A. The Board of Trustees hereby finds that the Village parks are matters
affecting the public interest and consequently should be subject to
supervision and administrative control for the purpose of safe-guarding
the public health, safety and general welfare of the public and the
people of the Village of Poquott.
B. Accordingly, in order to protect the natural resources of the Village
of Poquott, it is the intent of this chapter to regulate and monitor
access to, and the use of, Village parks and other Village-owned properties
in order to preserve the natural beauty and ecological value of these
recreational areas and to protect them against damage, erosion, litter
and vandalism.
As used in this chapter, the following terms shall have the
meanings indicated:
VILLAGE PARKS
All parks, playgrounds and other recreation areas, including
docks, waterfront, boat ramp and tennis courts owned by the Village
of Poquott.
A. Parking at Village parks shall continue to be restricted to Village
residents with valid Village of Poquott parking stickers.
B. Use of boat rack. Refer to Chapter
43, Article
II, §
43-21, regarding permitting for boat racks at Walnut, California and Van Brunt Manor Parks. All items are to be removed from the Village boat racks by December 1 of each year.
C. Use of boat ramp. No person shall launch or land a jet ski or other
vessel at the California Park Boat Launching Ramp unless said person
is a resident of the Village of Poquott with a current and valid Village
of Poquott parking permit validly assigned to and attached to the
vehicle that is being used to land or launch the vessel or to any
person who has obtained a temporary one-time pass to use the ramp
to launch a boat or other vessel owned by a Village resident. Police,
fire and other government agencies are exempt from this permit requirement
while on official business.
D. The use of the Village dock and tennis court shall be limited to
Village residents only.
E. Use of the Village dock.
(1) The Village dock, boat ramp, and adjacent parking area are for the
use of Village residents. The dock and ramp provide convenient access
to water craft for residents and their guests for loading and unloading
passengers and supplies. No commercial operation or activity shall
be operated from the dock or boat ramp at any time.
(2) All persons using the dock do so at their own risk and are responsible
for their own property. The Village of Poquott is not liable for any
injury or damages resulting from the use of the dock or boat ramp.
(3) Seasonal operation. Contingent on weather conditions, use of the
dock will be closed to vessels each year from approximately November
15 to April 1 or as posted by the Board of Trustees.
(4) Boats may not remain tethered to the dock overnight.
(5) Due to limited docking space, residents should be mindful of other
vessels waiting to use the dock and not remain tethered to the dock
longer than necessary.
(6) Children under the age of 12 years are not permitted anywhere on
the dock without adult supervision. All children under the age of
12 are encouraged to wear Coast Guard approved life jackets while
on the dock.
(7) No fires, cooking, or open flames are allowed on the dock or on vessels
tethered to the dock.
The following activities are prohibited at all Village parks:
A. Depositing or abandoning any garbage, sewage, refuse, trash, grass
clippings, branches, leaves or other waste material, except in receptacles
provided for such purpose.
B. Depositing or abandoning any material which may be hazardous to public
health or safety.
C. Firing or discharging a firearm or the possession of or firing of
a slingshot, or fireworks or explosives of any kind.
D. Trimming, cutting down, digging up, removing, injuring or destroying
any tree, shrub, plant, flower or wild animal.
E. Disobeying an order of a police officer, Code Enforcement Officer,
or other person duly empowered and authorized to enforce the provisions
of this chapter, or disobeying the notices, prohibitions, instructions,
directions or rules and regulations on any sign or as shall be established
by the Board of Trustees from time to time.
F. Village Parks are subject to the provisions of Ch.
57, Burning, Open.
