Whenever any words and phrases are used in this chapter, the
meaning respectively ascribed to them in Subtitle 1 of Title 39 of
the Revised Statutes of New Jersey shall be deemed to apply to such
words and phrases used herein.

Whenever certain hours are named in this chapter, they shall
mean either Eastern Standard Time or Eastern Daylight Savings Time
as may be in current use.

A. The
Chief of Police of this Borough, is hereby authorized to provide by
regulation for the closing of any street or portion thereof to motor
vehicle traffic on any day or days during specified hours on any day
or days whenever he finds that such closing is necessary for the preservation
of the public safety, health or welfare.
B. Any
regulations promulgated by the Chief of Police and in accordance with
paragraph A above, shall provide for the posting of proper warning
signs of such closing on any street or portion thereof during the
time the same is closed in pursuance thereof.
C. Any
violation of this regulation promulgated thereunder shall be punished
by a fine not to exceed $100. (N.J.S.A. 39:4-94.2)
D. Any
regulation adopted that mandates the closing of any street for a period
greater than 48 consecutive hours shall not become effective unless
and until it has been submitted to and approved by the Commissioner
of the Department of Transportation.

Any vehicle parked in violation of this chapter shall be deemed
a nuisance and a menace to the safe and proper regulation of traffic,
and any Police Officer may provide for the removal of that vehicle.
The owner shall bear the reasonable costs of removal and storage which
may result from such removal before regaining possession of the vehicle.

A. Unless
another penalty is expressly provided by New Jersey statute or specifically
set forth otherwise in this chapter, every person convicted of a violation
of a provision of this chapter or any supplement thereto shall be
liable to a penalty of $25.
B. Court
costs for violations of the following sections shall be reduced to
$10:
1. Section
7-12, Parking time limited;
2. Section
7-13, Metered parking (overtime);
3. Section
7-44.1, Pond Hole parking lot.

If any part or parts of this chapter are, for any reason, held
to be invalid, such decision shall not affect the validity of the
remaining portions of this chapter.

The effectiveness of each separate section or part of section
of this chapter is contingent on the erection of signs as required
by law. The failure to erect the appropriate sign shall not be construed
to limit the effectiveness of any other part of this chapter except
to the extent that the particular regulation is directly affected
by the absence of the sign or signs as required by law.

The Borough hereby finds and declares that problems of traffic
control occur when traffic must be moved through or around street
construction, maintenance operations, and utility work, above and
below the ground, which requires blocking the street and obstructing
the normal flow of traffic; and that such obstructions are or can
become dangerous when not properly controlled. In order to better
promote public health, safety peace and welfare, it is necessary to
establish controls and regulations when construction, maintenance,
repairs or utility work require blocking the streets and obstructing
the normal flow of traffic.

The Borough of Pompton Lakes hereby adopts the current Manual
on Uniform Traffic Control Devices, hereafter known as "MUTCD," as
same may be supplemented and amended. The MUTCD controls and regulates
traffic whenever construction, maintenance operations or utility work
obstructs the normal flow of traffic. Any person, entity, contractor
or utility that fails to comply with the provisions of MUTCD while
performing such work is in violation of this chapter.

A person, entity, contractor or utility wishing to conduct work
on, under or above any roadway within the Borough of Pompton Lakes
shall provide the Borough of Pompton Lakes Police Department Traffic
Safety Bureau with at least two emergency contact phone numbers. These
numbers are to be used in case of emergency problems at the construction
or maintenance site, or arising from the construction or maintenance
being performed, prior to the start of any work. If for any reason
an emergency contact cannot be reached, or if the emergency contact
person does not respond in a timely manner to the call from the Borough
of Pompton Lakes Police Department to correct a hazardous condition,
the Borough of Pompton Lakes may respond to correct such hazardous
conditions. The reasonable fees for such emergency service by the
Borough shall be charged to the person, entity, contractor or utility
responsible for such conditions.

A. It shall be the responsibility of the person, entity, contractor,
or utility as required under N.J.A.C. 16:25-9.2 wishing to conduct
work on, under or above the roadway, to contact the Pompton Lakes
Police Department in order to arrange a preconstruction meeting to
submit plans for the safe movement of traffic during such period of
construction work. The preconstruction meeting shall take place at
least one week prior to the start date of the construction or maintenance
work. The Borough of Pompton Lakes Chief of Police or designee shall
determine the required number of off-duty Police Officers or Special
Police Officers required to ensure the safe movement of traffic in
the construction or maintenance zone. Any person, entity, contractor
or utility who fails to submit and secure approval for its traffic
plan prior to the start of work shall be deemed to be in violation
of this chapter. The requirement to obtain approval of the plans shall
be in addition to any other permit or other approval required by any
other federal, state or municipal law, ordinance or regulation.
B. Public utilities conducting routine maintenance work are not required
to comply with the preconstruction meeting requirement.

