This article shall be known as and may be cited as "The Township of Reserve Employee Residency Requirement Ordinance."
This article shall apply to all employees hired by the Township of Reserve after the enactment date of this article. The provisions of this article shall not apply to the Township Engineer, Township Solicitor and to any independent contractors which the Township may engage.

As used in this article, the following terms shall have the meanings indicated:
EMPLOYEE
Any person hired or employed by the Township of Reserve for full-time positions, with the exception of the Township Manager, in the following:
A. 
Police Department.
B. 
Office and Clerical.
C. 
Road Department and Water Department.
D. 
Building Inspector.
E. 
Any and all other positions of employment that the Township of Reserve may hereafter create or designate.

Any person hired by the Township of Reserve for full time employment must either reside in the Township or within a radius of five air miles from the geographic boundary of the Township, and must continue to be a Township resident or reside within said five mile proximity throughout the term of his or her employment. Full-time employees may reside outside of Reserve Township only with approval by the Board of Commissioners.

The employment of any employee hired after the enactment date of this article, who fails to reside in the Township or within a five air mile radius of the Township shall be terminated.[1]

That any ordinance or parts of ordinances conflicting with the provisions of this article be and the same are hereby repealed to the extent of such conflict.

All new officers appointed to the position of police officer in the Township shall reside within five air miles of the Township within one year after such appointment.
All Township police officers shall maintain a bona fide residence within five air miles of the Township of Reserve as a condition of his or her employment and any police officer who does not maintain such bona fide residence within five air miles of the Township shall be terminated.
As used in this article, measurement of distance shall be made in a straight line, without regard to intervening structures or objects, from the nearest property line of the residence of the police officer to the nearest property line of the Township Municipal Building.
This article shall be effective January 1, 2004.
Ordinance No. 566, Ordinance No. 602 and all other ordinances or parts of Ordinances conflicting with the provisions of this article be and the same are hereby repealed to the extent of such conflict.
