Pursuant to Section 79.450, RSMo., a municipal fire department, herein after known as, the "Fayette Municipal Fire Department," is hereby established to provide fire suppression, protection and fire safety services within the municipal City boundaries of the City of Fayette, Missouri.

The Fayette Municipal Fire Department shall consist of a Fire Chief or Co-Fire Chiefs, who shall be selected by a majority vote from among the volunteer firefighters in the Department. The result of that selection process shall be provided to the Mayor within seven (7) days of the selection vote. The Mayor shall present the nominee for Fire Chief, or Co-Fire Chiefs to the Board of Aldermen at the next regularly scheduled meeting of the Board. The Board of Aldermen shall review the nominee, or nominees, for approval, which approval shall not be unreasonably withheld. The Fayette Municipal Fire Department shall also consist of as many volunteer firemen as may be enrolled by the Fire Chief, or Co-Fire Chiefs with the consent and approval of the Mayor and Board of Aldermen. Any reference to the Fire Chief in the Code or Ordinances of this City shall be construed to also refer to any Co-Fire Chiefs when such are appointed.

The Fire Chief and any volunteer firefighters shall receive as compensation for their services such sum as may be designated by resolution by the Board of Aldermen.

The Fire Chief shall report to the Board of Aldermen monthly at a regular meeting of the Board of Aldermen, the condition of the Department, of any fire apparatus needs or replacements, any repairs needed, and any recommendations for the betterment of the service or equipment, and shall participate in the budget process to prepare an annual budget for the Municipal Fire Department and present the same to the Board to be approved with the City's annual operating budget.