A. The Pompton Lakes Police Department shall maintain a list of all
roads determined to be heavily traveled for the purposes of this section.
Such determination shall be made by the Police Department and shall
be binding. This list may be amended from time to time as conditions
warrant to include roads which become heavily traveled due to temporary
conditions or events. This list shall be available for inspection
during normal business hours, and a copy shall be provided upon request
of any party.
B. There shall be no construction, maintenance operations or utility
work under, on or above any heavily traveled roadway, as defined in
paragraph A, before the hour of 9:00 a.m. or after 4:00 p.m. This
time limit may be adjusted to permit work prior to 9:00 a.m. or after
4:00 p.m. by the Chief of Police or designee. If it is determined
by the Police Department that the construction or maintenance operations
prior to 9:00 a.m. or after 4:00 p.m. on any roadway would substantially
delay traffic or cause a safety or health hazard, the work shall then
be permitted only between 9:00 a.m. to 4:00 p.m.

Road closings and/or traffic detours shall not be permitted
unless approved by the Borough of Pompton Lakes Chief of Police or
designee. Advance notice of detours must be given to motorists, except
in emergent situations as determined in the sole discretion of the
Chief of Police or designee, Borough Administrator or Borough Engineer.

The Borough of Pompton Lakes Police Department shall have sole
responsibility to immediately notify all affected agencies, including
but not limited to police, fire, EMS, and the school transportation
office, or any work or construction upon or near a roadway within
the Borough of Pompton Lakes that would delay or interfere with the
provision of service. Such notification shall be made in a manner
pursuant to, and in compliance with, the Borough of Pompton Lakes
Police Department's policy and procedures.

A. Any person, entity, contractor or utility wishing to conduct work
on, under or above any roadway within the Borough of Pompton Lakes,
which is anticipated to take longer than one hour, shall be required
to hire off duty Borough of Pompton Lakes Police Officers or Special
Police Officers, when determined by the Borough of Pompton Lakes Chief
of Police or designee to be necessary to ensure compliance with the
MUTCD, as well as to control traffic through the work zone.
B. The Borough of Pompton Lakes Police Department shall be contacted
at least 48 hours before starting work to arrange for the hiring of
off duty Police Officers or Special Police Officers.
C. All work on, under or over any roadway within Borough of Pompton
Lakes which is anticipated to take less than one hour may be controlled
with civilian flagmen, unless off duty Officers or Special Police
Officers are deemed necessary and approved by the Borough of Pompton
Lakes Chief of Police or designee. All civilian flagmen shall wear
high-visibility safety apparel that meets the Performance Class 2
or 3 requirements of the ANSI/ISEA 107-2004 publication entitled "American
National Standard for High-Visibility Apparel and Headwear" and must
be trained in safe traffic control practices and public contact techniques.
If flagmen cannot see each other, they must have radio communication
between them.
D. If the work requires any road to be closed to traffic 24 hours a
day, the hiring of off duty Officers or Special Police Officers shall
only be required when deemed necessary and approved by the Borough
of Pompton Lakes Chief of Police or designee.

A. In the case of emergency repair work where construction, maintenance
operations or emergency utility work must be performed that will obstruct,
interfere or detour traffic on any roadway in the Borough, the person,
contractor or utility performing such operation shall notify the Pompton
Lakes Police Department of such emergency operation. The person, contractor
or utility shall disclose the nature of the emergency, location and
hours of operation.
B. All emergency construction and maintenance operations shall be performed
with full regard to safety and to keep traffic interference to an
absolute minimum. During such emergency repair work, the person, contractor
or utility shall comply with the provisions of the MUTCD and this
chapter while performing such emergency repair work.

No materials, vehicles, or equipment are to be placed in any
roadway or sidewalk areas until all construction, signs, lights, devices
and pavement markings are installed and approved. All construction,
maintenance or work signs that will not apply during the work-zone
safety operation such as "Flagman Ahead" signs must be bagged or removed
from view of motorists when the work is completed at the end of each
day.

The Borough of Pompton Lakes Police Department, Borough Administrator
or Borough Engineer shall have the authority to stop work, including
the removal of equipment and vehicles, stored material within the
street right-of-way, backfilling of open excavations and/or other
related work, in order to abate any nuisance, traffic delay and/or
safety hazard or for any violation of this section.

Unless another penalty is provided by New Jersey statute, every person, entity, contractor or utility convicted of a violation of a provision of this chapter shall be subject to the penalties set forth in the Borough Code, Section
1-5, General Penalty. Except as otherwise provided, every day on which a violation of any provision of this section exists shall constitute a separate violation.

The provisions of this chapter imposing a time limit on parking
shall not relieve any person of the duty to observe other more restrictive
provisions prohibiting or limiting the stopping or standing or parking
of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey
Statute or as hereinafter provided.

A. Upon
the declaration of an emergency, there shall be no parking upon streets
or sections of streets where temporary EMERGENCY NO PARKING signs
are displayed. The Chief of Police or, in his absence, the ranking
Police Officer is authorized to declare an emergency and to direct
the posting of EMERGENCY NO PARKING signs when weather conditions,
accidents, road construction, fire or public celebrations dictate
or require avoidance of hazards or other conditions which interfere
with the free flow of traffic. Notification that EMERGENCY NO PARKING
signs are being or will be posted shall be given to the operator or
owner of any vehicle which has been parked prior to the posting of
the signs.
B. The
effectiveness of this section is contingent upon the signs being erected
as required by law.

