Whenever any words and phrases are used in this chapter, the
meaning respectively ascribed to them in Subtitle 1 of Title 39 of
the Revised Statutes of New Jersey shall be deemed to apply to such
words and phrases used herein.

Whenever certain hours are named in this chapter, they shall
mean either Eastern Standard Time or Eastern Daylight Savings Time
as may be in current use.

a. The
Mayor, Council President, Borough Clerk or, in their absence, disability
or inability to act, the State Police are hereby authorized to provide
by regulation for the closing of any street or portion thereof to
motor vehicle traffic on any day or days during specified hours on
any day or days whenever he finds that such closing is necessary for
the preservation of the public safety, health or welfare.
b. Any
regulations promulgated by the Mayor and Borough Council and in accordance
with paragraph a above, shall provide for the posting of proper warning
signs of such closing on any street or portion thereof during the
time the same is closed in pursuance thereof.
c. Any
violation of this regulation promulgated thereunder shall be punished
by a fine not to exceed $50.
d. Any
regulation adopted that mandates the closing of any street for a period
of greater than 48 consecutive hours shall not become effective unless
and until it has been submitted to and approved by the Commissioner
of the Department of Transportation.

Any vehicle parked in violation of this chapter shall be deemed
a nuisance and a menace to the safe and proper regulation of traffic,
and any peace officer may provide for the removal of such vehicle.
The owner shall bear the reasonable costs of removal and storage which
may result from such removal before regaining possession of the vehicle.

Unless another penalty is expressly provided by New Jersey Statutes,
every person convicted of a violation of a provision of this chapter
or any supplement thereto shall be liable to a penalty of not more
than $100 or a term of imprisonment not exceeding 15 days or both.

If any part or parts of this chapter are, for any reason, held
to be invalid, such decision shall not affect the validity of the
remaining portions of this chapter.

All former traffic ordinances of the Borough of Victory Gardens
are hereby repealed, and all ordinances or parts of ordinances in
conflict with or inconsistent with the provisions of this chapter
are hereby repealed, except that this repeal shall not affect or prevent
the prosecution or punishment of any person for any act done or committed
in violation of any ordinance hereby repealed prior to the taking
effect of this chapter.

The Borough Council finds and declares that problems of traffic
control occur when traffic must be moved through or around street
construction, maintenance operations and utility work, above or below
the ground which required blocking the street and obstructing the
normal flow of traffic; and that such obstructions are or can become
dangerous when not properly controlled. In order to better promote
the public health, safety, peace and welfare, it is necessary to establish
controls and regulations directed to the safe and expeditious movement
of traffic through and around construction and maintenance zones and
to provide safety for the work forces performing these operations.
The Borough of Victory Gardens in the County of Morris, State
of New Jersey, does hereby adopt the current Manual on Uniform Traffic
Control Devices for Streets and Highways also known as the M.U.T.C.D.,
except as hereby supplemented and amended, as it controls and regulates
whenever construction, maintenance operations or utility work obstructs
the normal flow of traffic. Any person, contractor or utility who
fails to comply with the provisions of the M.U.T.C.D. while performing
such work is in violation of this section.

It shall be the responsibility of the person, contractor, or
in the case of a public utility as required under the Public Utility
Agreement, Section 16:25-9.2, wishing to conduct work on, under or
above the street to contact the Mayor of the Borough of Victory Gardens
in order to arrange a preconstruction meeting in order to submit plans
for the safe movement of traffic during such period of construction
or work. Any person, contractor or utility who fails to comply with
this section prior to the start of such work, or whose plans are not
approved by the Borough is in violation of this section.

The person, contractor or utility shall provide at least two
emergency contact telephone numbers to be called in case of emergency
problems at the construction or maintenance site prior to the start
of any work. If, for any reason, emergency contact can not be made,
or if the emergency contact person does not respond to a call from
the Mayor of the Borough of Victory Gardens to correct such hazardous
condition, the Borough may respond to correct the hazardous condition(s).
The reasonable fees for such emergency services by the Borough shall
be charged to the person, contractor, or utility responsible for the
condition.

There shall be no construction, maintenance operations, or utility
work on any roadway in the Borough before the hour of 9:00 a.m. or
after 4:00 p.m. This time limit may be adjusted to permit work prior
to 9:00 a.m. or after 4:00 p.m. by the Officer in charge of the Borough.
If it is determined by the Officer in charge that the construction
or maintenance operations prior to 9:00 a.m. or after 4:00 p.m. would
substantially delay traffic or cause a safety or health hazard, the
work shall then be permitted only between 9:00 a.m. to 4:00 p.m.

Road closing and/or traffic detours shall not be permitted unless
approved by the Borough.

Traffic directors shall be posted at all construction or maintenance
sites when determined by the Borough that same is necessary to provide
for the safety and expeditious movement of traffic.

The Borough shall have the authority to stop work, including
the removal of equipment and vehicles, stored material within the
street right-of-way, back filling of open excavations and/or other
related work, in order to abate any nuisance and/or safety hazard
or for any violation of this section.

It is to be expressly understood that no materials, vehicle
or equipment are to be placed in the roadway or sidewalk or until
all construction, signs, light devices and pavement markings are installed.

a. Any person, contractor or utility who commits a violation of this
chapter shall, upon conviction thereof for a first offense pay a fine
of not less than $100 nor more than $500 and/or be imprisoned in the
county jail for a term not exceeding 90 days. For a second offense,
upon conviction thereof, pay a fine of not less than $250 and/or be
imprisoned in the county jail for a term not exceeding 90 days.
b. A separate offense shall be deemed committed on each day during or
on which violation occurs or continues.
c. Authority to Issue Summonses. The Fire Chief, the Construction Official
and any other person(s), who are empowered by the Mayor and Borough
Council shall have the authority to issue summonses for any violation
of this chapter.
Any violation of Sections
7-10; 7-14 and 7-17 shall carry with it a fine of $25 upon a plea of guilty or a finding of guilt by the Municipal Court.

