Whenever in this chapter the following terms are used, they shall have the meanings respectively ascribed to them in this section:
ALLEY
A public way within a block, generally giving access to the rear of lots or buildings, and not used for general traffic circulation.
BICYCLE
Every device propelled by human power upon which any person may ride, having two tandem wheels, except scooters and similar devices.

CROSSWALK
That portion of the roadway included within the connections of the lateral lines of the sidewalks on opposite sides of the highway measured from the curbs or, in the absence of curbs, from the edges of the traversable roadway, and in the absence of a sidewalk on one side of the highway, that part of the highway included within the extension of the lateral line of the existing sidewalk to the side of the highway without the sidewalk, with such extension forming a right angle to the center line of the highway; any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by lines or other markings on the surface placed in accordance with the provisions of the Manual on Uniform Traffic Control Devices.

DRIVER
Every person who drives or is in actual physical control of a vehicle.
DRIVER'S LICENSE
Any license to operate a motor vehicle issued under the laws of this state.

EMERGENCY VEHICLE
Vehicles of law enforcement agencies, fire-fighting vehicles, ambulances, vehicles carrying a state, county or municipal officer or employee in response to an emergency call, and emergency vehicles of public service corporations on an emergency call.
EXPLOSIVE
Any chemical compound or mechanical mixture that is commonly used or intended for the purpose of producing an explosion and which contains any oxidizing and combustive units or other ingredients in such proportions, quantities or packing that an ignition by fire, by friction, by concussion, by percussion or by detonator of any part of the compound or mixture may cause such a sudden generation of highly heated gases that the resultant gaseous pressures are capable of producing destructible effects on contiguous objects or of destroying life or limb.
FARM TRACTOR
Every motor vehicle designed and used primarily as a farm implement for drawing plows, mowing machines and other implements of husbandry.
FLAMMABLE LIQUIDS
Any liquid which has a flash point of 70° F. or less, as determined by tagliabue or equivalent closed-cup test device.

IMPROVED HIGHWAY
A roadway of concrete, brick, asphalt, macadam and crushed stone or gravel.

INTERSECTION
The area embraced within the prolongation or connection of the lateral curb lines, or, if none, then the lateral boundary lines of the roadways of two highways which join one another at, or approximately at, right angles or the area within which vehicles traveling upon different roadways joining at any other angle may come in conflict. Where a highway includes two roadways 40 feet or more apart, then every crossing of each roadway of such divided highway by an intersecting highway shall be regarded as a separate intersection. The junction of an alley with a street or highway does not constitute an intersection.

LANED ROADWAY
A street, the roadway of which is divided into two or more clearly marked lanes for vehicular traffic.
LOADING ZONE
The space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers or materials.[1]
METAL TIRES
Every tire, the surface of which in contact with the roadway is wholly or partially of metal or other hard, nonresilient material.
MOTOR VEHICLE
Every vehicle which is self-propelled and every vehicle which is propelled by electric power obtained from overhead wires, but not operated upon rails, except for vehicles moved solely by human power, motorized wheelchairs, low-speed electric bicycles and low-speed gas bicycles.

MOTORCYCLE
Every motor vehicle having a saddle for the use of the rider and designed to travel on not more than three wheels in contact with the ground, but excluding a tractor.
PARK
To stand a vehicle, whether occupied or not, otherwise than when temporarily and actually engaged in loading or unloading merchandise or passengers.

PEDESTRIAN
Any person afoot or wearing in-line speed skates, including a person with a physical, hearing or visual disability.

PNEUMATIC TIRE
Every tire in which compressed air is designed to support the load.
POLICE OFFICER
The President and any member of the Board of Trustees of the Village and any person designated by the President and Board of Trustees as a police officer.
PROPERTY LINE
The line marking the boundary between any street and the lots or property abutting thereon.
PUBLIC BUILDING
A building used by the municipality, the county, any park district, school district, the State of Illinois or the United States Government.
REGISTRATION
The registration certificate or certificates, registration plates and registration stickers issued under the laws of the State of Illinois pertaining to the registration of vehicles. "Registration" includes digital registration plates issued by the Secretary of State under 625 ILCS 5/3-401.5.

