In accordance with the authority set forth in the New Jersey
statutes, the Board of Commissioners of the City of Margate hereby
establishes the position of Municipal Administrator for the City of
Margate City, County of Atlantic and State of New Jersey. The duties
and responsibilities for said position are established hereinafter
and created under this article.
The Board of Commissioners of the City of Margate shall appoint
the Municipal Administrator by resolution, with no less than 2/3 of
the Board voting in the affirmative. The term of office of the Municipal
Administrator shall be at the pleasure of the Board of Commissioners.
If a vacancy shall occur as a result of the termination of the Administrator
or for such other reason, such vacancy shall be filled in accordance
with the appointment procedure hereinbefore mentioned, with the requirement
being, at all times, that said appointment be authorized by no less
than 2/3 of the Board of Commissioners voting in the affirmative.
The salary of the Municipal Administrator shall be determined and
fixed by the Board of Commissioners of the City of Margate, which
determination shall be included within the salary ordinance of the
City of Margate.
The Municipal Administrator may be removed from office by a
2/3 vote of the Board of Commissioners of the City of Margate. The
resolution of removal shall become effective three months after its
adoption by the governing body. In accordance with N.J.S.A. 40A:9-138,
the governing body may provide that the resolution of removal shall
have immediate effect; provided, however, that the governing body
shall cause to be paid to the Administrator forthwith any unpaid balance
of his/her salary and his/her salary for the next three calendar months
following adoption of the resolution.
The Municipal Administrator shall be selected on the basis of
his/her executive and administrative abilities, with special emphasis
on the experience, education and training that said person has in
the area of governmental affairs.
The Municipal Administrator shall be under the supervision and
control of each member of the Board of Commissioners as it shall relate
to the departments directly under their control and, in those instances
where applicable, under the supervision and direction of the Board
of Commissioners of the City of Margate, and shall have the following
duties and responsibilities pertaining thereto:
A. To serve as the principal administrative officer representing the
Board of Commissioners, and be responsible to the Board of Commissioners,
as a whole, for the proper and efficient administration of the business
affairs of the City of Margate. The duties and responsibilities of
the Municipal Administrator shall relate to the general management
of all City business, except those duties and responsibilities conferred
upon other City officials by state statute, other applicable laws,
rules and regulations promulgated by the state and county agencies,
decisional law or ordinances of the City of Margate.
B. To supervise and coordinate the administration of all departments
and offices, in consultation the Commissioner of each respective department.
C. To represent the City, when directed by the Board of Commissioners,
in its relations with federal, state, county and local governments,
and to evaluate, when requested by the Board of Commissioners, the
City's interests in contracts, franchises and other business transactions.
D. To study the administrative and other operations of the City and
make recommendations for plans and programs to meet the changing needs
of the City.
E. To attend all meetings of the Board of Commissioners.
F. To continually review and maintain the personnel policies and practices
of the City and recommend proposed changes for a more efficient operation
of the City.
G. To recommend the nature, location and extent of public improvements
in conjunction with the appropriate department head and to coordinate
the execution of same when authorized by the Board of Commissioners.
H. To implement and enforce the policies of the Board of Commissioners
with respect to the compiling and release of public information.
I. To receive from each department, office and board their annual budget
requests and to review and transmit same, along with comments and
recommendations to the Board of Commissioners.
J. To consult with the Board of Commissioners, the City Auditor and
department heads on the preparation of the budget and submit the final
recommendations together with an analysis of the various items of
revenue and expenditure in the form required by law.
K. To maintain a continuing review with the City Auditor of work progress
and the cost of municipal services and report same to the Board of
Commissioners on a monthly basis.
L. To coordinate the disbursement of all City funds and ensure approval
by the appropriate department head of all vouchers and bills before
submitting same to the Board of Commissioners for approval.
M. To continually review the City's insurance program with the insurance
representatives for the City and recommend to the Board of Commissioners
any changes or modifications to the plan of insurance in force at
the time.
N. To assist the Board of Commissioners in negotiating collective bargaining
agreements with the employees of the City of Margate.
O. To act as a liaison on behalf of the City with all utility companies
serving any portion of the City to ensure that such utility companies
are providing adequately for the needs of the residents of the City.
P. To assure that the provisions of all franchises, leases, permits
and privileges granted by the City are in compliance.
Q. To investigate and pursue federal, state and other aid projects and
programs for which the City of Margate may qualify and advise the
Board of Commissioners of the progress of said programs.
R. To act as the purchasing officer of the City of Margate and to purchase
in accordance with the provisions of the governing statutes and sound
purchasing practices, in order to secure all the supplies and equipment
for the various departments and agencies of the City. Purchases shall
be made in conjunction with the department heads and/or representatives
of the various agencies, boards and other offices within the City.
S. To require each department to maintain inventory records of all equipment
and materials owned and used by the City and dispose of all inadequate
or obsolete materials when so directed by the Board of Commissioners.
T. To advise the Board of Commissioners verbally and/or in writing on
all matters affecting the City.
U. To perform such other duties as may be assigned from time to time
by the Board of Commissioners.
The position of Municipal Administrator shall be a full-time
position, and the daily work hours shall include but not be limited
to 9:00 a.m. to 4:00 p.m., Monday through Friday. The Board of Commissioners
reserves the right to set additional hours for the Municipal Administrator.
Pursuant to N.J.S.A. 40A:9-136, a person appointed to the office
of Municipal Administrator need not be a resident of the City of Margate.
Nothing in this article shall authorize the Municipal Administrator
to exercise the powers and duties of the elected and appointed officials
of the City.
