This article is adopted in the interest of public safety and transportation efficiency. All persons operating golf carts and low-speed vehicles (LSVs) must be observant of, and attentive to, the safety of themselves and others, including their passengers, other motorists, bicyclists and pedestrians. All persons who operate or ride golf carts and LSVs on Village streets do so at their own risk and peril. The Village of Warrensburg disclaims any liability under any theory of liability for permitting golf carts and LSVs to be operated on Village streets.
As used in this article, the following terms shall have the meanings indicated:
GOLF CART
A vehicle specifically designed and intended for the purposes of transporting one or more persons and their golf clubs or maintenance equipment while engaged in the playing of golf, supervising the play of golf, or maintaining the condition of the ground on a public or private golf course.
LOW-SPEED VEHICLE (LSV)
Any four-wheeled vehicle with a maximum speed greater than 20 miles per hour, but not greater than 25 miles per hour, that conforms with the federal motor vehicle safety standards set forth in 49 CFR 571.500.
It shall be lawful to operate a golf cart or LSV on Village streets, subject to the requirements and regulations of this article.
A golf cart or low-speed vehicle to be operated on a Village street shall have the following equipment as required by 625 ILCS 5/11-1426.1 or 5/11-1426.2 in good working condition at all times:

Brakes;
B. 
Steering apparatus;
C. 
Tires;
D. 
A rear-view mirror;
E. 
A slow-moving emblem required by 625 ILCS 5/12-709 attached to the rear and a red reflector warning device on the front and rear;
F. 
Two headlights that emit white light visible from at least 500 feet to the front;
G. 
Two tail lamps that emit red light visible from at least 100 feet to the rear;
H. 
Two brake lights on rear;
I. 
Turn signals on front and rear;
J. 
A seat for each passenger that was installed by the manufacturer;
K. 
A parking brake; and
L. 
A windshield.
A golf cart or LSV operated on a Village street shall have the head lights and tail lamps on at all times.
A golf cart or LSV may transport only the number of passengers for which the specific golf cart or LSV was designed. Every passenger shall sit in a seat that was installed by the manufacturer of the golf cart or LSV. It shall be unlawful for the operator of a golf cart or LSV to transport passengers unless each passenger is in a seat. The operator of a golf cart or LSV shall not transport anyone who is sitting on the lap of a passenger, or in any other location except in a seat.
All trailers or carts being pulled by a golf cart or LSV must have tail lamps, brake lights and brakes in good working condition. The tail lamps shall be on at all times. It shall be unlawful for any person or animal to be in a trailer or cart when being pulled by a golf cart or LSV.
It shall be unlawful for the owner of a golf cart or LSV to modify or alter a golf cart or LSV from the original manufacturer's specifications that would result in a golf cart or LSV being faster or larger than originally manufactured.
No person shall operate a golf cart or LSV on a Village street unless the operator is at least 18 years old and has a valid Illinois driver's license. A sixteen-year-old person may operate a golf cart or LSV with someone over the age of 18 or older with a valid driver's license.
Golf carts and LSVs shall only be allowed to operate within the Village of Warrensburg from 6:00 a.m. until 10:00 p.m.
No person shall operate a golf cart or LSV on a Village street in excess of 30 miles per hour.
The operator of a golf cart or LSV on Village streets shall obey all ordinances of the Village of Warrensburg and the provisions of Illinois Vehicle Code 625 ILCS 5/11-1426.1 and 625 ILCS 5/11-1426.2, as amended from time to time.
No person shall operate a golf cart or LSV on a Village street unless the golf cart or LSV has been issued a license by the Village. A person desiring a license shall make application to the Chief of Police, or his designee, on forms provided by the Village. The license shall be valid for a period of one year from January 1 until December 31. Prior to the issuance of the license, a fee as set from time to time by the Village Board shall be paid to the Village Administrative Clerk by the applicant, and the applicant shall present the golf cart or LSV to the Chief of Police, or his designee, for an inspection to determine whether the golf cart or LSV may be operated on a Village street. If the applicant and the golf cart or LSV pass the inspection, a license shall be issued to the applicant.
No person shall operate, and no owner shall permit another person to operate, a golf cart or LSV on a Village street unless:
A. 
The golf cart or LSV is covered by a liability insurance policy as required by Section 7-601 of the Illinois Vehicle Code (625 ILCS 5/7-601); and
B. 
The operator of the golf cart or LSV carries with him/her proof of liability insurance as required by Section 7-602 of the Illinois Vehicle Code (625 ILCS 5/7-602).
If a golf cart or LSV that has a current license is sold, the new owner shall sign an ownership transfer form at the Village of Warrensburg Village Hall and present proof of insurance before the new owner may operate the golf cart or LSV in the Village of Warrensburg. The new owner may operate the golf cart or LSV for the remaining unexpired time of the license. At the end of the license period, which shall run from January 1 to December 31, the new owner must apply for a license pursuant to § 710-13.
A. 
The license of an operator of a golf cart or LSV issued pursuant to § 710-13 of this article may be revoked by the Chief of Police, or his designee, if:
(1) 
There is any material misrepresentation made by the applicant on the application; or
(2) 
The required liability insurance is no longer in full force and effect; or
(3) 
There is evidence that the license holder can no longer safely operate the golf cart or LSV.
B. 
The Chief of Police, or his designee, shall issue a notice of revocation of a license in writing and either hand deliver the notice to the license holder, or send the notice by certified mail to the license holder at the address on the application. The revocation of the license shall be effective immediately after personal service, or on the third day after the postmark of the certified mail receipt.
A. 
Any person violating or aiding or abetting the violation of any provision of this article is guilty of a petty offense and shall be fined not less than $50 nor more than $200.
B. 
Each day a person fails to comply with the provisions of this article constitutes a separate offense.

All persons who operate or ride motorized scooters, mini-bikes and motorized toy vehicles on Village sidewalks do so at their own risk and peril. The Village of Warrensburg disclaims any liability under any theory of liability for permitting motorized scooters, mini-bikes and motorized toy vehicles to be operated on Village sidewalks.
As used in this article, the following terms shall have the meanings indicated:
MINI-BIKE/MOTORCYCLE
Includes any motorcycle with a gas or electric engine. This does not include any motorcycle that falls within the ability to be licensed by the Illinois Secretary of State.
MOTORIZED SCOOTER
Includes any scooter operated with a gas, diesel or electric motor. The scooter or scooters which fall within the ability to be licensed by the Illinois Secretary of State will not be covered by this article.
MOTORIZED TOY VEHICLE
Includes any toy motorcycle, car, truck, four-wheel, three-wheel or two-wheel vehicle operated by a gas or electric engine.
It shall be unlawful to operate a motorized scooter, mini-bike/motorcycle or motorized toy vehicle on the roads within the Village of Warrensburg.

Any person violating or aiding or abetting the violation of any provision of this article is guilty of a traffic offense and shall be fined in accordance with Chapter 705, Vehicles and Traffic, § 705-13.
