The floor area of the roofed structure or a combination of the floor
area and attached pen area must equal at least 10 square feet of area
per chicken.
No farm animal shall be kept or allowed to be kept within 50 feet
of any stormwater catch basin which is located on private property.
For purposes of this section, stormwater catch basins located within
a public or private street shall not be counted.
The roofed structure for the chickens may only be located in a rear
yard and must meet setback and building separations as established
in Village zoning and building codes. Contact the Village Zoning Administrator
with questions.
The floors and walls of the roofed structure shall be kept in a clean,
sanitary and healthy condition with all droppings collected on a daily
basis and placed in a fireproof covered container until applied as
fertilizer, composted or transported off the premises.
Chickens must be kept in the roofed structure, an attached pen, or
a detached mobile pen whenever they are unattended by the keeper;
but when attended by the keeper, the chickens are allowed in a completely
fenced exercise yard.
A late fee shall be collected if the owner fails to obtain a license
prior to April 1 of each year or within 30 days of acquiring the animals
intended to be kept within the village. The late fee will be set by
the Village Board annually.
Delinquent renewal fees shall be collected in the manner specified
in § 74.11, Wis. Stats., for collection of personal property
taxes. The law enforcement officer of the Village may issue a citation
and bring action in Lafayette or Iowa County Circuit Court for failure
to license or renew as required by this article.
Where three or more violations occur within a 365-day period the
Public Safety Committee may vote to ban an address from participation
in this program, recording that decision in a Ban List.
A resident of a banned address may be petitioned to be removed from
the ban list, no sooner than one year after the address being banned
except where provided below.
The Ban List shall be reviewed annually by the Public Safety Committee
in October or when a resident petitions the Committee upon purchasing
a property whose address is on the banned list.
If the Planning Commission chooses to end the permitting of chickens
or deprecates the program entirely, written notice is to be served
to applicable addresses where chickens are kept at least 90 days before
the effective end date or date at which animals would need to be removed
from the Village.
Whenever in the judgment of the Village Officer an emergency exists which requires immediate action to protect the public health, safety or welfare, an order may be issued without notice, conference, or hearing, directing the owner/occupant or apparent agent to take appropriate action to correct or abet the emergency. Should such a unique situation arise it is be discussed at next Public Safety Committee Meeting, by date upon which the order was given, regardless of which officer(s) were involved. Failure to comply with the notification provision is governed by Chapter 5.