A. Whenever snow has fallen and the accumulation is such that it covers
the street, highway or thoroughfare to such a depth that snow removal
or plowing is necessary, thus creating an emergency, it shall be unlawful
for any vehicle to be parked on any street in the Borough of Pompton
Lakes. The above parking prohibition shall remain in effect after
the snow has ceased until the streets have been plowed sufficiently
to the extent that parking will not interfere with the normal flow
of traffic.
B. Upon declaration of an emergency, there shall be no parking upon
streets or sections of streets where temporary emergency no-parking
signs are displayed. The Chief of Police or, in his absence, the ranking
Police Officer is authorized to declare an emergency and direct the
posting of said emergency no-parking signs when weather conditions,
accidents, fire, flood, construction, obstructions or public celebrations
dictate or require the avoidance of hazards or other conditions which
interfere with the free flow of traffic. Notification that emergency
no-parking signs are being or will be posted shall be given to the
operator or owner of any vehicle which has been parked prior to the
posting of the signs.
C. Any unoccupied vehicles parked or standing in violation of this section
shall be deemed a nuisance and a menace to the safe and proper regulation
of traffic, and any Police Officer may provide for the removal of
such vehicle. The owner shall pay the reasonable cost of the removal
and storage which may result from such removal before regaining possession
of the vehicle.
D. As to signs that are posted that prevent vehicles from parking on
any street in the Borough of Pompton Lakes between the hours of 2:00
a.m. and 6:00 a.m. between November 15 and March 15, that proscription
on the sign is hereby nullified. However, to the extent that those
same signs indicate that there is no overnight parking when streets
are snow-covered, that portion of the sign shall remain in full force
and effect and is not amended by this section.
E. Unless another penalty is expressly provided by New Jersey statute,
every person convicted of violation or provision of this section or
any supplement thereto shall be liable to a penalty of $25 or imprisonment
for a term not exceeding 15 days, or both.

A. No person shall park a vehicle upon any of the following described
streets or parts of streets while the meter for the parking space
indicates that the vehicle occupying such space has already been parked
beyond the period prescribed for such parking space or for more than
three hours, irrespective of the signal on the meter, between the
hours and on the days specified. This regulation shall not apply on
Sundays and on New Year's Day, Memorial Day, Independence Day, Labor
Day, Thanksgiving Day and Christmas Day.
1. Cause, allow, permit or suffer any vehicle registered in the name
of or operated by such person to be parked overtime or beyond the
period of legal parking time established for any parking meter zone
as herein described or to deposit in any parking meter any coin for
the purpose of parking beyond the maximum legal parking time for the
particular parking meter zone.
2. Permit any vehicle to remain or be placed in any parking space adjacent
to any parking meter while said meter is displaying a signal indicating
that the vehicle occupying such parking space has already been parked
beyond the period prescribed for such parking space.
3. Park any vehicle across any line or marking of a space or in such
position that the vehicle shall not be entirely within the area designated
by such lines or markings.
4. Deface, injure, tamper with, open or willfully break, destroy or
impair the usefulness of any parking meter installed under the provisions
of this section.
5. Deposit or cause to be deposited in any parking meter any slugs,
device or metal substance or other substitute for lawful coins.
6. Park at any time within parking meter zones except in designated
individual parking spaces and within the lines or markings designating
such spaces.
B. In such zones and such other parking meter zones as may be hereafter
created by ordinance or regulation of the Borough of Pompton Lakes
there shall be installed parking meters and there shall be designated
parking meter spaces in accordance with the provisions of this section.
C. Placement and operation of meters.
1. Such parking meters shall be placed on the curb alongside or next
to individual parking spaces as hereinafter provided. Each parking
meter shall be so set as to show or display a signal that the parking
space adjacent thereto is not in use. Each parking meter shall be
installed and set to display a signal indicating legal parking upon
a coin of the United States being deposited in such meter. Upon the
deposit of one quarter ($0.25), such signal shall indicate legal parking
for a period of one hour; upon the deposit of two quarters ($0.50),
such signal shall indicate legal parking for a period of two hours;
and upon the deposit of three quarters ($0.75), such signal shall
indicate legal parking for a period of three hours.
2. Each meter shall, by its device, clearly set out and continue in
operation from the time of depositing of such coin or coins until
the expiration of the time paid by the parker. Each meter shall be
so arranged that, upon the expiration of the time paid for, it will
indicate by mechanical operation and display of proper signal that
the lawful parking period has expired. The maximum legal parking time,
irrespective of the number of coins deposited, shall not exceed the
maximum period hereinbefore set forth.
D. Parking in designated spaces; overtime parking. The Superintendent
of Public Works is hereby directed to have lines or markings painted
or placed upon the curb and upon the street adjacent to each parking
meter for the purpose of designating the parking space for which said
meter is to be used, and each vehicle parked alongside of or next
to any parking meter shall park within the lines or markings so established.
It shall be unlawful and a violation of this section to park any vehicle
across any such line or marking or to park said vehicle in such position
that the same shall not be entirely within the area so designated
by such line or markings. All vehicles shall be parked parallel to
the adjacent curb or sidewalk, and any vehicle parked in such parking
space shall be parked so that the parking meter is either immediately
to the front or immediately to the rear of the parked vehicle. When
any vehicle shall be parked in any space immediately to the rear or
immediately to the front of a meter which is located in accordance
with the provisions of this section, the operator of said vehicle
shall, upon entering said parking space, immediately deposit or cause
to be deposited in the parking meter nearest the space designated
for parking said vehicle such coin or coins of the United States as
may be required to operate said meter, and said parking space may
then be lawfully occupied by such vehicle for the period paid for
at the rate hereinbefore specified. If such vehicle shall remain parked
in any such parking space beyond the period so paid for by the deposit
of such coin or coins, the parking meter shall display a sign or signal
showing illegal parking, and in that event, such vehicle shall be
considered as parked overtime and beyond the period of legal parking
time. The parking of a vehicle overtime or beyond the period of legal
parking time in any such part of a street where any such meter is
located shall be a violation of this section and punishable as hereinafter
set forth.
E. Collection of meter coins. It shall be the duty of the Mayor and
Council of the Borough of Pompton Lakes to employ and designate a
person or persons to make regular collections of the money deposited
in said meters, and it shall be the duty of such person so designated
to remove the coins from the parking meters to place them in a sealed
container and deliver said sealed container, with seal unbroken, to
the Borough Treasurer or a bank designated by the Treasurer.
F. Impounding of vehicles; redemption. Any vehicle unlawfully parked within any parking meter zone for a period in excess of 24 hours may be taken into possession by the Police Department of the Borough of Pompton Lakes and towed to some proper storage place and held there until the penalty provided for in Section
7-4 of this chapter is paid and until the further costs covering towage and any and all reasonable storage charges incurred by the Borough of Pompton Lakes in storing said vehicle shall also have been paid.
G. Enforcement. It shall be the duty of the Pompton Lakes Police Department
to enforce the provisions of this section and also any other person
or persons lawfully delegated for that purpose by the Mayor and Borough
Council.

