This chapter shall be known as the "Borough of Brentwood Park Rules and Regulations."
The Council of the Borough of Brentwood, following due investigation, deems it necessary to establish rules and regulations governing the use and rental of the Brentwood Borough Facilities (as defined below) to provide for the health, safety and welfare of such public facilities.
As used in this chapter, the following terms shall have the meanings indicated:
BOROUGH FACILITIES
A. 
Borough municipal building.
B. 
Borough field stadium.
C. 
Borough Park:
(1) 
Ball fields;
(2) 
Basketball court;
(3) 
Dek hockey rink;
(4) 
Swimming pool;
(5) 
Tennis court; and
(6) 
Track field.
D. 
Community room.
E. 
Civic center.
The activities listed in this § 155-4 are prohibited anywhere in the Borough Facilities. Exceptions to these prohibitions will be recognized only upon possession and presentation of a written authorization signed by the Parks and Recreation Director or the Borough Manager, by signs posted by authorized representatives of the Director, or by immediate direction of a Brentwood Borough Police Officer.
A. 
Motor vehicles.
(1) 
Driving or parking on grass areas or trails;
(2) 
Parking at any place where official signs prohibit parking;
(3) 
Washing, greasing, lubricating, or repairing;
(4) 
Landing any aircraft for any nonemergency purpose;
(5) 
Operating any motorized conveyance, including, but not limited to, snowmobiles, all-terrain vehicles, motorcycles, or motor scooters except that street licensed vehicles may be used in parking lots, or roads open to traffic; or
(6) 
Exceptions shall include those devices utilized for and covered by the American with Disabilities Act of 1990.
B. 
Shrubs, flowers, trees, grass, turf, soil or rock formations.
(1) 
Picking, cutting, breaking, digging, defacing or injuring any shrubs, flowers, trees, grass, turf, soil or rock formations in any way.
C. 
Buildings, structures or park facilities.
(1) 
Damaging, defacing or misusing any buildings, structures or park facilities in any way;
(2) 
Use of the stadium track during high school games, paid events and other times designated by the Borough;
(3) 
Placement and use of soccer goals without a permit issued by the Borough;
(4) 
Hanging or climbing on the football or soccer goal posts;
(5) 
Use of any area of the Borough Park for a formal or practice game without a permit issued by the Borough. Reservation must adhere to designated field, unless approval is given by the Borough;
(6) 
Having more than permitted number of individuals in the press box at anyone time and absolutely no more than six individuals shall be on the roof of the press box at anytime;
(7) 
Use of the Dek hockey rink without tennis shoes or roller blades; or
(8) 
Use of the track field and Borough stadium without rubber cleats with 1/4 inch-track spikes or shorter.
D. 
Wastepaper, garbage and refuse.
(1) 
Scattering or depositing except in appropriate receptacles;
(2) 
Failing to clean up and place all picnic wastepaper, garbage and refuse in receptacles provided for that purpose; or
(3) 
Depositing in park receptacles wastepaper, garbage or refuse except for that generated in the park by normal or permitted park activities such as picnicking.
E. 
Animals, birds and fish.
(1) 
Except as specifically authorized by the Parks and Recreation Department, molesting, trapping, hunting, capturing, killing or injuring any bird or mammal; or
(2) 
Abandoning animals or birds within the park.
F. 
Advertising.
(1) 
Except as specifically authorized by the Parks and Recreation Department in accordance with the Brentwood Borough Advertising and Naming Rights Policy, posting or distributing any notice signs, advertisements, or handbills; or
(2) 
Posting regarding permitted park activities may be authorized by the Parks and Recreation Department or by permit but must be removed by sunset of each day.
G. 
Weapons and explosives.
(1) 
Discharge of any firearm or weapon, including, but not limited to, handguns, rifles, shotguns, crossbow, bow and arrow, air rifle or pistol, any device firing a projectile by compressed gas or spring, such as paintball devices, or as otherwise specifically allowed by permit issued by the Parks and Recreation Department;
(2) 
Brandishing of a firearm or weapon, including, but not limited to, handguns, rifles, shotguns, crossbow, bow and arrow, air rifle or pistol, any device firing a projectile by compressed gas or spring, such as paintball devices, except as otherwise specifically allowed by permit issued by the Parks Department. Firearms may be transported through the park if kept in a car trunk, enclosed in a case, or otherwise inaccessible to use. Nothing contained herein shall prohibit any person licensed under the Pennsylvania Uniform Firearms Act, 18. Pa. C.S.A. § 6109, from possession of a firearm as defined in the Pennsylvania Uniform Firearms Act, 18 Pa. C.S.A. § 6102.
