The annual license fees are fixed as follows:
A. 
Plenary retail consumption: $430.
B. 
Plenary retail distribution: $354.

Seasonal retail consumption: $320.
D. 
Club: $150.
A. 
No licensee shall sell, serve, deliver or allow, permit or suffer the sale, service or delivery of any alcoholic beverage or permit consumption of any alcoholic beverage upon the licensed premises on New Year's Day, when it is a weekday, between the hours of 3:00 a.m. and 7:00 a.m.; on New Year's Day, when it is a Sunday, between the hours of 2:00 a.m. and 1:00 p.m.; or other weekdays between the hours of 3:00 a.m. and 7:00 a.m.; or on other Sundays between the hours of 2:00 a.m. and 1:00 p.m.
B. 
Exception to Sunday operations hours. No plenary retail distribution licensee shall serve or deliver any alcoholic beverages on Sundays between the hours of 2:00 a.m. and 9:00 a.m. All other restrictions regarding hours of operations of sale on weekdays and holidays shall continue in full force and effect.

Any person who violates any provision of this article shall, upon conviction thereof, be subject to the penalty provisions in Chapter 1, Article II, General Penalty, of the Code of the Township of Harmony.

As used in this article, the following terms shall have the meanings indicated:
DRINKING
Consuming or holding an open or partly consumed container of an alcoholic beverage of any nature or having in one's possession an open or partly consumed container of an alcoholic beverage of any nature.
PUBLIC PLACE
Any place to which the public has access, and shall include any street, highway, road, alley or sidewalk. It shall also include the front or the neighborhood of any store, shop, restaurant, tavern or other place of business and public grounds areas and parks, as well as parking lots or other vacant private property not owned by or under the control of the person charged with violating this article.
A. 
No person shall drink in a public place without a duly authorized permit from the Mayor.
B. 
This section shall not apply to an owner of private property and his guests or to a business holding a valid retail plenary alcoholic beverage consumption license.
Whenever any police officer shall, in the exercise of reasonable judgment, decide that any person in any public place is drinking alcoholic beverages as enumerated in §§ 124-4 and 124-5, that person shall be guilty of a violation of this article.
