The purpose of this chapter is to promote public safety with respect to those events, as defined herein, held by private entities (licensed liquor establishments, see Chapter 174). This chapter is also intended to protect and promote the peaceful enjoyment of property by neighboring residents.
As used in this chapter, the following terms shall have the meanings indicated:
SPECIAL EVENT
Includes any outdoor parade, concert, carnival, festival, fair, or other event as may be designated by the Town Council.
No person or entity shall conduct or operate a special event without first obtaining approval as provided in this chapter. The Town Clerk shall have the authority to issue special event licenses, subject to approval of the Town Council.
A. 
Applications for approval of the issuance of special event licenses shall be made to the Town Clerk no less than 45 days prior to the date of the scheduled special event. If the event is proposed to be held on Town property/recreation areas, approval from the Recreation Director and/or Town Council must be obtained prior to submitting the application. In the event the Recreation Director fails to give such approval, then approval from the Town Council shall be obtained, prior to or simultaneously with the approval of a special event license. Applications shall be made upon forms prepared by the Town Clerk and shall include the following information:
(1) 
The name and address of the applicant;
(2) 
The nature of the proposed special event, date(s) and times; location of event, proposed entertainment, and activities offered to the public;
(3) 
A diagram of the proposed area to be used describing size of lot, egress points, walls or obstacles and proposed parking area;
(4) 
The provisions for medical assistance, fire protection, police protection, parking facilities, protection of neighboring property, crowd control and sanitary facilities;
(5) 
A 300-foot radius map, and a list of the names and addresses of all owners of property within the radius area;
(6) 
Such other information as the Town Council shall find reasonably necessary to effectuate the purpose of this chapter and to arrive at a fair determination of whether the terms to this chapter have been complied with.
B. 
Hearing.
(1) 
Upon receipt of such application, the Town Clerk shall assign said application for hearing before the Town Council. A notice shall be sent by regular mail, at least one week prior to the hearing, to the owners of all properties within 300 feet of the perimeter of the premises on which the special event is proposed. The public hearing shall be advertised in a newspaper of general circulation in the Town, at least 10 days prior to the hearing, by the Town Clerk. The applicant shall be responsible for the cost of advertising and notice to abutters.
(2) 
For reoccurring events, with no change in request from the previous year, the Town Council, by a majority vote, may have the authority to waive the current year's public hearing if no complaints, issues, or questions have been presented to said Town Council as a result of the previous year's event.
C. 
Police and fire approval. Prior to the public hearing, all complete applications will be forwarded to the Police Chief and Fire for their consideration. All recommendations and/or comments will be forwarded to the Town Council prior to the public hearing. If Town Council determines that a police and/or fire detail shall be a stipulation of the license, the applicant shall be responsible for said detail fees.
D. 
A fee shall be charged for all applications for special event licenses in accordance with Chapter 368, Fee Schedule, and shall be retained by the Town whether the license is granted or denied. The license fee may be waived for nonprofit town groups holding special events for Town-wide participation. A request to waive the fee shall be included, in writing, with the application and will be considered by Council.
E. 
Should the license be granted, the license shall reflect any and all restrictions, stipulations, or terms as imposed by the Town Council.
F. 
Vendors.
(1) 
MFEs. If mobile food establishments are to be included at the proposed event, the name of each MFE shall be submitted with the special event application. Each MFE not already licensed with the Town, with their annual license, shall present their state certification and complete the licensing process prior to issuance of the special event license to the organizer. If multiple food trucks are proposed, the applicant shall also be subject to application for an event permit and/or a temporary mass gathering permit as outlined in Chapter 191, Temporary or Itinerant Vendors, §§ 191-11 and 191-12.
(2) 
Hawkers and/or peddlers. If hawkers and/or peddlers are to be included at the proposed event, each commercial hawker/peddler shall be licensed with the Town prior to issuance of a special event license. A commercial hawker/peddler is a vendor that holds a Rhode Island permit to make sales. It shall be the responsibility of the special event promoter to ensure that all commercial vendors have made application to the Town for said permit and also that all said vendors are licensed, per this chapter, on the day or day(s) of the event.
G. 
Violations/noncompliance. Violation of stipulations or noncompliance with rules of the Town, as set forth, whether in this Code of Ordinances or by a Town official, may be considered grounds for denial, revocation or suspension of any license granted hereunder or any licenses applied for in the future.
