This chapter shall be known and may be cited as the "Ordinance Establishing and Fixing Fees for Inspection and Permits Issued by the Board of Health."

a. 
For the purpose of this chapter, the following terms, phrases, words and their derivations shall have the meanings given herein. When not inconsistent with the context, words used in the present tense include the future, words in the plural number include the singular, and words in the singular number include the plural number. The word "shall" is always mandatory and not merely directory.
b. 
As used in this chapter, the following terms shall have the meanings indicated:
ALTER
Shall mean the replacing or repairing of any portion of an existing individual sewage disposal system.
APPLICANT
Shall mean any person making written application to the Board of Health or other designated person for the inspection or permits referred to in this chapter.
BOARD OF HEALTH
Shall mean the Board of Health of the Township of Holmdel.
KENNEL
Shall mean any establishment wherein or whereon the business of boarding or selling dogs or breeding dogs for sale is carried on, except a pet shop.
PET SHOP
Shall mean any room or group of rooms, cage or exhibition pen, not part of a kennel, wherein dogs for sale are kept or displayed.
POUND
Shall mean an establishment for the confinement of dogs seized either under the provisions of this chapter or otherwise.
RETAIL FARM MARKET
Shall mean a permanent building to which the general public is invited for the purpose of retail sales of vegetables, fruit, flowering farm products and other goods and services.
SHELTER
Shall mean any establishment where dogs are received, housed and distributed without charge.

The following fees shall be paid with respect to an individual sewerage disposal system:
a. 
Septic system submission: $100.
b. 
Septic system revised submission fee (each revision): $50.
c. 
Permit to install an individual sewerage disposal system: $150.
d. 
Permit to alter or repair an existing individual sewerage disposal system: $100.
e. 
For the witnessing of each permeability test for each individual lot as required by the Board of Health, in addition to any and all fees required by this section: $100.
f. 
For the witnessing of each soil boring test for each individual lot as required by the Board of Health, in addition to any and all fees required by this section: $50.
g. 
For each reinspection of an individual sewerage disposal system, or part thereof, caused by the failure of the licensee to locate and construct or alter the same in accordance with the terms of the license issued or the terms of the aforesaid standards: $50.
h. 
Final grade inspection/certification: $25.

The following fee schedule is hereby fixed for the review of site plans in connection with retail food establishments:
a. 
Initial Review:
Up to 1,000 square feet

b. 
Reinspection fee in connection with all site plan reviews shall be $30.

The following fee schedule is hereby fixed for the issuance of retail food establishment permits:
a. 
Any retail establishment engaged only in the sale of prepackaged food and not potentially hazardous in nature, the fee for the permit shall be $50.
b. 
The permit fee for restaurants, luncheonettes, fast food restaurants and taverns shall be based upon capacity as follows:
1 to 50 seats

c. 
The permit fee for offices, plants, school cafeterias and nursing homes shall be based upon the square footage of kitchen preparation and dining areas as follows:

d. 
The permit fee for supermarkets and retail food establishments shall be based upon the square footage of the establishment as follows:

e. 
A retail farm market as defined herein shall be required to obtain a retail food permit and the fee shall be based upon the square footage of the market as follows:

f. 
The permit fee for day care centers with on-site food preparation shall be based upon the square footage of the kitchen preparation and dining areas as follows:

The permit fee for day care centers serving prepackaged food only shall be $60.
The permit fee for licensed nonprofit day care centers shall be $30.
g. 
The permit fee for mobile units shall be $75.
h. 
The permit fee for licensed nonprofit organization facilities shall be $30.
i. 
The permit fee for a temporary food license, which shall be limited to a carnival, fair, etc. of up to a two-day duration, shall be $25 for each vendor and three days or more shall be $50 for each vendor.
j. 
Reinspection Fees. The fee for any reinspection of a retail food establishment as set forth in this section shall be $30.
k. 
Vending Machines. The fee for a vending machine dispensing food for human consumption shall be $25 per machine where the cost per item dispensed by the machine is $0.25 or less, and $100 per machine where the cost per item dispensed is $0.26 or more. Reinspection fees for all vending machines shall be $10. No fee shall be charged under this section where a vending machine is owned by a charitable organization as defined by the Internal Revenue Code.

