A Code regulating retail food establishments, food and vending machines and fixing penalties is hereby established pursuant to N.J.A.C. 8:24-1 et seq.
The Code established and adopted by this chapter is described and commonly known as the Sanitation in "Sanitation in Retail Food Establishments and Food and Beverage Vending Machines Code," Chapter XII of the State Sanitary Code (N.J.S.A. 8:24-12 et seq.).

Three copies of the Sanitation in Retail Food Establishments and Food and Beverage Vending Machines Code of New Jersey have been placed on file in the office of the City Clerk and Health Officer and shall remain on file there for use and examination by the public.
No person shall operate a retail food establishment or vending machine as defined in the New Jersey Administrative Code without first obtaining a license from the City Clerk and paying the required license fee. The term of the license shall be for a period of one year, with all licenses expiring on December 31, and shall be nontransferable.
Application forms for all licenses shall be obtained from and kept on file by the City Clerk.
The enforcement authority for this Code shall be the Health Officer and any other licensed health official authorized by the City Council to enforce this chapter and the Code hereby adopted.
Each application for a license under this chapter shall be investigated by the Health Official who shall report his findings in writing to the Municipal Clerk within a reasonable time. No license shall be issued unless the Health Official reports that the applicant conforms to all provisions of this chapter. No food establishment license shall be issued until the applicant complies with all other licensing requirements which may apply to his business.
Any license issued under this chapter may be suspended or revoked for failure to comply with any provision of this chapter.
Any person violating any of the provisions of this chapter or of the Code established herein shall, upon conviction thereof, be punishable by a fine of not less than $50 nor more than $1,000. Each day a particular violation continues shall constitute a separate offense. (N.J.S.A. 26:1A-10)

A. 
Licensing Fees. The fees for licenses under this chapter shall be as follows:
1. 
Vending Machine: $40.00 per machine;
2. 
Retail Food Establishment: $40.00 per establishment;
3. 
Temporary Retail Food Establishment: $40.00 per event.
B. 
Inspection and Plan Review Fees. In addition to the licensing fee, there shall be an inspection fee for each establishment holding a vending machine, retail food and/or temporary food licenses, as follows:

Initial Inspection: $10.00
2. 
Retail Food Establishment Re-Inspection: $50.00 each
3. 
Retail Food Establishment Initial Plan Review: $75.00 each
C. 
Fees Payable to the Middlesex County Public Health Department. The fees for the Retail Food Establishment Re-Inspection and the Retail Food Establishment Initial Plan Review are payable to the Middlesex County Public Health Department within (10) business days of the re-inspection or plan review. All other fees are payable to the City of South Amboy.