REGISTRATION STICKER OR STICKERS
A device or devices to be attached to a rear registration plate that will renew the registration and registration plate or plates for a predetermined period not to exceed one registration year, except as provided in Subsection (1) of Section 3-14 of the Illinois Motor Vehicle Code. "Registration sticker or stickers" includes digital registration stickers issued by the Secretary of State under 625 ILCS 5/3-401.5.

RESTRICTED DRIVING PERMIT
That document which grants and specifies limited privileges to drivers of motor vehicles who have their full driving privileges suspended, revoked or cancelled. The restricted driving permit is valid only when in the immediate possession of the driver to whom it is issued.

RIGHT-OF-WAY
The right of one vehicle or pedestrian to proceed in a lawful manner in preference to another vehicle or pedestrian approaching under such circumstances of direction, speed and proximity as to give rise to danger of collision unless one grants precedence to the other.

ROAD TRACTOR
Every motor vehicle designed and used for drawing other vehicles and not so constructed as to carry any load thereon either independently or any part of the weight of a vehicle or load so drawn.
SAFETY ZONE
That portion of a roadway reserved for the exclusive use of pedestrians, suitably marked or elevated.
SCHOOL BUS

A. 
Every motor vehicle, except as provided in Subsection B of this definition, owned or operated by or for any of the following entities for the transportation of persons regularly enrolled as students in grade 12 or below in connection with any activity of such entity:
(1) 
Any public or private primary or secondary school;
(2) 
Any primary or secondary school operated by a religious institution; or
(3) 
Any public, private or religious nursery school.
B. 
This definition shall not include the following:
(1) 
A bus operated by a public utility, municipal corporation or common carrier authorized to conduct local or interurban transportation of passengers when such bus is not traveling a specific school bus route but is:
(a) 
On a regularly scheduled route for the transportation of other fare-paying passengers;
(b) 
Furnishing charter service for the transportation of groups on field trips or other special trips or in connection with other special events; or
(c) 
Being used for shuttle service between attendance centers or other educational facilities.
(2) 
A motor vehicle of the First Division.
(3) 
A multifunction school-activity bus.[2]
SIDEWALK
That portion of a street between the curbline or the lateral lines of a roadway and the adjacent property line designated for pedestrian use.

SOLID TIRE
Every tire of rubber or other resilient material which does not depend upon compressed air for the support of the load.
STREET OR HIGHWAY
The entire width between property lines of each side or place of whatever nature when any part thereof is open to the use of the public, as a matter of right, for the purpose of vehicular traffic and each way set aside for public travel by vehicles.
TRAFFIC
Pedestrians, ridden or herded animals, vehicles and other conveyances either singly or together while using any highway for the purpose of travel.
TRAILER
Every vehicle without motive power designed for carrying passengers or property and for being drawn by a motor vehicle and so constructed that no part of its weight rests upon the towing vehicle.
TRUCK TRACTOR
Every motor vehicle designed and used primarily for drawing other vehicles and not so constructed as to carry a load other than a part of the weight of the vehicle and load so drawn.
URBAN DISTRICT
The territory contiguous to and including any street which is built up with structures devoted to business, industry or dwelling houses situated at intervals of less than 100 feet for a distance of a 1/4 of a mile or more.
VEHICLE
Every device in, upon or by which any person or property is or may be transported or drawn upon a highway, except devices moving by human power or used exclusively upon stationary rails or tracks and snowmobiles as defined in 625 ILCS 40/1-1 et seq.

YIELD RIGHT-OF-WAY
When required by an official sign, means the act of granting the privilege of the immediate use of the intersecting roadway to traffic within the intersection and to vehicles approaching from the right or left, provided that when the roadway is clear the vehicle may proceed into the intersection.

