It shall be unlawful for any property owner or tenant to allow
any domesticated or caged animal to create a sound across real property
lines which unreasonably disturbs or interferes with the peace, comfort
and repose of any resident, or to refuse or intentionally fail to
cease the unreasonable noise when ordered to do so by any official
authorized to enforce this article. Violation of this article shall
include, but is not limited to:
A. Vocalizing (howling, yelping, barking, squawking, etc.) by the animal
for five minutes without interruption, defined as an average of four
or more vocalizations per minute in that period; or
B. Vocalizing by the animal for 20 minutes intermittently, defined as
an average of two vocalizations or more per minute in that period.
The Township Police Department and/or the Animal Control Officer
shall, in connection with their duties imposed by law, diligently
enforce the provisions of this article.
Any person violating the provisions of this article shall be
liable to a penalty of not less than $100 for a first offense and
a fine of not less than $500 for each subsequent offense, and upon
failure to pay the fine and the costs and charges incident thereto,
may be imprisoned in the county jail for a period not exceeding 10
days in the case of a first conviction, and in the case of a conviction
for any subsequent violation, for a period not exceeding 30 days.
