Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of the State of New Jersey shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Savings Time as may be in current use in the Borough.

a. 
The Director of the Department of Public Safety or, in his absence, disability or inability to act, then the Chief of Police of this municipality, is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days whenever he finds that such closing is necessary for the preservation of the public safety, health or welfare.
b. 
Any regulations promulgated by the abovementioned officials and in accordance with Subsection a above, shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
c. 
Any violation of this regulation promulgated thereunder shall be punished by a fine not to exceed $50.
d. 
Any regulation adopted that mandates the closing of any street for a period greater than 48 consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation.

Any vehicle parked in violation of this chapter shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any police officer may provide for the removal of such vehicle. The owner shall bear the reasonable costs of removal and storage in accordance with the Borough "Towing and Storage Service" ordinance[1] which may result from such removal before regaining possession of the vehicle.

Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of a provision of this chapter or any supplement thereto shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 15 days, or both.

If any part or parts of this chapter are, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this chapter.

All former traffic ordinances of the Borough of Pine Hill are hereby repealed, and all ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this chapter are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this chapter.

The Council hereby finds and declares that problems of traffic control occur when traffic must be moved through or around street construction, maintenance operations and utility work, above or below ground which requires blocking the roadway and obstructing the normal flow of traffic; and that such obstructions are and can become dangerous when not properly controlled. In order to better promote the public health, safety, peace and welfare, it is necessary to establish controls and regulations directed to the safe and expeditious movement of traffic through construction and maintenance zones and to provide safety for the work force performing these operations.
The Borough of Pine Hill in the County of Camden, State of New Jersey, does hereby adopt the current Manual on Uniform Traffic Control Devices hereinafter known as M.U.T.C.D., except as hereby supplemented and amended, as it controls and regulates whenever construction, maintenance operations or utility work obstructs the normal flow of traffic. Any person, contractor or utility who fails to comply with the provisions of the M.U.T.C.D. while performing such work is in violation of this section.

It shall be the responsibility of the person, contractor, or in the case of a public utility, as required under the public utility agreement, wishing to conduct work on, under or above the roadway to contact the Borough of Pine Hill Police Department in order to arrange a pre-construction meeting to submit plans for the safe movement of traffic during such period of construction or work. Any person, contractor or utility who fails to comply with this section prior to the start of such work or whose plans are not approved by the Police Department is in violation of this section.

The person, contractor or utility shall provide the Police Department with at least two emergency contact phone numbers to be called in case of emergency at the construction or maintenance site prior to the start of any work. If for any reason the emergency contact cannot be reached, or if the emergency contact person does not respond to the call from the Police Department to correct a hazardous condition, the Borough may respond to correct such hazardous conditions. The reasonable fees for such emergency service by the Borough shall be charged to the person, contractor, or utility responsible for such conditions.

There shall be no construction, maintenance operations or utility work on any roadway in the Borough before 9:00 a.m. or after 4:00 p.m. The time limit may be adjusted to permit work prior to 9:00 a.m. or after 4:00 p.m. by the Chief of Police. If it is determined by the Chief that the construction or maintenance operations prior to 9:00 a.m. or after 4:00 p.m. would substantially delay traffic or cause a safety or health hazard, the work shall then be permitted only between 9:00 a.m. to 4:00 p.m.

Traffic directors shall be posted at all construction or maintenance sites when determined by the Chief of Police that same is necessary to provide for the safe and expeditious movement of traffic.

The Chief of Police shall have the authority to stop work, including the removal of equipment and vehicles, stored material within the street right-of-way, backfilling of open excavations and/or other related work, in order to abate any nuisance and/or safety, hazard or for any violation of this section.

It is to be expressly understood that no materials, vehicles or equipment are to be placed in the roadway or sidewalk area until all construction signs, lights, devices and pavement markings are installed.

a. 
Any person, contractor or utility who commits a violation of this section shall, upon conviction thereof for a first offense pay a fine of not less than $100 nor more than $500 and/or be imprisoned in the County Jail for a term not to exceed 90 days.
b. 
For a second offense, upon conviction thereof, pay a fine of not less than $250 and/or be imprisoned in the County Jail for a term not exceeding 90 days.
c. 
A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other, more restrictive provisions prohibiting or limiting the stopping or standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey Statute or as hereinafter provided.

a. 
Upon the declaration of an emergency, there shall be no parking upon the streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, road construction, fire or public celebrations dictate or require avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
b. 
The above parking prohibitions shall remain in effect until the emergency has been declared over by the Chief of Police, or, in his absence, the ranking police officer.
c. 
Any unoccupied vehicle parked or standing in violation of this chapter shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any police officer may provide for the removal of such vehicle. The owner shall bear all costs charged for the removal and storage, in accordance with the provisions of § 8-3, which may result from such removal before regaining possession of the vehicle.
d. 
The effectiveness of this section is contingent upon the signs being erected as required by law.

a. 
Whenever snow has fallen and the accumulation is such that it covers the streets and highways, an emergency shall exist and no vehicle shall be parked on the streets or highways or portions thereof indicated.
The above parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.
b. 
Any unoccupied vehicle parked or standing in violation shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.

Exceptions. Nothing within this section shall be construed as preventing vehicles of a registered gross weight of five tons from making deliveries of merchandise or persons, or as prohibiting any vehicles exceeding said registered gross weight of five tons, used by any public utility company in connection with the construction, installation, operation or maintenance of any public utility facilities from parking while being used for such purposes.