The provisions of this chapter imposing a time limit on parking
shall not relieve any person of the duty to observe other, more restrictive
provisions prohibiting or limiting the stopping or standing or parking
of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey
Statute or as hereinafter provided.

a. Upon
the declaration of an emergency, there shall be no parking upon streets
or sections of streets where temporary EMERGENCY NO PARKING signs
are displayed. The Mayor or the Borough Administrator, in his absence,
is authorized to declare an emergency and to direct the posting of
EMERGENCY NO PARKING signs when weather conditions, accidents, road
construction, fire or public celebrations dictate or require avoidance
of hazards or other conditions which interfere with the free flow
of traffic. Notification that EMERGENCY NO PARKING signs are being
or will be posted shall be given to the operator or owner of any vehicle
which has been parked prior to the posting of the signs.
b. The
effectiveness of this subsection is contingent upon the signs being
erected as required by law.

a. Whenever snow has fallen and the accumulation is such that it covers
the streets or highways, an emergency shall exist and no vehicle shall
be parked on the streets or highways or portions thereof indicated.
The above parking prohibitions shall remain in effect after
the snow has ceased until the streets have been plowed sufficiently
and to the extent that parking will not interfere with the normal
flow of traffic.
b. Any unoccupied vehicle parked or standing in violation shall be deemed
a nuisance and a menace to the safe and proper regulation of traffic
and the Code Enforcement Officer, the Fire Chief or the Building Code
Official may provide for the removal of such vehicle. The owner shall
pay the reasonable costs of the removal and storage which may result
from such removal before gaining possession of the vehicle.

b. Request for Residential Parking Permit. Anyone requesting a special
permit for parking shall present their request and the reasons therefor
to the Mayor and Council. If the request is for good and sufficient
reason, a special permit will be issued for that homeowner. This special
permit shall have a duration of no longer than six months. Thereafter,
the homeowner shall submit a new application for such a permit.
1. No permit shall be issued to any vehicle which is principally garaged
in the Borough.
2. Temporary permits shall be issued to those homeowners (residents)
requesting same because of an event that he is holding at his home
and because of the stringent parking policy of this section, there
are limited places for his guests to park. In the event of such an
occurrence, the homeowner (tenant) may apply to the Borough Clerk
on an approved form for an "Application For Temporary Permit". Such
permit shall be issued to the applicant.
3. No more than 10 such permits shall be issued for any one event and
no such permits will be issued more than once in any thirty-day period.
4. No more than 30 permits for the entire Borough shall be issued for
any one time period.
5. Temporary permits issued under this section shall expire at 12:01
a.m. on the date following the effective date of the permit.
6. Temporary permits issued under this section will allow the permit holder to park his vehicle on and along those streets as indicated on the Temporary Permit which are listed in Section
7-14 for the duration of the permit.

The owners of the premises referred to in this section shall
provide and install signs and pavement markings as required, which
signage and markings shall be in accordance with the current Manual
On Uniform Traffic Control Devices (MUTCD). The cost of signs and
installations shall be the responsibility of the owner of the property.
The owner shall, subsequent to the initial procurement and installation,
maintain such signs and pavement markings in good condition at no
cost or expense to the Borough.
The penalty for a violation and conviction of this section shall
be not less than $50 nor more than $1,000 and/or imprisonment in the
county jail for a term not to exceed 90 days, or by a period of community
service not to exceed 90 days.

In accordance with the provisions of N.J.S.A. 39:5A-1, the regulations
of Subtitle 1, Title 39 of the Revised Statutes are hereby made applicable
to the properties listed below.
a. Victory Highlands Condominiums. The following regulations, applicable
to the semi-public roads, streets, driveways and parking lots at the
Victory Highlands Condominiums Association, Inc., located in the Borough
of Victory Gardens, County of Morris, shall be enforceable:

Regulatory and warning signs shall be erected and maintained
to effect the above designated speed limits authorized by the Department
of Transportation.
4. Tow Away Zones. Any vehicle parked or standing so as to obstruct
or impede a normal flow of traffic, block entrances or exit ways,
loading zones, oil fills, and grassy area, pedestrian walkway, or
present in any way a safety or traffic hazard may be removed by towing
the vehicle at the owner's expense.
5. That all signs, posts, or other necessary materials be installed
and paid for by the applicant. All signing shall conform to the current
Manual on Uniform Traffic Control Devices, pursuant to N.J.S.A. 39:4-198
and N.J.S.A. 39:4-183.27.
6. Unless another penalty is expressly provided by New Jersey Statute,
every person convicted of a violation of this subsection or any supplement
thereto shall be liable to a penalty of not more than $50 or imprisonment
for a term of not exceeding 15 days or both.
b. Hamilton Park Condominiums. The following regulations, applicable
to the semi-public roads, streets, driveways and parking lots at the
Hamilton Business Park Condominiums located in the Borough of Victory
Gardens, County of Morris shall be enforceable:
1. All vehicles must park only in designated areas and between the lines
provided.
2. Handicapped Parking. All stalls shall be 12 feet wide as shown on
the attached site plan and signed with R7-8 and R7-8(P). (Reserved
Parking Sign and Penalty Plate), in the designated parking areas for
persons who have been issued the handicapped parking permits by the
Division of Motor Vehicles.
3. Stop Intersections. The following described intersections are hereby
designated as stop intersections. Stop signs shall be installed as