The purpose of this section is to reduce hazardous traffic conditions
resulting from the overflow of traffic onto and the overcrowding of
streets exclusively or primarily serving residential areas in order
to protect those streets and their inhabitants from polluted air,
excessive noise and the trash and refuse caused by the entry of such
vehicles; to protect the residents of such streets from unreasonable
burdens in gaining access to their residences; to preserve the maintenance
of the streets in such areas in a clean and safe condition; to preserve
and protect the safety of children and other pedestrians and traffic
on said streets; to reduce air pollution and other deleterious environmental
effects of vehicular commuting; to encourage reliance upon car pools
and other means of mass transit, and generally to promote, preserve
and protect the peace, good order, comfort, convenience, health, safety
and welfare of the citizens and inhabitants of the Borough.

Parking shall be limited from 8:00 p.m. to 8:00 a.m., Monday through Sunday, for permit and sticker parking only on the streets designated in subsection
7-17.6 of this section.

The following vehicles shall be exempt from the provisions of subsection
7-17.2:
A. Emergency Vehicles. Emergency vehicles and public service, telephone
and other public utility vehicles may park within parking area during
the time they are rendering service or repairs within the area.

The Borough Administrator, or his/her designee, shall periodically
cause traffic studies to be performed in residential areas. Where
such studies reveal that certain streets or parts of streets primarily
servicing residential land uses are being used for parking by drivers
who do not reside on said streets, thereby causing a shortage of parking
spots for the residents of those streets, the Administrator shall
recommend to the Borough Council that such streets be included within
the regulations of this section. A street shall be deemed to have
a shortage of residential parking spots where an average of 25% or
more of the parking spots are occupied by vehicles owned by nonresidents
of the street block and an average of 65% or more of the parking spots
are occupied during weekdays from 9:00 a.m. to 5:00 p.m.

Applications for stickers pursuant to this section shall be
made in writing on forms provided by the Borough Clerk. Stickers shall
be issued only under the following terms and conditions:
A. To persons who are residents on a street block or a portion thereof
upon which parking is restricted by this section, a permanent sticker,
valid for one year from its date of issue, shall be issued for a maximum
of one vehicle owned or principally operated by such person.
B. A properly displayed sticker shall constitute authorization to park
the vehicle for an unlimited period of time in any legal parking space
on the street for which the sticker was issued, except when alternate
side, emergency or snow removal restrictions are in effect.

Avenue, a one-way street between Ramapo Avenue and Hamburg Turnpike,
parallel with the left-hand edge of said roadway headed in the direction

in N.J.S.A. 39:4-135b. This section of the Code of the Borough of
Pompton Lakes shall not be deemed to permit parking where prohibited

A. Pursuant to N.J.S.A. 40:67-16.1, the streets or parts of streets

The owners of the premises referred to in Section
7-43 shall provide and install signs and pavement markings for each parking space reserved for the use of handicapped persons, which signs and markings shall be in accordance with the Manual on Uniform Traffic Control Devices. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of said property. The owner shall, subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Borough. The owner shall be responsible for the repair and restoration or replacement of same.

Any person parking a motor vehicle in a restricted parking place
without a special vehicle identification card shall be liable to a
fine of $250 plus an A.T.S. Court cost assessment for the first offense,
and for subsequent offenses, a fine of at least $250 and up to 90
days community service on such terms and in such form as the Court
shall deem appropriate, or any combination thereof.