Police officers are hereby authorized to direct all traffic in accordance with the provisions of this chapter, or in emergencies as public safety or convenience may require, and it shall be unlawful for any person to fail or refuse to comply with any lawful order, signal or direction of a police officer. Except in case of emergency, it shall be unlawful for any person not authorized by law to direct or attempt to direct traffic.
It shall be unlawful for the driver of any vehicle to disobey the instructions of any traffic sign or signal placed in view by authority of the President and Board of Trustees or in accordance with the laws of the State of Illinois, except on direction of a police officer. All signs and signals established by direction of the governing body shall conform to the State Manual on Uniform Traffic Control Devices for Streets and Highways.

Whenever traffic is controlled by traffic-control signals exhibiting different colored lights or color-lighted arrows, successively one at a time or in combination, only the colors green, red and yellow shall be used, except for special pedestrian signals carrying a word legend, and the lights shall indicate and apply to drivers of vehicles and pedestrians as follows:
A. 
Green indication.
(1) 
Vehicular traffic facing a circular green signal may proceed straight through or turn right or left unless a sign at such place prohibits either such turn. Vehicular traffic, including vehicles turning right or left, shall yield the right-of-way to other vehicles and to pedestrians lawfully within the intersection or an adjacent crosswalk at the time such signal is exhibited.
(2) 
Vehicular traffic facing a green arrow signal, shown alone or in combination with another indication, may cautiously enter the intersection only to make the movement indicated by such arrow, or such other movement as is permitted by other indications shown at the same time. Such vehicular traffic shall yield the right-of-way to pedestrians lawfully within an adjacent crosswalk and to other traffic lawfully using the intersection.
(3) 
Unless otherwise directed by a pedestrian-control signal, as provided in § 705-7, pedestrians facing any green signal, except when the sole green signal is a turn arrow, may proceed across the roadway within any marked or unmarked crosswalk.
B. 
Steady yellow indication.
(1) 
Vehicular traffic facing a steady circular yellow or yellow arrow signal is thereby warned that the related green movement is being terminated or that a red indication will be exhibited immediately thereafter.
(2) 
Pedestrians facing a steady circular yellow or yellow arrow signal, unless otherwise directed by a pedestrian-control signal as provided in § 705-7, are thereby advised that there is insufficient time to cross the roadway before a red indication is shown and no pedestrian shall then start to cross the roadway.
C. 
Flashing yellow arrow indication.
(1) 
Vehicular traffic facing a flashing yellow arrow indication may cautiously enter the intersection only to make the movement indicated by the arrow and shall yield the right-of-way to other vehicles and pedestrians lawfully within the intersection or an adjacent crosswalk at the time the signal is exhibited.
(2) 
Pedestrians facing a flashing yellow arrow indication, unless otherwise directed by a pedestrian-control signal as provided in § 705-7, may proceed across the roadway within any marked or unmarked crosswalk that crosses the lane or lanes used to depart the intersection by traffic controlled by the flashing yellow arrow indication. Pedestrians shall yield the right-of-way to vehicles lawfully within the intersection at the time that the flashing yellow signal indication is first displayed.
D. 
Steady red indication.
(1) 
Except as provided in Subsection D(3) and (4), vehicular traffic facing a steady circular red signal alone shall stop at a clearly marked stop line, but if there is no such stop line, before entering the crosswalk on the near side of the intersection, or if there is no such crosswalk, then before entering the intersection, and shall remain standing until an indication to proceed is shown.
(2) 
Except as provided in Subsection D(3) and (4), vehicular traffic facing a steady red arrow signal shall not enter the intersection to make the movement indicated by the arrow and, unless entering the intersection to make a movement permitted by another signal, shall stop at a clearly marked stop line, but if there is no such stop line, before entering the crosswalk on the near side of the intersection, or if there is no such crosswalk, then before entering the intersection, and shall remain standing until an indication permitting the movement indicated by such red arrow is shown.
(3) 
Except when a sign is in place prohibiting a turn and local authorities by ordinance or state authorities by rule or regulation prohibit any such turn, vehicular traffic facing any steady red signal may cautiously enter the intersection to turn right, or to turn left from a one-way street into a one-way street, after stopping as required by Subsection D(1) or (2). After stopping, the driver shall yield the right-of-way to any vehicle in the intersection or approaching on another roadway so closely as to constitute an immediate hazard during the time such driver is moving across or within the intersection or junction or roadways. Such driver shall yield the right-of-way to pedestrians within the intersection or an adjacent crosswalk.
(4) 
After stopping as required by Subsection D(1) or (2), the driver of a motorcycle or bicycle, facing a steady red signal which fails to change to a green signal within a reasonable period of time not less than 120 seconds because of a signal malfunction or because the signal has failed to detect the arrival of the motorcycle or bicycle due to the vehicle's size or weight, shall have the right to proceed, after yielding the right-of-way to oncoming traffic facing a green signal, subject to the rules applicable after making a stop at a stop sign as required by § 705-65 of this chapter.
(5) 
Unless otherwise directed by a pedestrian-control signal as provided in § 705-7, pedestrians facing a steady circular red or red arrow signal alone shall not enter the roadway.
E. 
In the event an official traffic control signal is erected and maintained at a place other than an intersection, the provisions of this section shall be applicable except as to provisions which by their nature can have no application. Any stop required shall be at a traffic sign or a marking on the pavement indicating where the stop shall be made or, in the absence of such sign or marking, the stop shall be made at the signal.
Whenever flashing red or yellow signals are used they shall require obedience by vehicular traffic as follows:
A. 
Flashing red (stop signal). When a red lens is illuminated by rapid intermittent flashes, drivers of vehicles shall stop before entering the nearest crosswalk at an intersection or at a limit line when marked, or if none, then before entering the intersection, and the right to proceed shall be subject to the rules applicable after making a stop at a stop sign.
B. 
Flashing yellow (caution signal). When a yellow lens is illuminated with rapid intermittent flashes, drivers of vehicles may proceed through the intersection or past such signal only with caution.

