While In a public park or recreation area, all persons shall conduct themselves in a proper and orderly manner, and in particular no person shall:
a. 
Willfully mark, deface, disfigure, injure, tamper with, displace or remove any buildings, bridges, tables, benches, fireplaces, railings, paving materials, public utilities or appurtenances thereof, signs, notices or placards (whether temporary or permanent), monuments, stakes, posts, or other boundary markers, or other structures or equipment, facilities or park property or appurtenances whatsoever, either real or personal.
b. 
Fail to cooperate in maintaining rest rooms and washrooms in a neat and sanitary condition.
c. 
Dig or remove any soil, rock, sand, stones, trees, shrubs, plants or other means.
d. 
Construct or erect any building or structure of whatever kind (whether permanent or temporary) or run or string any public service utility into, upon, or across such lands, except on special written permit issued hereunder.
e. 
Damage, cut, carve, transplant or remove any tree or plant, or injure the bark, or pick flowers or seed of any tree or plant, dig in or otherwise disturb grassed areas, or in any other way injure the natural beauty or usefulness of any area.
f. 
Climb any tree or walk, stand or sit upon monuments, vases, planters, fountains, railings, fences or upon any other property not designated or customarily used for such purposes.
g. 
Tie or hitch an animal to any tree or plant.
h. 
Hunt, molest, kill, wound, trap, abuse, shoot, pursue, or throw objects at, or have in his/her possession any animal, reptile or bird found within any park, nor shall their habitats be disturbed, except where specifically designated and permitted. No person shall purchase, sell, accept or give away any such animal, reptile, bird or eggs except as may be specifically provided for and permitted.
i. 
Throw, discharge, or otherwise place or cause to be placed in the waters of any fountain, pond, lake, stream or other body of water in any park or any tributary stream, storm sewer, or drain flowing into such water, any substance, matter or thing, liquid or solid, which may result in the pollution of said waters.
j. 
Have brought in, dump in, deposit or leave any bottles, broken glass, ashes, paper, boxes, cans, dirt, garbage, refuse, or organic or inorganic solid or liquid waste.
k. 
Drive or park any vehicle on any area except the paved park roads or parking areas, or such areas as may on occasion be specifically designated as temporary parking areas by the Borough of Pine Hill.
l. 
Leave a vehicle standing or parked at night in established parking areas or elsewhere in the park areas. No motor vehicle shall be parked in said park areas from 1/2 hour after sunset until sunrise, except as otherwise permitted.
m. 
Ride a bicycle without reasonable regard to the safety of others.
n. 
Leave a bicycle lying on the ground or paving or set against trees, or in any place or position where a person may trip over or be injured by it.
o. 
Swim, bathe, or wade in any waters or waterways in any park, except in such waters and at such places as may be specifically designated for such activities.
p. 
Bring into or operate any boat, raft, or other watercraft, whether motor powered or not, upon any waters, except at places designated for boating by the Borough of Pine Hill. Such activity shall be in accordance with applicable regulations as are now or will hereafter be adopted.
q. 
Fish in any area where bathing is permitted.
r. 
Shooting into park areas from beyond boundaries is forbidden. No person shall carry or possess firearms of any description, or air-rifles, spring-guns, bow and arrows, slings or any other forms of weapons or devices potentially inimical to wildlife or dangerous to human safety, or any instrument that can be loaded with and fire blank cartridges, or any kind of trapping device, except as may be specifically permitted.
s. 
Violate the regulation that use of individual fireplaces together with tables and benches follows the generally accepted rule of "First come. First served."
t. 
Use any portion of the picnic area or any of the buildings or structures therein for the purpose of holding picnics to the exclusion of other persons, nor shall any person use such areas and facilities for an unreasonable time if the facilities are crowded.
u. 
Set up tents, shacks, or any other temporary shelter for the purpose of overnight camping, nor shall any person leave in a park after closing hours any movable structure or special vehicle to be used or that could be used for such purpose, such as a house-trailer, camp-trailer, camp-wagon, or the like except in those areas designated by the Borough of Pine Hill for those purposes.
v. 
Ride a horse except on designated bridle trails, where permitted. Horses shall be thoroughly broken and properly restrained, and ridden with due care, and shall not be allowed to graze or go unattended, nor shall they be hitched to any rock, tree, or shrub.
w. 
Bring alcoholic beverages or drink same at any time except in such areas and under such regulations as may be designated and permitted by the Borough of Pine Hill.
x. 
