As used in this article the following terms shall have the meanings indicated:
ACT 57
Act 57 of the Public Acts of 2018, as amended.
AUTHORITY
The Telegraph Road Corridor Improvement Authority established by this article.
BOARD
The Board of the Authority, the governing body of the Authority.
CHIEF EXECUTIVE OFFICER
The Mayor of the City of Monroe, Michigan.
CITY
The City of Monroe, Michigan.
COUNCIL and CITY COUNCIL
The City Council of Monroe.
DEVELOPMENT AREA
The Telegraph Road Corridor Development Area referred to in this article as now existing or hereafter amended.
This article shall be known, identified and cited as the "Telegraph Road Corridor Improvement Authority" and herein be referred to as the "Authority."
There is hereby established, pursuant to Act 57, a Corridor Improvement Authority in and for the City. The Authority shall be a public body corporate and shall be known and exercise its powers under the title of "Telegraph Road Corridor Improvement Authority." The Authority may adopt a seal, may sue and be sued in any court of this state and shall possess all of the powers necessary to carry out the purposes of its incorporation as provided in this article and Act 57. The enumeration of a power in this article or in Act 57 shall not be construed as a limitation upon the general powers of the Authority.
A. 
The Authority shall be under supervision and control of a Board consisting of the chief executive officer of the City and five members as provided in Act 57. The members shall be appointed by the chief executive officer subject to approval by the Council and shall hold office for the terms provided in Act 57. Members may be removed for cause in accordance with the provisions of Act 57. Every member shall hold office until the member's successor is appointed.
B. 
The Board shall adopt and may amend bylaws and rules of procedure consonant with the provisions of Act 57 providing for the holding of its meetings, election and duties of officers and transaction of business.
Except as specifically otherwise provided in this article, the Authority shall have all powers provided by law subject to the limitations established by law and herein contained.
The Authority shall have assigned to it City staff as designated by the City Manager who shall be secretary to the Authority and who shall have the responsibility to: record the meetings on audiotape; keep, prepare, and distribute meeting minutes; prepare and distribute materials to be considered in the business of the Authority; and act as a resource to the Board.
A. 
The fiscal year of the Authority shall begin on July 1 of each year and end on June 30 of the following year, or such other fiscal year as may hereafter be adopted by the City.
B. 
The Authority shall annually prepare a budget and shall submit it to the Council on the same date that the proposed budget for the City is required by the City Charter to be submitted to the Council. The Commission shall not finally adopt a budget for any fiscal year until the budget has been approved by the City Council. The Authority may, however, temporarily adopt a budget in connection with the operation of any improvements which have been financed by revenue bonds where required to do so by the ordinance authorizing revenue bonds.
C. 
The Authority shall submit financial reports to the Council at the same time and on the same basis as departments of the City are required to submit reports. The Authority shall be audited annually by the same independent auditors auditing the City, and copies of the audit report shall be filed with the Council.
If any section, subsection, sentence, clause or phrase of this article is declared unconstitutional or unenforceable by a court of competent jurisdiction, such decision or holding shall not affect the validity of the remaining portions of this article.
This article shall be in full force and effect immediately after final passage and publication.
