The provisions of this article shall apply whenever a bicycle
(including a low-speed electric bicycle and motorized bicycle as defined
herein) is operated upon any street, sidewalk, public way, park or
any other public property within the City of Hackensack, subject only
to those exceptions stated in this article or as provided by New Jersey
law. Unless otherwise specified, all of the provisions of this article
shall apply equally to bicycles, low-speed electric bicycles and motorized
bicycles.
As used in this article, the following terms shall have the
meanings indicated:
BICYCLE
A two-wheeled vehicle having a rear drive that is solely
human-powered and having a seat height of 25 inches or greater when
the seat is in the lowest adjustable position. For purposes of this
article, the term "bicycle" shall also encompass a device that has
one, three or four wheels (unicycle, tricycle or quadracycle) that
has a saddle or seat or seats, and is propelled by human power, via
pedals.
LOW-SPEED ELECTRIC BICYCLE
A two- or three-wheeled vehicle with fully operable pedals
and an electric motor of less than 750 watts, that meets the requirements
of one of the following classifications:
A.
"Class 1 low-speed electric bicycle," which means a low-speed
electric bicycle equipped with a motor that provides assistance only
when the rider is pedaling, and that ceases to provide assistance
when the bicycle reaches the speed of 20 miles per hour; or
B.
"Class 2 low-speed electric bicycle," which means a low-speed
electric bicycle equipped with a motor that may be used exclusively
to propel the bicycle, and that is not capable of providing assistance
when the bicycle reaches the speed of 20 miles per hour.
MOTORIZED BICYCLE
A pedal bicycle having a helper motor characterized in that
either the maximum piston displacement is less than 50 cc or said
motor is rated at no more than 1.5 brake horsepower or is powered
by an electric drive motor and said bicycle is capable of a maximum
speed of no more than 25 miles per hour on a flat surface, or a pedal
bicycle having an electric motor that is capable of propelling the
bicycle in excess of 20 miles per hour with a maximum motor-powered
speed of no more than 28 miles per hour on a flat surface. This term
shall not include a low-speed electric bicycle as defined in this
section. A motorized bicycle is also commonly referred to as a "moped."
Every person operating a bicycle on a roadway or other area
subject to the City's jurisdiction shall be granted all the rights
and shall be subject to all the duties applicable to the driver of
a vehicle by the laws of New Jersey and the traffic provisions of
the City Code applicable to the driver of a vehicle, except as to
special regulations in this article and except as to those provisions
of laws and ordinances that by their nature are inapplicable to such
persons.
Any person found in violation of this article, upon conviction thereof, shall be punished by a fine and/or community service as authorized by §
1-15 of Article
I, Chapter
1, General Provisions, of the Code of the City of Hackensack.
