BOARD OF HEALTH
Shall mean the borough board of health.
PORTABLE SWIMMING POOL
Shall mean and include any pool consisting of a water tight container open at the top, made of fabric, plastic or any other material and supported by a frame and resting on the ground, capable of being wholly or partly filled with water, and so constructed or erected that it may be taken apart and stored when not in use. The term "portable swimming pool" shall further mean portable swimming pools capable of being filled to a water depth in excess of 15 inches, with sides higher than 24 inches with access made by ladder, ramp, step or steps or any other means and with a circumference greater than 35 feet.
PRIVATE SWIMMING POOLS
Shall mean any pool, tank or similar containers which are artificially constructed, designated or maintained for baths, wading or swimming purposes and used as an accessory to a residence by persons living therein or their guests. The term "private swimming pools" shall also include partly artifical swimming pools, which shall mean a pool formed by a natural body of water with a limited or controlled flow or which has an inadequate water flow that shall be maintained by artificial means. The term "private swimming pools" shall also mean a pool with a circumference of 35 feet or greater and capable of being filled to a water depth of 15 inches or more. The term "private swimming pool" shall further apply to pools located indoors or outdoors; and constructed or erected level with or below the ground or with sides less than two feet above ground level.
PUBLIC SWIMMING POOL
Shall mean either outdoor or indoor pools which are artificially or partly artificially constructed to provide recreational facilities to the general public for swimming, bathing or wading.
WADING POOL
Shall mean artificially constructed or erected pools not designated or used for swimming with a maximum circumference of 35 feet and a maximum water depth not exceeding 12 inches.
No person shall erect, construct, maintain, operate or use any swimming pool in the borough, except as herein provided, and unless the same complies with the requirements of this chapter in all respects.
It shall be unlawful to establish or construct a private or public swimming pool without first obtaining a permit therefor in the manner hereinafter prescribed. No permit shall be required for a wading pool.
Application for a permit to construct a private or public swimming pool accompanied by four sets of plans and specifications or proper descriptive brochures and a fee of $15 shall be made to the Building Inspector by the owner of the property. The Building Inspector shall not pass upon the structural features or durability of the pool except, in so far as may be necessary, to assure safe and sound construction in accordance with the generally acceptable principles of safe swimming pool construction and for the purpose of insuring compliance with the terms of this chapter. If the Building Inspector is satisfied with respect to the structural features of the proposed pool, he shall submit the plans and specifications or brochures to the Board of health which shall review the same for the purpose of assuring that the health and sanitary features and equipment of the pool are in accordance with the terms of this chapter. If the Board of health approves the plans and specifications, it shall cause a statement to that effect to be endorsed thereon and return the same to the Building Inspector.
All material used in the construction of private swimming pools shall be waterproof and easily cleaned. The bottom and sides of the pool shall be either white or a light color, except that aluminum paint shall not be used as a finish. Sand or earth bottoms shall not be used.
There shall be no physical connection between a potable water, public or private supply system and such private swimming pool at a point below the maximum water level of the pool or to a recirculating or heating system of a pool, unless such physical connection is so installed and operated that no pool water can be discharged or syphoned into a potable water supply system.
All private swimming pools shall be so constructed, installed and maintained as to provide necessary equipment for chlorination and other disinfection and filtering to comply with approved bacteriological standards as may be promulgated by regulations issued by the borough board of health.
Private swimming pools shall be so designed and constructed as to facilitate emptying and cleaning, and shall be maintained and operated in such a manner as to be clean and sanitary at all times. The interior of the pool shall be constructed with a smooth finish. Inlets shall be so located and spaced as to secure satisfactory dispersion of inflowing water throughout the pool, and to permit draining, cleaning and disinfecting of the bottom and the sides.
No artificial lighting shall be maintained or operated in connection with any private swimming pool, wading pool, tank or plunge in such manner as to be a nuisance or an annoyance to neighboring properties.
All private swimming pools now existing or hereafter constructed, installed, established or used shall be enclosed by a permanent fence of durable material at least four feet in height, which fence shall be so constructed as not to have openings, mesh, holes or gaps larger than four inches in any dimension except for doors and gates; if a picket fence is erected or maintained the spacing between pickets shall not exceed four inches. All gates used in conjunction with the fence shall meet the same specifications as the fence itself, and shall be equipped with approved locking devices which shall be self closing, and shall be locked at all times when the private swimming pool is not in use.
All portable swimming pools, in lieu of fencing, may be equipped with a suitable strong cover, which shall be put in place and locked at all times when the occupant of the dwelling to which the pool is an accessory or some other responsible person delegated by him is not either in the pool or attendant thereon. If a portable swimming pool is equipped with a ladder, stairway, or ramp in order to facilitate entry into the same, such ladder, stairway, or ramp shall be removed when the pool is not in use and temporarily unattended.
None of the installations as set forth in section 14-1 shall be erected or placed nearer to a street property line or nearer to a side or rear property line than herein set forth:
Residential A and B:
Front — Not less than required setback for home.
Rear and Sides — Minimum 15 feet from property line.
Corner residences — Minimum of 25 feet from corner of property line.
No private swimming pool, portable swimming pool or wading pool shall be constructed or installed on any lot unless the lot is located a residence building as permitted in the zoning chapter of this revision.
Any nuisance which may exist or develop, in or in consequence of, or in connection with any private swimming pool, portable swimming pool, wading pools, tank or plunge, shall be abated or removed by the owners.
Whenever any private swimming pool, portable swimming pool, wading pool, tank or plunge, by reason of mechanical defects or lack of supervision is, in the opinion of the Board of health, polluted and detrimental to health, it shall be summarily closed.
Owners or persons in possession of private swimming pools, portable swimming pools, wading pools, tanks or plunges shall allow the sanitary inspector and the Building Inspector access to inspect the pool and the appurtenances at any time that may be required by the Board of health or the Building Inspector.
The Board of health may cause any pool, tank or plunge subject to this chapter to be inspected for compliance with the borough plumbing code.
Any accessory buildings, such as locker rooms, bath houses, cabanas, shower rooms, toilets, runways or any other physical facility or equipment incident to the operation of any of the above described shall be in conformance with the rules and regulations of both the Board of health and the building code of the borough.
Public swimming pools shall be constructed, maintained, located, altered and operated in accordance with the "Swimming Pool Code of New Jersey (1955)".
It shall be the duty of the police department of the borough to enforce the provisions of this chapter pertaining to regulations, permits and safety equipment and requirements.
