No person, firm or corporation shall improve with permanent pavement of concrete, macadam or any other acceptable material, any road, street or right-of-way in the Borough of Pompton Lakes, or submit same for acceptance and perpetual maintenance by the Borough of Pompton Lakes, without first installing all underground utilities to be used in connection with buildings to be erected along said street, road or right-of-way.

There shall be installed, in accordance with any lot layout, subdivision plan or development plan, house connections or service connections for each house plot set forth on said plan. The house connections shall be drawn from the main line to the curbline.

Should the Borough of Pompton Lakes improve with permanent pavement any public street or right-of-way, it may provide that each property owner, before such improvement is started, shall complete and install any house connections or service connections which may be necessary for buildings erected or to be erected on said streets, and in the event the property owner or owners shall refuse to install such house or service connections, then the Borough of Pompton Lakes may install or secure the installation of the house connections and assess the cost of the installation against such property owner or owners.

Should any person, firm or corporation violate the terms of this article, the Borough of Pompton Lakes may invoke the jurisdiction of any appropriate forum for the purpose of securing a mandatory injunction to enforce the provisions of this article, or, in its discretion, it may cause a complaint to be made in any Court of competent jurisdiction, and, upon conviction, shall be liable to the penalty stated in Chapter 1, Section 1-5.
