Upon the basis of an engineering study of the weight and size restrictions based on the conditions of highway or bridge pursuant to Title 67, § 201.81, and 75 Pa.C.S.A. § 4902(a) of the Pennsylvania Vehicle Code, conducted by Michael J. Haberman and prepared by The Gateway Engineers, Inc., 400 Holiday Drive, Suite 300, Pittsburgh PA 15220-2727, this being the applicable study information undertaken by the Board of Supervisors of Brady Township, Butler County, Pennsylvania, that the Township roads may be damaged or destroyed unless the permissible weight of motor vehicles is restricted to a maximum weight of 10 tons and/or 15 tons as set forth above on all listed roads in the designated sections. The Township of Brady, Butler County, Pennsylvania, therefore, authorizes the enforcement of the maximum weight limits of 10 tons and/or 15 tons as set forth above and the installation and placement of the applicable signage on the Township roads as set forth in the engineering study.
Except when a special hazard exists that requires an emergency vehicle or the proper permit is obtained as described below, noncompliance with the maximum weight limit restrictions as set forth above will be enforced as directed by the Motor Vehicle Code, all vehicles traveling said Township roads as set forth above shall be required to limit their weight to a maximum of 10 tons and/or 15 tons as set forth above, and no person shall violate the provisions of the weight restriction with the same enforced under the Motor Vehicle Code.
The said Township road weight restriction set forth above shall be clearly posted in accordance with state law and the rules and regulations of the Department of Transportation, which shall require the posting of the required notice signs as applicable and in the time frames and required distances for the same.
The Township of Brady, Butler County, Pennsylvania, pursuant to Chapter 189 of Pennsylvania Code, will issue permits for the movement of motor vehicles or combinations with weights in excess of the restrictions imposed under this article conditioned upon the execution of an approved form of security in favor of the said Township to cover the cost of repairs and restoration necessitated by the movement. All vehicles with weights in excess of the restrictions imposed under this article must comply with the terms and conditions of Brady Township's Heavy Hauling Permit. Further, vehicles with weights in excess of the restrictions must execute an Excess Township Road Maintenance Agreement and Performance Bond Agreement to be in compliance with said Township.
Any person in violation of this article is guilty of a summary offense and shall upon conviction, be sentenced to pay a fine of $75, except that any person convicted of operating a vehicle with a gross weight in excess of a posted weight restriction shall upon conviction, be sentenced to pay a fine of $150 plus $150 for each additional 500 pounds, or part thereof in excess of 3,000 pounds over the maximum allowable weight under this article. See 75 Pa.C.S.A. § 4902(g)(1).
The Board of Supervisors of Brady Township, Butler County, Pennsylvania, does hereby revoke any inconsistent ordinances and declares that Ordinance No. 2012-4 supersedes any and all ordinances on this matter.