In accordance with the provisions of N.J.S.A. 39:4-197, the
following Municipal and Board of Education Property shall have the
movement of traffic controlled by the type of regulation indicated.
No person shall operate, or park a vehicle in violation of the regulations
indicated.

A. Lot No. 28, Block 6300, as shown on the Tax Assessment Map of the
Borough of Pompton Lakes and commonly known as the "Pond Hole Parking
Lot" will hereby include the following designations as shown on the
amended site plans which are on file in the office of the Municipal
Clerk.
B. No person shall park any vehicle or permit any vehicle to stop or
stand or to be parked on the premises known and designated as the
"Pond Hole Parking Lot" except in accordance with the designations
and within the areas as shown on the amended site plans which are
made part of this subsection; except that the following restrictions
shall apply to all parking spaces within the Pond Hold Parking Lot:
1. No vehicle shall be parked in the Pond Hole Parking Lot between the
hours of 3:00 a.m. and 5:00 a.m. except for vehicles displaying an
appropriate parking sticker or permit.
2. Parking in the Pond Hole Parking Lot is hereby restricted to a ten-hour
maximum time limit for all vehicles during the hours of 5:00 a.m.
to 3:00 a.m. the following day unless the vehicle has a parking permit
allowing a longer parking duration or has a parking permit that restricts
parking durations to less than 10 hours.
3. Metered parking spaces may be time limited and such time limits shall
be conveyed to parking lot users via conspicuously placed signs installed
as directed by the Chief of Police or Borough of Pompton Lakes.
C. Whenever snow has fallen and the accumulation is such that it covers
the premises known as the "Pond Hole Parking Lot," the Chief of Police
or, in his absence, the ranking officer, is authorized to declare
an emergency and to direct the posting of temporary signs and/or barricades
designed to enable the safe and efficient clearing of snow and ice
from parking lot surfaces. Any business or individual in possession
of any parking permit for the Pond Hole Parking Lot shall provide
phone and/or email contact information that the Chief of Police or
Borough of Pompton Lakes may employ to convey special parking instructions
during snow or other emergencies events. When weather conditions,
accidents, fires or public celebrations dictate or require the avoidance
of hazards or other conditions which interfere with the maintenance
of the parking lot, notification that emergency parking procedures
have been enacted shall be given to any business or individual in
possession of any parking permit for the Pond Hole Parking Lot or
the operator or owner of any vehicle which has been parked prior to
the enactment of emergency procedures or posting of the signs. Any
unoccupied vehicle parked or standing in violation of this subsection
shall be deemed a nuisance, and any police officer may provide for
the removal of such vehicle. The owner shall pay the reasonable costs
of removal and storage which may result from such removal before gaining
possession of such vehicle.
D. No person shall park or permit any vehicle to be parked in any designated
aisle or roadway.
E. All moving vehicles within said parking lot shall be operated in
accordance with the following provisions:
1. Maximum speed limit: 10 miles per hour.
2. Vehicles shall proceed in the direction of travel designated by pavement
markings on the parking lot surface and/or posted signs.
3. All vehicles shall park within the marked areas of a parking stall.
4. Vehicles travelling within the parking lot or from one area of the
parking lot to another area shall be limited to parking aisles or
roadways only and shall not travel across or through painted parking
stalls or cross-hatched areas.
F. Parking stalls shall be painted upon the paved surface of the parking
lot and regulatory signs shall be installed to reasonably notify users
of the parking lot of these regulations.
G. Parking permits shall be designated by appropriate identification
tags or stickers, the form and location of which shall be prescribed
by the Chief of Police or Borough of Pompton Lakes, and issued in
accordance with procedures hereinafter set forth:
1. The Chief of Police or Borough of Pompton Lakes shall determine the
number of parking permits which can be issued, marking appropriate
allowance for turnover of use, seasonal variations or changes in parking
patterns so that the maximum number of permits may be issued.
2. Permits shall be issued on a first-come-first-served basis and shall
be classified as follows:
a. Student (S) permits which shall be valid only on school days between
the hours of 7:00 a.m. and 4:00 p.m.
b. Employee (E) permits which shall be valid at all times between the
hours of 5:00 a.m. and 3:00 a.m. the following day.
c. Resident (R) permits which shall be valid at all times.
3. The fees to purchase parking permits shall be:
a. Made available to student(s) by choosing one of the following options:
(1)
One hundred fifty dollars for the entire calendar school year
for each student (S) permit purchased. The calendar school year shall
be defined as the period of time commencing on September 1 until June
30; or
(2)
Fifty dollars per trimester for a student (S) permit. The first
trimester shall be defined by the period of time between September
1 and the start of the Christmas/holiday break; the second trimester
shall be defined by the period of time between January 1 and the start
of spring break; and the third trimester shall be defined by the period
of time between the end of spring break and June 30.
b. Fifty dollars per month for an employee (E) permit which shall be
valid between the first and last day of the month purchased.
c. One hundred dollars per month for a resident (R) permit which shall
be valid between the first and last day of the month purchased.
4. The following valid documents must be provided in order to purchase
a parking permit:
a. For a student (S) permit: vehicle registration of the vehicle that
will display the parking permit; student ID; driver's license of the
student named on the student ID.
b. For an employee (E) permit: vehicle registration of the vehicle that
will display the parking permit; copy of a recent pay stub (with sensitive
information redacted) from a business located on the east side of
Wanaque Avenue or a property bordering the Pond Hole Parking Lot;
driver's license of the employee named on the pay stub.
c. For a resident (R) permit: vehicle registration of the vehicle that
will display the parking permit; a recent utility or tax bill having
an address located within 400 feet of the Pond Hole Parking Lot and
matching the address on the vehicle registration, driver's license
of the permit holder.
d. Student (S) permits being renewed need to be repurchased each trimester
with the required accompanying documentation using procedures determined
by the Chief of Police or Borough of Pompton Lakes.
e. Employee (E) permits may be automatically renewed each month however,
recent pay stubs must be resubmitted at least every three months to
verify continued employment within the boundaries described in Subsection
g4(b).
f. Resident (R) permits may be automatically renewed each month, however,
recent utility or tax bills must be resubmitted at least every three
months to verify continued residency within the boundaries described
in Subsection g4(c).
g. Parking permits will not be automatically renewed for any month or