Have in his/her possession, set or otherwise cause to explode, discharge or burn, any fireworks, firecrackers, or explosives or flammable material, or discharge them or throw them into any such areas from lands or highways adjacent thereto.
y. 
Be responsible for the entry of a dog or other domestic animal into areas clearly marked by the Borough of Pine Hill signs bearing the words "Domestic Animals Prohibited in this Area." All domestic animals in those areas where such animals are permitted shall be adequately restrained at all times.
z. 
Solicit alms or contributions for any purpose, whether public or private except in such areas and under such regulations as may be designated and permitted by the Borough of Pine Hill.
aa. 
Build, or attempt to build, a fire except in such areas and under such regulations as may be designated by the Borough of Pine Hill. No person shall drop, throw or otherwise scatter lighted matches, burning cigarettes, cigars, tobacco, paper or other flammable material within any park or on any highways, roads, or streets abutting or contiguous thereto.
bb. 
Gamble, participate in, or abet any game of chance except in such areas and under such regulations as may be designated by the Borough of Pine Hill.
cc. 
Go onto the ice on any waters except such areas as are designated as skating fields, and provided a safety signal is displayed.
dd. 
Disturb or interfere unreasonably with any person or party occupying any area or participating in any activity under the authority of a permit.
ee. 
Expose, or offer for sale, any article or thing, nor place any stand, cart or vehicle for the transportation, sale, or display of any such article or thing. Exception is made for any permittee or licensed concessionaire acting by and under the authority and regulation of the Borough of Pine Hill.
ff. 
Paste, glue, tack, or otherwise post any sign, placard, advertisement, or inscription whatever, nor shall any person erect, or cause to be erected, any sign on any park lands or roads in any park.
gg. 
No person shall be permitted under the influence of intoxicating beverages, drugs or narcotics. No person shall possess or distribute for consumption alcoholic beverages without the required permits issued from the borough Clerk's office, and the approval of the governing body. No person shall possess, distribute or consume drugs, or narcotics in or upon any borough park or recreation area.
hh. 
No group of 10 or more persons shall use a borough park, recreation area or playground without first having obtained a permit approved by the Board of recreation commission from the borough Clerk's office at least 15 days before the proposed date of use. Group use shall be limited to designated areas. Adult supervision of children's groups is required at all times.
ii. 
No person shall call or hold any public meeting or give any concert or public entertainment of any kind within a Borough of Pine Hill park, recreation area or playground without first having obtained written permission from the Board of recreation commission by applying to the borough Clerk's office for same in writing at least 15 days before the proposed date of use.
jj. 
No person shall use loudspeakers, public address systems or amplifiers within a Borough of Pine Hill park or recreation area without first having obtained written permission from the Board of recreation commission by applying to the borough clerks office for same in writing at least 15 days before the proposed date of use.
kk. 
1. 
Dogs, horses, animals or pets, domestic or wild, are not permitted within any Borough of Pine Hill park or recreation area at any time either on a leash or at large.
2. 
No person shall ride, drive, lead or keep a saddled horse or other animal within a Borough of Pine Hill park or recreation area except when a permit has been issued by the borough for a special event, such as a circus, pet show, fair, etc.
ll. 
1. 
No person shall pick flowers, foliage, berries or fruit or cut, break, dig up or in any way mutilate or injure any tree, shrub, plant, fern, grass, turf, railing, seat, fence, structure or any other object within a borough park or recreation area.
2. 
No person shall plant or bring into or upon any Borough of Pine Hill park or recreation area any tree, shrub, or plant or any newly plucked branch or portion of a tree, shrub or plant without written permission from the governing body.
3. 
No person shall dig up, excavate, quarry, or remove any dirt, stone, rock, sand or other substance whatever, or set off any blast, or cause or assist in doing any of said things within a Borough of Pine Hill park or recreation area.
4. 
No person shall build, construct, tear down, improve or alter any buildings or recreation fields or borough property without written permission from the governing body.
5. 
No person who is not a borough employee or approved volunteer, shall perform field maintenance in any Borough of Pine Hill park or recreation area without written permission from the governing body prior to any work being performed.
mm. 
No person shall build, light or maintain a fire within a Borough of Pine Hill park or recreation area except in a permanent grill installed, maintained or designated for that purpose by the Borough of Pine Hill. Portable grills and camp stoves are prohibited.
nn. 
No person shall coast with hand sleds, bobsleds, skis, carts, skateboards or other vehicles on wheels, or runners within a Borough of Pine Hill park or recreation area, except in areas so designated and posted for that purpose.
oo. 
