A Code, regulating the manner in which refuse may be stored,
collected and disposed of; declaring and defining certain conditions
as nuisances; fixing the responsibilities and duties of persons storing,
collecting and/or disposing of refuse; providing for the issuance
of permits to collect refuse, and prescribing penalties for violations
is hereby established pursuant to the provisions of N.J.S.A. 26:3-69.1
et seq. A copy of this Code is located in the office of the Board
of Health of the Borough of Victory Gardens.

The Code established and adopted by this chapter is described
and commonly known as the Solid Waste Code of New Jersey (1959).

Three copies of the "Solid Waste Code of New Jersey (1959)"
have been placed on file in the Office of the Secretary of the Board
of Health and will remain on file for the use and examination of the
public.

The following additions, amendments and revisions are hereby
made to the Solid Waste Code:
a. Section 3.6 is amended to read as follows:
3.6 Refuse prepared for collection shall be packaged or otherwise
assembled in quantities weighing not more than 80 pounds.
b. Section 6.1 which pertains to permits for conducting the business
of refuse collection is deleted in its entirety.

Any person who violates any provision or order promulgated under
this chapter shall, upon conviction thereof, be subject to a penalty
of not less than $5 nor more than $500 for each violation. The continuation
of such violation(s) for each successive day shall constitute a separate
offense, and the person or persons allowing or permitting the continuation
of the violation may be punished as provided herein for each separate
offense.