trimester when the accompanying driver's license or vehicle registration
is set to expire.
5. The number of parking permits issued shall be limited as follows,
however, the Chief of Police or Borough of Pompton Lakes may, from
time to time, make modifications to these limitations in accordance
with Subsection g1.
a. Student (S) permits issued shall be initially limited to a maximum
of 35.
b. Employee (E) permits issued shall be initially limited to a maximum
of 50.
c. Resident (R) permits issued shall be initially limited to a maximum
of 150.
6. The Chief of Police or Borough of Pompton Lakes may issue employee
(E) permits to businesses located on properties that border the Pond
Hole Parking Lot using guidelines, rules and regulations that differ
from Subsection g2 through 5 above.
7. Any time the maximum number of parking permits in any category has
been reached, the Chief of Police or Borough of Pompton Lakes may
establish a waiting list for such permits in accordance with the following:
a. If or when certain categories of parking permits become oversubscribed,
customers may request to be placed on a waiting list to be contacted
in the event a parking permit(s) becomes available. In the event a
parking permit becomes available, the longest listed individual on
the waiting list will be contacted to purchase the permit. If that
individual refuses to purchase the permit they will be removed from
the waiting list and the next longest listed individual will be contacted
for the same purpose, and so forth.
H. The Pond Hole Parking Lot shall be available to public parkers without
a parking permit on a first-come-first-served basis subject to availability.
1. The Pond Hold Parking Lot will contain parking Pay Kiosks that will,
upon deposit of a valid credit card, Google Pay, Apple Pay or other
contactless payment dispense "paid" parking stubs for use by nonpermitted
public parkers who must display such stubs on their vehicle dashboard
as proof of purchase of parking time. The fee for parking time shall
be a minimum $1.00 for two hours and .50 per hour thereafter.
2. It shall be unlawful for nonpermitted public parkers to cause their
vehicle to be parked in a Pond Hole Parking Lot parking space without
displaying a valid, nonexpired, "paid" parking stub on the vehicle's
dashboard.
3. It shall be unlawful for nonpermitted public parkers to cause their
vehicle to be parked in a Pond Hole Parking Lot parking space if a
"paid" parking stub displayed on the vehicle's dashboard is invalid
due to expiration.
4. "Paid" parking stubs are valid for use and display in one vehicle
only and it shall be unlawful to transfer a still-valid "paid" parking
stub to another individual or vehicle after the stub has been displayed.
5. Nonpermitted public parkers are subject to all rules and regulations
posted on signs within the Pond Hole Parking Lot, posted or displayed
on the parking pay kiosks, and printed on the parking stubs. It shall
be unlawful for nonpermitted public parkers to violate any of these
rules and regulations.
I. It shall be unlawful to utilize any portion of the Pond Hole Parking
Lot, including, but not limited to, parking spaces, driveways, traffic
lanes and planting areas, for the purpose of storing or causing to
be stored commercial and/or private vehicles or for the purpose of
using said public parking spaces or general areas for the storage,
maintenance, washing, painting, repairing, loading or unloading of
vehicles or for the conduct of private business, regardless of time
limits posted and fees paid, within the subject areas, which practice
denies or unduly limits the use of the parking facilities to the general
parking public for whom they are intended. Nothing herein shall be
construed to prohibit necessary and minimal emergency repairs which
are required to render a car operational so that it can be moved from
any parking space.
J. The Pond Hole Parking Lot includes parking spaces for handicapped
persons in accordance with law and it shall be unlawful to park in
any space designated for handicapped persons unless the appropriate
handicapped parking credentials are displayed. The prohibition against
parking in a space designated for handicapped persons without the
appropriate credentials shall be enforced by law enforcement personnel
in accordance with New Jersey State and federal law.
K. It shall be unlawful to damage or tamper with parking control equipment
or to deposit therein anything other than U.S. currency, credit cards,
or parking stubs and slips. It shall be unlawful to deface, injure,
tamper with, willfully break, destroy or impair the usefulness of,
or to open without lawful authority, parking control equipment installed
in the Pond Hole Parking Lot.
L. It shall be unlawful to deface or alter in any way "paid" parking
stubs or parking permits issued by the Borough of Pompton Lakes. It
shall be unlawful to produce or duplicate "paid" parking stubs or
Borough-issued parking permits. It shall be unlawful to attempt the
use of any defaced, altered, duplicated, counterfeit, or unlawfully
produced "paid" parking stub or parking permit.
M. Loitering in or upon any parking areas, garages, facilities, or lots
owned or operated by the Borough of Pompton Lakes which obstructs
the free passage of pedestrians or vehicles, or obstructs, molests,
or interferes with any person lawfully upon such Borough property
shall be prohibited. No person shall be prosecuted for loitering upon
such Borough property unless the violator shall first disobey a police
officer's or parking enforcement officer's direction to cease loitering
and disburse, move on, or exit the property.
N. The Chief of Police or Borough of Pompton Lakes shall publish notice
in the official newspaper of the Borough and prominently post notice
in locations deemed by him to give adequate notice to the public of
the acceptance of applications for parking permits.
O. The Chief of Police or Borough of Pompton Lakes is authorized to
establish permit issuing procedures: to allow a person to whom a permit
has been issued to substitute a vehicle; designed to improve or maximize
the efficiency and/or utilization of the Pond Hole Parking Lot; to
discourage abuse or misuse of parking permits; to discourage or alter
the emergence of unhealthy parking patterns or practices; to prioritize
permit issuance for Pompton Lakes residents or other user groups;
to improve safety and security, or; for any reason or reasons that
would better serve the interests of Pond Hole Parking Lot users, local
businesses, Borough residents and/or the Borough of Pompton Lakes.
P. Parking violations within the Pond Hole Parking Lot will be issued
in accordance with law and the following fine schedule which shall
be subject to change.
1. Overtime parking/parking without payment: $35.
2. Unlawful extension/parking beyond posted time limits/parking during
restricted time periods/unlawful transfer of paid parking stub: $45.
3. Improper placement of vehicle: $55.
4. Handicap violations: in accordance with federal and New Jersey statutes.
Q. Whenever any words and phrases are used in this subsection, the meaning
respectively ascribed to them in Subtitle 1 of Title 39 of the Revised
Statutes of New Jersey shall be deemed to apply to such words and
phrases used herein.
R. The provisions of this subsection imposing regulations shall not
relieve any person of the duty to observe any more restrictive provisions
set forth in Title 39 of the Revised Statutes of the State of New
Jersey.

