Pursuant to the provisions of Chapter 48 of Title 40 of the
New Jersey Statutes Annotated, there is hereby created and established
the Golden Seniors' Association Board of Trustees of and for
the Borough of Demarest, to be appointed by the Mayor with the advice
and consent of the Borough Council, as deemed necessary and proper
by the Mayor and Council. The Board shall consist of three members,
with one alternate member to participate in any Board decisions in
the absence of one or more full members. The term of Board members
shall be for three years, with the inaugural Board members to have
staggered terms of three, two and one year respectively, but in no
event for longer than three years per appointment. Alternate members
shall serve for terms of one year. Except as by further amendment
to this section, Trustees of the Golden Seniors' Association
Board of Trustees shall be a volunteer position to serve without compensation
or consideration.
The duties of the Golden Seniors' Association Board of
Trustees shall be to administer the program and to provide for senior
activities and support the organization within the budget established
and appropriated by the Borough Council. The Board shall seek funding
from public and private sources and may apply for grant funding as
appropriate to offset and defray its costs. It may employ a Director
or Secretary, if desired, and such other staff as necessary and permitted
by budgetary constraints. Such employees or staff will be privately
employed, and may be, but shall not be required to be, employees of
the Borough. Any compensation of such employees shall be borne by
the Association, and not by the Borough.
Board members shall serve without compensation. The Borough
may provide such funding as it deems adequate and proper pursuant
to the provisions of N.J.S.A. 40:48-9.4, by way of an annual, voluntary
contribution, to defray the costs and expenses of the Association.
This chapter shall be in full force and effect from and after
its adoption and any publication as may be required by law.
In the event any portion of this chapter shall be found by a
court of competent jurisdiction to be invalid, unconstitutional, or
in any other way unenforceable, that portion shall be severed therefrom
and shall not be deemed to affect the validity, constitutionality
or enforceability of the balance and remainder of the chapter.
All ordinances or parts of ordinances inconsistent with the
terms of this chapter be and hereby are repealed to the extent of
such inconsistency.
