Any development or redevelopment projects that disturb greater
than or equal to one (1) acre, including projects less than one (1)
acre that are part of a larger common plan of development or sale
that would disturb one (1) acre or more.

As used in this Article the following terms shall have the meanings
indicated:
DETENTION
Any structure which is designed to collect and store surface
water for subsequent gradual discharge.
NATURAL WATERCOURSE
A channel that is formed through the natural flow of stormwater
runoff influenced by area topography. The channel can carry a flow
of water continuously or intermittently. Such a channel can include
but not be limited to swales, streams, creeks, gullies, ravines, or
rivers of varying depths and lengths.
ONE-HUNDRED-YEAR STORM
A rainstorm of varying duration and intensity having a one
percent (1%) probability of recurring in any one (1) year.
POST-DEVELOPMENT
The conditions which are expected to exist, or do exist,
after alteration resulting from human activity, of the natural topography,
vegetation and rate, volume or direction of surface or subsurface
flow.
PRE-DEVELOPMENT
Those conditions which exist at a site prior to any alteration
of the natural topography, vegetation, flow rate, flow volume, or
direction of surface or subsurface flow. In the case of a site where
development has occurred in the past, the pre-development condition
shall be the physical conditions of the site at the time of the application
for the permit.
RETENTION
Any structure which is designed to collect and store surface
water without releasing it except through infiltration or evaporation.
TWENTY-FIVE-YEAR STORM
A rainstorm of varying duration and intensity having a four
percent (4%) probability of being equaled or exceeded in any given
year.

A. Stormwater
Retention. The first one (1) inch of rainfall is to be retained on
the site using methods such as retention, infiltration, and green
infrastructure. Runoff flowing to the site from upstream areas may
be passed through the site without being retained.
B. The
post-development peak discharge from the site must not exceed the
pre-development peak discharge for the twenty-five-year and one-hundred-year
frequency events.
C. Natural
watercourses shall have an easement extending fifty (50) feet in either
direction from the centerline of the channel. Permanent vegetation
should be left intact within this easement.
D. Building
gutter drainage systems may not be discharged directly into the City's
enclosed stormwater collection system.

A. All
stormwater BMPs shall be regularly maintained such that they continue
to function as originally designed.
B. The
person(s) responsible for ongoing maintenance should be clearly specified
in the applicant's long-term maintenance plan.
C. Designs
should include sufficient access for long-term maintenance of all
stormwater structures.

A. The
following shall be submitted to the City prior to construction in
order to obtain an authorization to proceed with the project.
1. Stormwater design plans, including, at a minimum, proposed stormwater
BMPs, impervious surfaces, stream locations, and FEMA flood plain
boundaries.
2. Retention and detention volumes of all stormwater detention structures.
3. Peak runoff flow rates into and out of stormwater detention structures.
4. Peak discharge rates for pre-development and post-development conditions.
5. Hydrologic calculation used to design and analyze stormwater BMPs.
6. Long term maintenance plan, specifying, at a minimum, the person(s)
responsible for long term maintenance of all stormwater BMPs, the
method of maintaining the stormwater BMPs, and the frequency of maintenance.

A. All
stormwater plans and calculations shall be submitted to the City along
with the building permit application and must be approved prior to
a building permit being issued.
B. Final
construction approval shall occur with the final building inspection
prior to occupancy.

A. Enforcement
shall be performed by the Code Enforcement Officer. The Code Enforcement
Officer, and other duly authorized employees bearing proper credentials
and identification, shall be permitted to enter upon all properties
for the purpose of inspection, observation, and measurement in accordance
with the provisions of this Article.
B. Violation
of the provisions of this Article or failure to comply with any of
its requirements will result in a written notice to comply which will
set forth the nature of the correction required and the time within
which the correction shall be made.
C. Failure
to comply with the written notice will result in a fine no less than
one dollar ($1.00) and no greater than five hundred dollars ($500.00)
for each offense. Each day such a violation continues shall be considered
a separate offense.
