The following words shall be defined as set forth herein for
the purposes of this chapter. In the event that any definition herein
is inconsistent with the definitions set forth elsewhere, the definitions
herein shall govern for the purposes of this chapter:
CERTIFICATE OF COMPLIANCE
A written document issued by a Code Enforcement Officer when
the property or unit thereof is in compliance with life safety and
other applicable codes.
CERTIFICATE OF OCCUPANCY
Issued by the Code Administration Office after a code compliance inspection by a Code Enforcement Officer acting on behalf of the City of Sunbury indicating that the subject property is in compliance with code and approved for occupancy under the permitted zoning use as set forth in Chapter
132, Property, Commercial.
CITY
The City of Sunbury, County of Northumberland, Commonwealth
of Pennsylvania.
CODE
The Uniform Construction Code (UCC), as adopted by the Commonwealth
of Pennsylvania; the International Property Maintenance Code as adopted
by the City of Sunbury; the Zoning Code of the City of Sunbury; and any code, ordinance, or law adopted, enacted, and/or
in effect in and for the City of Sunbury or the Commonwealth of Pennsylvania.
CODE ENFORCEMENT OFFICER
A duly appointed Code Enforcement Officer or inspector employed
by the City or a certified third-party agency contracted by the City
for the purpose of administration and enforcement of code, and any
duly authorized agents thereof.
COMMERCIAL PROPERTY
Any structure, building or premises that is subject to regulation
under applicable fire and building codes, including occupancies on
either public or private properties, as well as on all other types
of ownership which is zoned for commercial use; or a mixed-use building
with commercial and residential units; or a property with three or
more residential rental units.
COMPLIANCE INSPECTION
An inspection of the parcel, structures, and residential
rental units situated therein by a Code Officer of the City of Sunbury
using a standardized checklist.
DELINQUENT TAXES
Shall include delinquent taxes relative only to the City
of Sunbury. Shall not include school, county, state, or federal taxes.
HOUSING PERMIT
A permit issued by the City Code Administration Office after
all criteria therefor is met, and all fees have been paid by the property
owner. Said permit authorizes the property owner to operate a residential
rental unit.
HOUSING PERMIT ADDENDUM
Tenant information, including, but not limited to, the name,
age, and date of birth for each tenant residing in the rental property.
Said addendum shall further include a copy of a photo ID (or other
acceptable proof of identification, such as a birth certificate, if
no photo ID is available) for each tenant residing in the rental property
who is 18 years of age or older.
MIXED-USE PROPERTY
A commercial property within which a portion or portions
are designated for residential occupancy by owner or tenant.
OCCUPANTS
Tenants, including adults and children, whether related family
members or not, who occupy a residential rental unit, or an owner
and others residing with said owner, whether related family members
or not, occupying a residential unit.
OWNER
One or more persons, jointly or severally, in whom is vested
all or part of the legal title to the property.
PERSON
Any individual, agent, corporation, firm, partnership, association,
organization, or any other group acting as a singular unit. Also included
shall be an executor, administrator, trustee, receiver or other representative
appointed according to law. Whenever the word "person" is used in
any section of this chapter prescribing a penalty or fine, as to partnerships
or association, the word shall include the partners or members thereof,
and as to corporations, shall include the officers thereof.
POLICE
The Police Department of the City of Sunbury, or any properly
authorized member or officer thereof, or any other law enforcement
agency having jurisdiction within the City of Sunbury.
RESIDENTIAL RENTAL UNIT
A residential or commercial property or portion thereof specified
for use as a dwelling unit for lease or rent to be occupied by a tenant
or tenants for residential purposes for a period of 30 days or more.
TENANT
A person occupying all or a portion of a property, with whom
a legal interest and legal relationship with the property owner is
established by a lease, sublease, or agreement of some nature or by
the laws of the City of Sunbury and/or the Commonwealth of Pennsylvania.
UNIFORM CONSTRUCTION CODE
Pennsylvania's statewide building code, which the City
has opted into for administration and enforcement by Code Enforcement
Officers employed by the City or by a certified third-party agency.
Codes and standards enforced under the UCC are the International Codes
issued by the International Code Council, and the provisions amended
by the UCC Review and Advisory Council.
UNIT
A building or a portion of a building specified for commercial
or residential use, whether by owner or tenant, and being separated
from other such units in the same structure or premises by having
its own means of entry and security, such as a door that can be locked.
Approved storage facilities are excluded herefrom.
ZONING USE PERMIT
A permit issued by a Zoning Officer when the stated use of the property is in compliance with the Zoning Ordinance (Chapter
175) or such use has been otherwise approved by the Zoning Hearing Board.
This chapter applies to residential rental properties, the residential
portion of mixed-use properties for which there is an active housing
permit, and commercial properties consisting only of three or more
residential rental units. The provisions herein shall not apply to
any property owned by the United States government, the Commonwealth
of Pennsylvania, the City or any other governmental unit, nor to any
of their respective agencies or subdivisions.
A. For mixed-use properties, provisions of the Commercial Property Ordinance
shall also apply.
