All proposed amendments, supplements or changes originating
by petition or by motion of the Common Council shall be referred to
the Planning Commission for a report and recommendations thereon.
The Planning Commission shall submit its report within 45 days after
receiving such referral. Failure of the Planning Commission to report
within the required time shall be deemed to be approval of the proposed
amendment.
After the public hearing and referral to and report by the Planning Commission, a majority vote of the members of the Common Council shall be required to amend this chapter, except as described in §
640-65.
If a protest against a proposed amendment, supplement or change
is presented to the Common Council, duly signed and acknowledged by
the owners of 20% or more of the area of the land included in such
proposed change, or by the owners of 20% or more of the land immediately
adjacent extending 100 feet therefrom, or by the owners of 20% or
more of the land directly opposite thereto extending 100 feet from
the street frontage of such opposite land, such amendment shall not
be passed except by the favorable vote of 3/4 of the Common Council.
From time to time, at intervals of not more than three years,
the Planning Commission shall reexamine the provisions of this chapter
and the location of district boundary lines and shall submit a report
to the Common Council recommending such changes or amendments, if
any, which may be desirable in the interest of public safety, health,
convenience, necessity or the general welfare.