In accordance with the provisions of N.J.S.A. 39:4-197.6, the following on-street locations are designated as handicapped parking spaces in front of private residences occupied by handicapped persons. Such spaces are for use by persons who have been issued special identification cards or plates or placards by the Motor Vehicle Commission, or a temporary placard issued by the Chief of Police. No other person shall be permitted in these spaces.
a. 
Procedure for Handicapped Parking on Street for Private Residence; Permit. Prior to the establishment of a restricted parking zone for a residence occupied by a handicapped person, the handicapped applicant shall satisfy the following criteria.
1. 
The handicapped person shall have first applied to the Director of Motor Vehicles in the Department of Law and Public Safety of the State of New Jersey and have received a special vehicle identification card and certificate to be posted on the windshield of the car as provided for by the revised statutes in Title 39.
2. 
The applicant must be a resident of the Borough of Pine Hill and reside at the address where on-street parking is requested.
3. 
The handicapped person shall then submit an application in writing for the desired parking space to the Borough Clerk's Office, who shall present same to the Borough Council at the next regularly scheduled meeting.
4. 
This applicant shall provide the following information on the application: (1) copy of the New Jersey Identification Card, (2) applicant's personal information, (3) the precise location for the permit, including street name and address, and any information regarding the availability of off-street parking at the subject property.
5. 
The location of the on-street handicapped parking space must be on a public street and off-street parking is not available.
6. 
Upon the approval of such request by the Borough Council of the Borough of Pine Hill, the Borough Clerk shall provide the Chief of Police with a Letter of Approval and the address for the parking zone.
7. 
The requested on-street handicapped parking space shall be installed in front of the applicant's residence in accordance with N.J.S.A. 39:4-197.6 unless:
(a) 
The requested space conflicts with any parking restriction already in place;
(b) 
There is not at least twenty-two-foot frontage on a public street in front of the applicant's residence; or
(c) 
The requested space is otherwise deemed unacceptable by the Pine Hill Police Department.
In the event that at least one of the above items are found to be present, then the requested space shall be designated by the Pine Hill Borough Police Department as near to the applicant's property as possible.
8. 
The permit issued by the Borough to the handicapped person shall be prominently displayed within the vehicle when it is parked in the designated area so it can be seen from the middle of the street. Only vehicles which have such a permit properly displayed shall be permitted to be parked in the restricted parking zone indicated on such permit.
9. 
Handicapped parking spaces under this subsection shall be designated as tow-away zones. Parking a motor vehicle in a handicapped parking space without a special identification card will entitle the Borough Police Department to authorize an immediate towing of the offending vehicle.
10. 
A fee of $250 shall be charged for the issuance of the permit.
11. 
The applicant shall be required to have his or her permit annually renewed by the Borough Police Department on the anniversary of date of said application. An annual renewal fee of $100 shall be assessed.
12. 
A holder of a Borough handicapped parking permit issued pursuant to this subsection must notify the Borough Clerk within 30 days if such person changes his or her residency or his or her vehicle registration number changes or the handicapped parking space is no longer required. Failure to notify the Borough Clerk within 30 days of any of the above items shall incur a $50 penalty to be paid to the Borough.
b. 
Regulatory and Warning Signs. Signs for on-street handicapped parking spaces shall be installed by the Borough following the approval of an application for such a handicapped parking space.

The owners of the premises referred to in Subsections 8-37.3, 8-37.4 and 8-37.5 shall provide and install signs and pavement markings for each parking space reserved for the use of handicapped persons, which signs and markings shall be in accordance with the Manual on Uniform Traffic Control Devices. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of said property. The owner shall, subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Borough of Pine Hill. The owner shall be responsible for the repair and restoration of same.

Any person violating any provision of this section shall, upon conviction, be liable for a penalty of not more than $100 for the first offense or $100 minimum and/or up to 90 days community service for subsequent offenses. The provisions of § 8-4 shall also apply to any person violating the provisions of this section.

Tow-Away Zones. Any vehicle parked or standing as to obstruct or impede a normal flow of traffic, block entrances or exit ways, loading zones, oil fills, any grassy area, pedestrian walkway, or present in any way a safety or traffic hazard may be removed by towing the vehicle at the owner's or operator's expenses.

Signs. All signs, posts, or other necessary materials be installed and paid for by the applicant. All signing shall conform to the current Manual on Uniform Traffic Control Devices, pursuant to N.J.S.A. 39:4-198 and N.J.S.A. 39:4-183.27.

1. 
Title 39 of the Revised Statutes of the State of New Jersey shall become applicable to the Bromley Estates Condominium Association, Phases I & II, pursuant to N.J.S.A. 39:5-1 and to the private road identified as Ski Mountain Drive.

Appropriate speed limit signs shall be erected and maintained on this private roadway of Bromley Estates Condominium Association, Phases I & II, said costs to be borne by the Condominium Association.

(a)

A map describing the streets and roads within the Mason Run Community are identified on the parking layout plan on file in the Borough Clerk's office and incorporated by reference herein.
(c) 
Handicap parking. All handicap parking shall be 12 feet wide as required by law in appropriate designated parking areas for persons who have been issued the handicap parking permits by the Motor Vehicle Commission. Reserve parking and penalty signs shall be posted at all handicap parking spaces.
(d) 
The general parking regulations shall apply to all roads identified on the parking layout plan at all times and all hours.