No person shall throw, cast, catch, kick, or strike any baseball, golf ball, football, basketball or any other object within a Borough of Pine Hill park or recreation area except in areas designated and posted for that purpose.
pp. 
No person shall use motorized or powerless flying objects or devices, either for landing or taking off, within a Borough of Pine Hill park or recreation area except in areas designated and posted for that purpose.
a. 
Except for unusual and unforeseen emergencies, parks shall be open to the public every day of the year during designated hours. The opening and closing hours for each individual park shall be posted therein for public information and shall be determined from time to time by resolution of the Borough of Pine Hill.
1. 
Designated hours for opening and closing of parks and playgrounds. Parks and playground areas of the Borough of Pine Hill shall be open to the public from dawn to dusk only except in those areas lighted for night activities; provided, however, that all lights shall be extinguished at 9:30 p.m. prevailing time, Sundays to Thursdays, and at 10:30 p.m. prevailing time, Fridays and Saturdays. In the event there is a special occurrence held by the controlled youth organizations within the municipality, lights may be on later than 9:30 p.m. prevailing time, but only until such activities have been completed and visitors have left the area.
2. 
No person shall enter upon any parks or play areas at any other time except for emergency purposes, unless by permit of the Borough of Pine Hill.
b. 
No person shall, on the grounds of race, color, national origin, religion, age, sex, or handicap be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination in, any park facility, program, or activity.
c. 
Discrimination on the basis of residence, including preferential reservation, membership, or annual permit systems is prohibited except to the extent that reasonable differences in admission and other fees may be maintained on the basis of residence in any park.
d. 
Subsection 24-1.2 shall apply to all public parks, playgrounds and recreation areas owned or leased by the Borough of Pine Hill, including Veteran's Park.
Permits for special events/activities in parks must be obtained by application to the Borough of Pine Hill in accordance with the following procedures:
a. 
Definition. Special events/activities: Is any event or activities other than normal daily use activities; i.e. tournaments or any sports event controlled by the Youth Organizations or of persons, organizations or corporations for use of facilities by permit.
b. 
Permit Applications Procedures:
1. 
Permit applications shall be picked up and returned to the office of the Clerk with a certificate of insurance, 15 days before the proposed date of use.
2. 
Permit applications will be forwarded to the Board of recreation Commissioners for approval.
3. 
Board of recreation Commissioners shall approve or deny within a period of seven days from the receipt of the permit application and shall return application to the office of the Clerk for issuing a permit. From time of receipt of approval or denial of the permit application from the Board of recreation Commissioners, the Clerk shall have three working days to issue the permit or to comply with subsection 24-1.3b.
4. 
Application will be on a form approved by the governing body.
5. 
Liability insurance. The applicant for a permit is required to provide a certificate of insurance for comprehensive general liability with a minimum combined bodily injury and property damage limit of $1,000,000 and shall include the Borough of Pine Hill be named as an additional insured.
6. 
Appeal process. In the event the Board of recreation Commissioners deny a permit application the applicant has the right to appeal to the governing body of the Borough of Pine Hill in writing to the borough Clerk. The borough Clerk shall present the appeal to the governing body; appeal may be heard at the next regular council meeting.
c. 
Standards for issuance of a use permit by the Borough of Pine Hill shall include the following findings:
1. 
That the proposed activity or use of the park will not unreasonably interfere with, or detract from, the general public enjoyment of the park.
2. 
That the proposed activity and use will not unreasonably interfere with, or detract from, the promotion of public health, welfare, safety and recreation.
3. 
That the proposed activity or uses that are reasonably anticipated will not include violence, crime or disorderly conduct.
4. 
That the facilities desired have not been reserved for other use at the date and hour requested in the application.
d. 
Within 10 days after the receipt of an application for permit, the Borough of Pine Hill shall apprise an applicant in writing of its reasons for refusing a permit, and provide for an appeal process.
e. 
A permittee shall be bound by all park rules and regulations and all applicable ordinances fully as though the same were inserted in said permits.
f. 
The person(s) to whom the permit is issued shall be liable for all loss, damage, or injury sustained by any person whatever by reason of the negligence of the person(s) to whom such permit shall have been issued. The Borough of Pine Hill shall have the right to require any permittee to submit evidence of liability insurance covering injuries to members of the general public arising as a result of such permitted activities in such amounts as may be from time to time determined by the Borough of Pine Hill prior to the commencement of any activity or issuance of any permit.
g. 
