its Animal Control Officers (either in-house or outside contractors) as MHLEOs.
g. 
A Police Officer will provide assistance should there be an issue which may require an armed officer.
h. 
The MHLEO will be under the supervision of the Chief of Police or the Chief's designee.