The following traffic regulations shall be applied to Block
100, Lot 8, as shown on the Tax Assessment Map of the Borough of Pompton
Lakes and commonly known as the "Pompton Lakes Towne Square":
A. All moving vehicles within the parking lot shall be operated at a
maximum speed of 10 miles per hour.
B. No person shall park a vehicle in any designated loading zone except
for the period necessary to load, unload and deliver materials.
C. No person shall be permitted to park in any designated aisle or roadway.
D. No person shall be permitted to drive a vehicle in a direction contrary
to the directions indicated by any arrows painted on the paved areas
of the property.

vehicle to stop, stand or park on premises known as "Municipal Building
property" and commonly designated as Lot Nos. 19 and 21, Block 6300,
as shown on the Tax Assessment Map of the Borough of Pompton Lakes,
except in accordance with parking assignments assigned by the Municipal
Clerk or by resolution of the Mayor and Borough Council.
B. Authority of the Municipal Clerk. The Municipal Clerk shall review
and determine parking requirements for municipal officials and employees
and for the public availing themselves of municipal services at the
Municipal Building.
C. Parking Stalls. Parking stalls shall be painted upon the paved surface
of the parking areas.
D. Installation of Signs. No parking except for official business signs
and other necessary signs shall be installed.
E. Towing of Vehicles in Violation. Any vehicle parked in violation
of the provisions of this subsection shall be subject to being towed
away at the owner's expense.

Property," commonly known and designated as Lot 17, Block 9001, as
shown on the Tax Assessment Map of the Borough of Pompton Lakes, except
in accordance with parking assignments assigned by the Superintendent
of Public Works or by resolution of the Mayor and Borough Council.
B. Authority of the Superintendent of Public Works. The Superintendent
of Public Works shall review and determine the parking requirements
for municipal officials, employees and equipment and for the public
availing themselves of services at the Mill Street Garage.
C. Parking Stalls. Parking stalls shall be painted upon the paved surface
of the parking area.
D. Installment of Signs. No parking except for official business signs
and other necessary signs shall be installed.
E. Towing of Vehicles in Violation. Any vehicle parked in violation
of the provisions of this subsection shall, in addition to other penalties,
be subject to being towed away at the owner's expense.

In accordance with the provisions of N.J.S.A. 40:48-2.46, the
following private property that is open to the public and to which
the public is invited, the movement of traffic shall be controlled
by the regulations listed herein. No person shall operate or park
a vehicle in violation of the following regulations.

A. Applicability of Title 39. Gabrellian Associates has filed a written
consent with the Borough of Pompton Lakes that the provisions of Subtitle
One of Title 39 of the Revised Statutes of New Jersey be made applicable
to the semi-public roads, streets, driveways and parking lots at the
Pompton Lakes Towne Square located in the Borough of Pompton Lakes,
Passaic County and the following regulations shall be enforceable.
B. Specific regulations.