Revocation. The Borough of Pine Hill shall have the authority to revoke a permit upon a finding of violation of any rule or ordinance, or upon good cause shown.
a. 
The Borough of Pine Hill or its designated agents shall, in connection with their duties imposed by law, diligently enforce the provisions of this ordinance.
b. 
The Borough of Pine Hill or its designated agents shall have the authority to eject from the park any person(s) acting in violation of this ordinance.
c. 
The Borough of Pine Hill or its designated agents shall have the authority to seize and confiscate any property, thing, or device in the park, or used, in violation of this ordinance.
d. 
This section shall also be enforced by the Borough of Pine Hill Police Department of the municipality.
e. 
Any person violating any of the provisions of this ordinance or any rule or regulation promulgated pursuant hereto, shall, upon conviction, be subject to the replacement, repair or restoration of any damaged park property and shall be subject to a fine not exceeding $500 and in default of payment thereof may be sentenced to imprisonment in the County Jail for a term not exceeding 90 days.
a. 
The Board of recreation Commissioners upon approval from the governing body, may restrict the use of a park area for an exclusive purpose and may charge fees accordingly for upkeep, improvement and supervision of same. Fees may be developed for each individual project and will be considered on an individual case basis. All fees shall be reasonable and nonrestrictive.
b. 
A fee schedule shall be prepared by the Board of recreation, Commissioners to be approved by the governing body by resolution. The schedule may include the following categories:
1. 
Yearly, seasonal, monthly, weekly, daily; individual, group or family;
2. 
Resident, nonresident, handicapped, senior citizens, disadvantaged;
c. 
Fees collected shall be used only for the operation, maintenance and/or for capital expenses related to the recreation facility or program as a whole provided, however, that priority shall be given to the facility for which the fee revenues were taken. A trust account shall be established by the Borough of Pine Hill for this purpose.
d. 
Fees collected for revenues from facilities leased for an approved temporary use (see N.J.A.C. 7:36-6.9) shall be used only for the operation, maintenance and/or for capital expenses related to the recreation facility or program as a whole.
e. 
Any payments, fees or rental shall be charged and collected directly by the Borough of Pine Hill and shall be used to offset the operating cost of the recreation programs as a whole in accordance with N.J.A.C. 7:36-1.8(e)
f. 
On parks/recreation areas considered Green Acres, no fee shall be charged over $2 per person, unless approved by the State Department of Environmental Protection, Bureau of Green Trust Management.
g. 
No change in the approved fee schedule for Green Acres parks or recreation areas over $2 shall be made without prior approval by the State Department of Environmental Protection, Bureau of Green Trust Management.
a. 
In areas where appropriate, signs indicating the accessibility of the facility to the handicapped shall be posted.
b. 
Permanent commercial billboards or any other type of displayed advertising or promotion of products or services is prohibited.
c. 
Posting of political campaign signs on the site is prohibited.
d. 
Posting of signs shall be placed at the entrance of each park, playground or recreation area designating the hours of operation according to subsection 24-1.2a,1.
e. 
Posting of signs shall be placed at the entrance of each park, playground or recreation area designating "Domestic Animals Prohibited In Park, Playground or Recreation Area."
f. 
Posting of signs shall be placed at the entrance of each park, playground or recreation area designating "Rules and Regulations" to comply with this section.
g. 
At Green Acres parks/recreation areas, a sign available from the New Jersey Department of Environmental Protection, Bureau of Green Trust Management, shall be in a prominent place indicating that the site was acquired and/or developed with State of New Jersey Green Acres Financial Assistance.
h. 
At Green Acres parks/recreation areas, posting of signs that restrict public access or use shall be approved by the Department of Environmental Protection, Bureau of Green Trust Management, in advance of posting.
a. 
Green Acre Lands designated for recreation and open space purposes are identified on the following list and may not be disposed of, or diverted for any other use than recreation or conservation purposes without prior written approval of the Department of Environmental Protection, Bureau of Green Trust Management and have been recorded with the Office of the Camden County Clerk.
1. 
Little Mill Road, Block 1.01, Lot 5;
2. 
Davis Avenue, Mills Lane and Hillside Avenue, Block 80, Lot 1-6 and 15-23;
3. 
Open Space adjacent to Penn Reading Seashore Line, Block 131, Lot 16;
4. 
DeCou Road Playground, Block 4, Lots 18, 20, 22, and 24;
5. 
Joey Green Recreation Area, Block 112, Lot 5 and 6, Turnerville/Hickstown Road; and
6.
