§ 7-1 WORDS AND PHRASES.

Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the New Jersey Statutes Annotated shall be deemed to apply to such words and phrases used herein.

§ 7-2 OFFICIAL TIME STANDARD.

Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Savings Time as may be in current use in the Borough.

§ 7-3 PARKING.

§ 7-3.1 Regulations Not Exclusive.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter provided.

§ 7-3.2 Parking Prohibited During State of Emergency.

a. Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY - NO PARKING signs are displayed. The Chief of Police or, in his absence, the ranking Police Officer is authorized to declare an emergency and to direct the posting of EMERGENCY - NO PARKING signs when weather conditions, accidents, fires and public celebration, dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that the EMERGENCY - NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.

b. Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any Police Officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.

c. The effectiveness of this subsection is contingent upon the signs being erected as required by law.

d. Violations and Penalties. Any person convicted of a violation of a provision of this subsection or any supplement thereto shall be liable to a penalty of $67 for each day of occurrence.

§ 7-3.3 Parking Prohibited at All Times on Certain Streets.

§ 7-3.5 Exceptions to Overnight Parking Regulations.

No vehicle shall be permitted to park or stand on any public street or highway in the Borough of New Milford between the hours of 2:00 a.m. and 5:00 a.m. except on Saturdays, Sundays, holidays, Memorial Day through Labor Day; the week of Thanksgiving; and December 15th through January 15th .

The provisions of this section shall not apply to:

§ 7-3.6 Parking Prohibited Certain Hours for Street Cleaning and Snow Removal.

For street cleaning purposes and snow removal, there shall be no parking or standing on the following streets, between the hours of 10:00 a.m. and 3:00 p.m. on the days specified, except for legal holidays, and excluding U.S. Postal Service vehicles while in the performance of their official duties.

§ 7-3.9 No Parking Trucks.

a. It shall be illegal for trucks to be parked on any street in a noncommercial zone except during deliveries or pick-ups, or during work to be performed at the premises.

b. Trucks are vehicles with the following characteristics:

1. Vehicles which exceed four wheels.

2. Total height of vehicle and/or any vehicle extensions which exceed seven and one-half (7 1/2) feet.

c. Violations and Penalties. Any person convicted of a violation of a provision of this subsection or any supplement thereto shall be liable to a penalty of $67 for each day of occurrence.

c. Violations and Penalties. Any person convicted of a violation of a provision of this section or any supplement thereto shall be liable to a penalty of $44 for each day of occurrence.

§ 7-15 GAS AND ELECTRIC SCOOTERS PROHIBITED.

No person, whether licensed or unlicensed will operate a gas or electric scooter that is not legally registered as a motor vehicle with the State of New Jersey, on any municipal roadway, sidewalk, or recreation area within the confines of the Borough of New Milford, unless same is operated on private property with the express permission of the owner of that property.

§ 7-16 PENALTY.

Unless another penalty is expressly provided by N.J.S.A. 39:4-203, every person convicted of a violation of a provision of this chapter or any supplement thereto shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 15 days or both.

All former traffic regulations of the Borough of New Milford covered in this Chapter 7, Traffic, are hereby repealed except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any regulations hereby repealed prior to the taking effect of this chapter.