Whenever lane control signals are used in conjunction with official signs, they shall have the following meanings:
A. 
Downward facing green arrow. Drivers of vehicles facing such signals are permitted to use the lane or lanes over which the signal is displayed, provided that no intersection traffic control signal gives a stop indication affecting the lane or lanes involved.
B. 
Red X symbol. Drivers of vehicles facing such signal are prohibited from using the lane over which the signal is displayed.
C. 
Yellow X (steady). A driver facing this indication should prepare to vacate the lane over which the signal is located, in a safe manner to avoid, if possible, occupying that lane when a steady red X is displayed.

Whenever special pedestrian-control signals exhibiting the words "Walk" or "Don't Walk" or the illuminated symbols of a walking person or an upraised palm are in place such signals shall indicate as follows:
A. 
"Walk" or walking person symbol. Pedestrians facing such signal may proceed across the roadway in the direction of the signal, and shall be given the right-of-way by the drivers of all vehicles.
B. 
"Don't Walk" or upraised palm symbol. No pedestrian shall start to cross the roadway in the direction of such signal, but any pedestrian who has partly completed his crossing on the "Walk" signal or walking person symbol shall proceed to a sidewalk or safety island while the "Don't Walk" signal or upraised palm symbol is illuminated, steady or flashing.
A. 
No person shall place, maintain or display upon or in view of any highway any unauthorized sign, signal, marking or device which purports to be or is an imitation of or resembles an official traffic control device or railroad sign or signal, or which attempts to direct the movement of traffic, nor shall any person place, maintain or display upon or in view of any highway any other sign which hides from view or interferes with the movement of traffic or effectiveness of any traffic control device or any railroad sign or signal, and no person shall place or maintain nor shall any public authority permit upon any highway any traffic sign or signal bearing thereon any commercial advertising.
B. 
It shall be unlawful for any person to deface, injure, move or interfere with any official sign or signal. Any such unauthorized device is hereby declared to be a nuisance, and may be removed by any police officer.

It shall be unlawful for any person to operate any motor vehicle on any street while under the influence of alcohol, other drug or drugs, intoxicating compound or compounds or any combination thereof in violation of 625 ILCS 5/11-501.

