An appeal to the Board of Adjustment may be taken by any interested party affected by any decision of the administrative officer of the Borough based on or made in the enforcement of this chapter or Official Map. Such appeal shall be taken in accordance with § 585-29 of this chapter and in accordance with the provisions of Article 9 of the Municipal Land Use Law of 1975, N.J.S.A. 40:55D-1 et seq.[1]

An appeal from any decision of the Board of Adjustment granting a use variance pursuant to the provisions of N.J.S.A. 40:55D-17 may be taken to the Borough Council, provided such appeal shall be made within 10 days of the date of publication of such final decision of the Board of Adjustment.
An appeal from any final decision of the Board other than an appeal of the type described in § 585-47 hereof and an appeal from any final decision of the Planning Board may be taken to the Borough Council, provided such appeal shall be taken in accordance with N.J.S.A. 40:55D-17.