The fee for the conduct of a dye test shall be $50.

The fee for conducting an analysis of potable (microbiological) water sample shall be $50.

Each and every dog shall be duly licensed and shall wear proof of such license at all times, in accordance with the laws of New Jersey. The annual fee for such license shall be $21 per year to be paid by an owner for any dog, provided that the fee shall be $18 per year for any dog when the owner has presented a certificate signed by a licensed veterinarian stating that the dog has been spayed or neutered. Every applicant shall include a self-addressed stamped envelope for use by the Board. The licenses, registration tags, and the renewal thereof shall expire on the last day of January of each year. A late fee in the amount of $5 for each and every dog licensed after the 31st day of January of any year shall be assessed. Thereafter, after the last day of each month that a dog remains unlicensed, an additional late fee in the amount of $5 shall be assessed.

a. 
License Required. Any person who keeps or operates or proposes to establish a kennel, pet shop, shelter or pound shall apply to the Township Clerk for a license entitling him to keep or operate such establishment. Any person holding such license shall not be required to secure individual licenses for dogs owned by such licensee and kept at such establishments; such licenses shall not be transferable to another owner or different premises.
b. 
Application Information. The application shall contain the following information:
1. 
The name and permanent and local address of the applicant.
2. 
The street address where the establishment is located or proposed to be located, together with a general description of the premises.
3. 
The purpose for which it is to be maintained.
4. 
The maximum number of dogs to be accommodated by such establishment at any one time.
c. 
Approval of Health Officer. No license shall be issued until the proposed licensee submits a written statement from the Health Officer of the Board of Health that the establishment or proposed establishment complies with local and State rules governing the location of and sanitation at such establishment.
d. 
License Term. All licenses issued for a kennel, pet shop, shelter or pound shall state the purpose for which the establishment is maintained, and all such licenses shall expire on the last day of June of each year.
e. 
License Fees. The annual license fees for kennel and pet shop licenses shall be as follows:
1. 
Kennel accommodating 10 or less dogs: $10.
2. 
Kennel accommodating more than 10 dogs: $25.
3. 
Pet shop: $10.
4. 
Shelter or pound: no fee.
f. 
Compliance with State Regulations.
1. 
All licenses issued for a kennel, pet shop, shelter or pound shall be subject to revocation by the Township Committee on recommendation of the State Department of Health or the Board of Health for failure to comply with the rules and regulations of the State Department of Health or the Board of Health, after the owner has been afforded a hearing by either the State Department of Health or the Board of Health.
2. 
Any person holding a license to establish, keep or operate a kennel, pet shop, shelter or pound shall comply with all township ordinances and the rules and regulations promulgated by the State Department of Health governing the sanitary conduct and operation of kennels, pet shops, shelters and pounds, the preservation of sanitation therein, and the prevention of the spread of rabies and other diseases of dogs within and from such establishments.
g. 
Reports to State Health Department. The Clerk shall forward to the State Department of Health a list of all kennels, pet shops, shelters and pounds licensed within 30 days after the licenses thereof are issued, which list shall include the name and address of the licensee and the kind of license issued.
h. 
Control of Dogs Off Premises. No dog kept in a kennel, pet shop, shelter or pound shall be permitted off such premises, except on a leash or in a crate or other safe control.

The fee for a potable water well or irrigation water well inspection shall be $75.

The following fees shall be paid with respect to vital statistics documents:
a. 
Fee for certified copies of birth, marriage, domestic partnership, civil union, and death certificates: $15
b. 
Processing fee for corrections to birth, marriage, domestic partnership, civil union and death certificates: $10
c. 
Fee for a search per each year searched: $1.

The following fee schedule is hereby fixed for public recreational bathing establishments as defined in the New Jersey Sanitary Code (N.J.A.C. 8:26-1 et seq.):
a. 
For review of site plans in connection with a public bathing place as defined in N.J.A.C. 8:26-1.3: $50.
b. 
For the annual permit in connection with a public bathing place as defined in N.J.A.C. 8:26-1.3: $100.