A. 
The driver of any vehicle involved in a motor vehicle accident resulting in injury to or death of any person or damage to any vehicle which is driven or attended by any person shall give the driver's name, address, registration number and owner of the vehicle the driver is operating and shall upon request and if available exhibit such driver's license to the person struck or the driver or occupant of or person attending any vehicle collided with and shall render to any person injured in such accident reasonable assistance, including the carrying or the making of arrangements for the carrying of such person to a physician, surgeon or hospital for medical or surgical treatment, if it is apparent that such treatment is necessary or if such carrying is requested by the injured person.
B. 
If none of the persons entitled to information pursuant to this section is in condition to receive and understand such information and no police officer is present, such driver, after rendering reasonable assistance, shall forthwith report such motor vehicle accident at the nearest office of a duly authorized police authority, disclosing the information required by this section.
Every person riding a bicycle or an animal or driving any animal drawing a vehicle upon any street shall be subject to the provisions of this chapter applicable to the driver of a vehicle, except those provisions which can have no application to one riding a bicycle or driving or riding an animal; provided that, except in business districts, bicycles may be ridden on sidewalks.
A. 
Emergency vehicles.
(1) 
The provisions of this chapter regulating the movement or parking of vehicles, maximum speed limits and governing direction of movement or turning in specified directions shall not apply to the driver of any authorized emergency vehicle when responding to an emergency call, but such driver, upon approaching a red or stop signal or any stop sign, shall slow down as necessary for safety but may proceed cautiously past such red or stop sign or signal. At other times, drivers of authorized emergency vehicles shall stop in obedience to a stop sign or signal.

(2) 
No driver of any authorized emergency vehicle shall assume any special privileges under this chapter except when such vehicle is operated in response to an emergency call or in the immediate pursuit of an actual or suspected violator of the law.
B. 
Maintenance vehicles. The provisions of this chapter regulating the movement and parking of vehicles shall not apply to equipment or vehicles while actively engaged in installing, repairing or otherwise improving streets or street pavement.

A. 
Citation issuance. Any officer or employee of the Village or any person or persons designated by the President and Board of Trustees of the Village may issue an ordinance violation citation to any person or persons accused of a violation of one or more of the following sections of this chapter: § 705-14 through and including § 705-48; § 705-58; § 705-61; § 705-63 through and including § 705-66; § 705-74 through and including § 705-86; § 705-101 through and including § 705-108; and § 710-18 through and including § 710-20. Said citation shall show the name and address of the accused offender and the date, time and location of the offense on a form as approved from time to time by the President and Board of Trustees. The citation shall further designate the code section provided and shall include the issuance or signature and date of issuance. Nothing in this section shall be construed to require the issuance of any citation for any alleged offense.
B. 
Citation settlement.
(1) 
Any alleged offender who receives such citation may settle and compromise the claim against him or her for such alleged offense by paying the Village the sum set forth below:

(2) 
Within 14 days of the date such citation was dated and received by the alleged offender, the President and Village Board shall be empowered to designate a conspicuous place or places for such payments and to designate or cause to be designated citations for the convenient payment thereof. Notwithstanding any language to the contrary in this section herein, any alleged violation may be prosecuted as a state statute violation rather than an ordinance violation, at the sole discretion of the Village.
C. 
Repeat offenses. In the event any alleged offender receives a second citation accusing the alleged offender of the same violation listed in Subsection A of this section, and having received one prior ordinance violation citation for the same offense within the period of 12 months, the alleged offender may settle and compromise the second citation by paying the Village double the sum for the offense as set forth in Subsection B above, within 14 days of the date of the date such citation was dated and received by the alleged offender.
D. 
Failure to pay. In the event the alleged offender does not pay the appropriate sum as required above within 14 days, the original sum owed shall be doubled. In the event the alleged offender does not pay the aforementioned doubled sum within an additional 14 days, the entire sum shall be turned over to a collection agency chosen by the Village to pursue collection of all amounts due and payable to the Village.
