There is established and continued in the Borough of Pompton
Lakes, pursuant to Chapter 264 of the Public Laws of 1948, as amended,
(N.J.S.A. 2B:12-1 et seq.), a Municipal Court, to be known as the
"Municipal Court of the Borough of Pompton Lakes."

The Municipal Court shall have a Seal which shall bear the impress
of the name of the Court in the form and design as shall be determined
by the Mayor and Borough Council.

The Court shall be presided over by a Judge to be appointed
by the Mayor, with the advice and consent of the Borough Council,
for a term of three years from the date of his appointment and until
his successor is appointed and qualified. Such Judge shall be a resident
of this state and shall be an attorney at law of the State of New
Jersey. The Judge need not be a resident of the Borough of Pompton
Lakes. The Judge shall, before entering upon the duties of his office,
take and subscribe an oath in substantially the same manner as provided
by law. Compensation for the Judge shall be as provided in the Salary
Ordinance.

The Mayor and Council may, by ordinance, provide for employees
and other assistants for the Municipal Court and provide for their
compensation.

There shall be an Administrator of the Municipal Court who shall
be appointed by the Mayor and with the advice and consent of the Council,
and who shall serve at the pleasure of the Borough Council, subject
to the tenure provision of N.J.S.A. 2A:8-13.1. The Municipal Court
Administrator shall hold a Municipal Court Administrator Certificate
as required by N.J.S.A. 2B:12-11. The Municipal Court Administrator
shall receive an annual salary, as specified in the Salary Ordinance.
The Municipal Court Administrator shall perform such functions and
duties as shall be prescribed by law, the rules applicable to Municipal
Courts, and by the Judge of the Municipal Court.

The Mayor and Council may, by ordinance or resolution, designate any officer or employee of the Borough of Pompton Lakes to serve as Municipal Court Administrator of the Municipal Court, with or without additional compensation and subject to the qualification provisions of Subsection
2-48.5.

The Mayor and Council shall provide for the necessary accommodations
and supplies for the Municipal Court.

Said Municipal Court shall have jurisdiction over all matters
for which authority is granted under State Statute or Rules of the
Court.

Said Municipal Court and the Judge thereof shall have jurisdiction
over all matters for which authority is granted under State Statute
or Rules of the Court.

Whenever the Judge of said Municipal Court shall be unable to
sit as such Judge, he may designate any other Judge of any Municipal
Court to sit for him temporarily and hold said Municipal Court, provided
that the designation of his substitute is made in writing, and which
said designation shall be filed in said Court, and any such person
so designated, while sitting temporarily, shall have all of the powers
of the Judge of the Municipal Court.

No Judge appointed under this chapter shall practice law in
any municipal court in the County of Passaic nor upon appeals from
such municipal courts or contrary to State Statute or the Rules of
Court.

The costs and fees charged and collected against the defendants,
shall become the revenue of either or both the Pompton Lakes and such
other government entity of the State of New Jersey or its political
subdivisions or agencies as established by State Statutes and rules
and regulations of Court.

A. Position established. Pursuant to N.J.S.A. 2B:24-1 et seq., there
shall be a Public Defender in and for the Borough of Pompton Lakes.
B. Appointment; compensation. The Public Defender shall be appointed
by the Mayor with the advice and the consent of the Borough Council
for a term of one year. The compensation for the Public Defender shall
be as provided in the Salary Ordinance or by contract by and between
the Public Defender and the Borough, in the sole discretion of the
Borough.
C. Qualifications; duties. The Public Defender shall be an attorney
admitted in the State of New Jersey who shall defend persons who are
otherwise unable to hire any other attorney as determined in the sole
discretion of the Judge of the Municipal Court.
D. Application for Services. Any person unable to hire an attorney shall
apply to the Municipal Court of the Borough of Pompton Lakes for representation
by the Public Defender and pay to the Borough an application fee as
required by the Court and consistent with State Statutes and the Rules
of Court. The Municipal Court may waive such required application
fee in whole or in part if the Court determines, in its discretion,
that the application fee represents an unreasonable burden on the
person seeking such representation.
E. Reimbursement for services received. Any person who receives the
services of the Municipal Public Defender shall reimburse the Borough
of Pompton Lakes for said services in an amount not to exceed $200
or such other amount as may be revised or amended by State Statute
or Rules of Court.
