In accordance with the Absolute Charter issued by the University
of the State of New York Education Department, a municipal public
library and Library Board of Trustees was authorized and is hereby
established by the Village.
The Library shall be administered by a Board of Trustees consisting
of five members, who are approved by the Mayor of the Village and
the Village Board of Trustees.
Members of the Library Board of Trustees shall be appointed
five-year terms. Vacancies occurring other than by expiration of terms
of office shall be filled for the unexpired terms of the offices so
filled.
Each member of the Library Board of Trustees shall serve without
compensation.
The Library Board of Trustees shall be responsible for appointing
all library staff, including but not limited to a Secretary to the
Library Board of Trustees.
The Library Board of Trustees shall be required to hold the
required number of meetings each year in accordance with the Library
by-laws. Library Board meetings shall fall under provisions of the
Open Meetings Law. Written minutes of such meetings shall be kept
and maintained and copies thereof shall be promptly furnished to the
Village Clerk.
All ordinances, local laws or resolutions, or parts of ordinances,
local laws or resolutions of the Incorporated Village of Valley Stream
inconsistent with the provisions of this chapter are hereby repealed,
provided, however, that such repeal shall be only to the extent of
such inconsistency and in all other respects this chapter shall be
in addition to other legislation regulating and governing the subject
matter covered by this chapter.
If any section, paragraph, subdivision or provision of this
chapter shall be adjudged invalid or held unconstitutional the same
shall not affect the validity of this chapter as a whole or any part
or provision thereof, other than the part so decided to be invalid
or unconstitutional.
The foregoing provisions shall take effect immediately upon
filing with the Secretary of State.