6. Speed limits.
a. The speed limit for both directions of traffic in the parking lot(s)
shall be 10 miles per hour.
b. Regulatory and warning signs shall be erected and maintained to effect
the above designated speed limits authorized by the Department of
Transportation.
7. Tow-away zones. Any vehicle parked or standing as to obstruct or
impede a normal flow of traffic, block entrances or exitways, loading
zones, oil fills, any grassy area pedestrian walkway, or present in
any way a safety or traffic hazard may be removed by towing the vehicle
at the owner's or operator's expense.
8. Turn prohibitions. No person shall make a turn at any location listed,

C. Signage. All signs, posts, or other necessary materials shall be
installed, maintained and paid for by the applicant. All signing shall
conform to the current Manual on Uniform Traffic Control Devices,
pursuant to N.J.S.A. 39:4-198 and N.J.S.A. 39:4-183.27.
1. The stop intersection approach along the road to the Wendy's drive-through
shall be properly marked as "CAUTION STOP AHEAD," the stop sign is
not visible until 10 feet to 12 feet prior to arriving at the intersection.
2. The mid-block crosswalk on Road E shall be properly marked for driver's
approach.
3. Pursuant to the provisions of N.J.S.A. 39:4-140, stop signs shall
be installed on the near right side of each street intersecting the
through street, except where yield signs are provided for in the designation.
D. Violations and penalties. Unless another penalty is expressly provided
for by the New Jersey statute, every person convicted of a violation
of this subsection or any supplement thereto shall be liable to a
penalty of not more than $50 or imprisonment for a term not exceeding
15 days, or both.

In accordance with the provisions of N.J.S.A. 39:5A-1, the regulations
of Subtitle 1, Title 39 of the Revised Statutes are hereby made applicable
to the properties listed below.

A. Applicability of Title 39. The Pompton Lakes Police Department is
authorized to enforce Title 39 at the Pompton Village Condominium
Association.
B. Specific regulations. The following provisions shall be specifically
applied to the premises:
1. No person shall park any vehicle in any designated loading zone except
for the period necessary to load, unload and deliver materials.
2. No person shall park or permit any vehicle to be parked in any designated
aisle or roadway.
3. All moving vehicles within the parking lot shall be operated in accordance
with the following provisions:
a. Maximum speed limit shall be 10 miles per hour.
b. Vehicles shall proceed in the direction designated on the Tax Assessment
Map of the property.
c. All vehicles shall park within the marked areas of a parking stall.
d. Parking stalls shall be painted upon the paved surface of the parking
lot. Stop, yield, loading zone, directional, parking, speed limit
and other necessary signs shall be installed to reasonably notify
users of the parking lot of these regulations.

The owner of the premises referred to Sections
7-44,
7-45 and
7-46 shall provide and install signs and pavement markings as required, which signage and markings shall be in accordance with the "Manual on Uniform Traffic Control Devices for Streets" and Highways. The cost for the procurement and installation of signs and pavement markings shall be the responsibility of the owner of said property. The owner shall subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Borough. The owner shall be responsible for the repair and restoration or replacement of same.

A. No motor vehicle or vehicular traffic shall enter Wanaque Avenue
in an easterly direction from the driveway now existing and located
on the westerly side of Wanaque Avenue 174.30 feet south of the intersection
of the westerly curbline of Wanaque Avenue with the prolongation of
the southerly curbline of Colfax Avenue, said driveway being hereby
designated as an entrance to the parking area at the rear of said
buildings.
B. No motor vehicle or vehicular traffic shall proceed from Wanaque
Avenue and enter the driveway lying immediately to the south of the
New York, Susquehanna & Western Railroad right-of-way to the parking
lot in the rear of said driveway, the same being designated as an
exit.
C. No motor vehicle or vehicular traffic proceeding easterly to Wanaque
Avenue from the driveway immediately south of the New York, Susquehanna
& Western Railroad may make any maneuver other than a right turn
to proceed south on Wanaque Avenue. No vehicle may proceed across
Wanaque Avenue in an easterly direction from the aforesaid driveway.
D. No person shall park any vehicle or permit any vehicle to stop, stand
or park within 5 feet from either edge of any commercial, residential
or public driveway located in the Borough.

The Mayor and Borough Council may, by ordinance, authorize the
Chief of Police or other chief executive officer of the municipality,
or the officer in charge of streets in any municipality not having
a chief executive officer, if he shall find that a safety problem
exists for ingress and egress to any public or private school or for
the provisions of recreational facilities for children attending such
school, or both, due to lack of a suitable area surrounding the school,
to close by regulation any portion of any street within the block
upon which such school is located, to the use of through traffic during
such time as he shall determine, not to exceed one hour between 7:30
and 10:00 a.m., two hours between 11:00 a.m. and 2:00 p.m. and one
hour between 2:30 and 4:30 p.m., on any days upon which such school
is in session and to permit the use of said portion of said street,
during said hours, for ingress and egress to such school, and for
the use by the pupils of such school for recreational purposes, under
proper supervision and to provide adequate police facilities for such
supervision and for the control of traffic upon such portion of said
street, which ordinance shall provide for the posting of proper warning
signs in said street indicating that said street is so closed and
the purpose thereof, during the time when the same is so closed and
shall provide penalties for the violation of the terms of such ordinance
or of any regulation promulgated thereunder.
