It is determined and declared that the Township of Harmony contains a place where an agricultural fair and exhibition is held by an association organized for the purpose of holding agricultural fairs and exhibitions which has been approved by the State Department of Agriculture, namely "Warren County Farmer's Fair Association, Inc."
It shall be unlawful for any person, persons, firm or corporation to own or operate within the Township of Harmony any amusement games, as said terms are defined by the Amusement Games Licensing Law, P.L. 1959, c. 109, and the amendments thereto,[1] without first having obtained a license from the Township Committee of the Township of Harmony. Said license shall be issued pursuant to and subject to the provisions of the Amusement Games Licensing Law, as amended, and rules and regulations issued thereunder.

Each applicant for such a license shall file with the Township Clerk of the Township of Harmony a written application on such form as may be prescribed by the Amusement Games Licensing Law, as amended, and also in accordance with the rules and regulations which may now or hereafter be promulgated by the Amusement Games Control Commissioner.
The fee for each municipal license shall be five dollars ($5.).

In addition to the above fee, each applicant and applicant employee shall provide with application a current fingerprinting report acceptable to the State of New Jersey under the rules and regulations issued by the Amusement Games Control Commissioner for each licensee and employee of said licensee.
Amusement games can be conducted only during that part of the year when there is conducted in the Township of Harmony an agricultural fair and exhibition by an association organized for the purpose of holding the same and which is approved by the State Department of Agriculture for participation in any or all state-sponsored programs relative to the promotion of agriculture and the advancement of agricultural interests in this state.
On the days set forth in § 128-6 of this chapter, amusement games may be conducted from 10:00 a.m. to 1:00 a.m. on the following day, except that there shall be no amusement games conducted on any Sunday.
A. 
In the event that any licensee shall violate any of the provisions of this chapter or the Amusement Games Licensing Law or the rules and regulations promulgated by the Amusement Games Control Commissioner or the terms of such license, such licensee shall be a disorderly person and, if convicted as such, shall, in addition to suffering any of the penalties which may be imposed, forfeit any license issued to such licensee under this chapter.
B. 
Any person who violates any provision of this chapter shall, upon conviction thereof, be subject to the penalty provisions in Chapter 1, Article II, General Penalty, of the Code of the Township of Harmony.