(3) 
Sale, use, discharge or cause to be discharged, ignited, fired or otherwise set in action, any fireworks, firecrackers, sparklers, cannons using gunpowder for ignition or other pyrotechnics, except in compliance with the provisions of Chapter 112 of the codified ordinances of the Borough of Brentwood, entitled "Fireworks."
H. 
Merchandising.
(1) 
Offering, distributing, supplying, renting or selling any literature, commodity, article, material, equipment, service or supply.
I. 
Noise.
(1) 
Using electrical amplifying equipment; or
(2) 
Performing activities that violate Chapter 145 of the codified ordinances of the Borough of Brentwood, entitled "Noise."
J. 
Alcoholic beverages.
(1) 
Bringing, introducing, drinking, or selling alcoholic beverages without a permit issued by the Borough in accordance with Chapter 70 of the codified ordinances of the Borough of Brentwood, entitled "Alcoholic Beverages."
(2) 
Persons who appear to be under the influence of alcohol or narcotics.
K. 
Beverages; food.
(1) 
All glass containers;
(2) 
No food or drink, except water and sport drinks, shall be permitted on the track or field.
(3) 
No sunflower seeds or gum is permitted on the track or field.
L. 
Nonmotorized Vehicles.
(1) 
Operating any nonmotorized conveyance, including, but not limited to, bicycles, skateboards, rollerblades, sledding, scooters, hover boards, or any other type of similar nonmotorized conveyance device, except that they may be used to access the area designated as the place to park said nonmotorized vehicle (i.e., bike racks, etc.).
M. 
Remote-controlled soaring and/or gliding crafts.
(1) 
Flying, introducing, bringing unmanned aircraft systems, drones, RC aircraft, toy aircraft, and rockets.
N. 
Animals.
(1) 
Brining, introducing, or leading domesticated animals with the exception of service dogs.
O. 
Smoking.
(1) 
Smoking, including the use of smokeless tobacco products; or
(2) 
Any electronic oral device, such as one composed of a heating element, battery or electronic circuit, which provides a vapor of nicotine or any other substances and the use or inhalation of which simulates smoking. The term shall include any such device, whether manufactured, distributed, marketed or sold as an e-cigarette, e-cigar or e-pipe or under any other product name or descriptor shall be prohibited in any area of the stadium/park or facilities.
P. 
Use of profanity.
Q. 
Skateboarding.
R. 
Golfing.
S. 
Markings/paint.
(1) 
No chalking, tape or other adhesive material shall be placed on fields or track surfaces;
(2) 
No painting shall be placed on the field surface without prior approval by the Borough; or
(3) 
No stakes, spikes or other pointed materials may be used for anchoring anything on the fields or track surfaces without prior approval by the Borough.
T. 
Park hours.
(1) 
Use of the Borough Facilities outside the hours of 7:00 a.m. through 11:30 p.m. Sunday through Saturday.
The activities in this § 155-5 are permitted in any area lying within a Brentwood Borough Stadium/Park and facilities but are subject to the regulations indicated herein and those conspicuously posted in the appropriate area. Use of the stadium/park and facilities and its equipment shall be at the users' own risk.
A. 
Picnicking, tennis, baseball, softball, basketball, soccer, football, horseshoe pitching, and related and similar forms of recreation are permitted only in areas designed for such use, and in no case shall such use be permitted in areas where park facilities or areas may be damaged.
B. 
Fires.
(1) 
Fires are permitted only in grills or similar designated areas and facilities and must be thoroughly extinguished before leaving the area;
(2) 
Matches, cigars, cigarettes, charcoal, and all flammable materials must be thoroughly extinguished before being disposed of.
C. 
Sale of food and refreshments.
(1) 
Food and refreshments may be sold only by concessionaires approved by the Borough of Brentwood and may only be sold pursuant to the provisions of their respective concession agreements and/or permits;
(2) 
If food and refreshment concessionaires are unwilling to provide such service at special events, the holders of the appropriate permits may provide refreshments to the public subject to approval and conditions imposed by the Borough of Brentwood.
D. 
Charging admission for permit areas and buildings.
(1) 
The holders of permits for any stadium/park or facility areas who are engaged in a non-profit-making enterprise may charge the public for admission to an event.
(2) 
Any fees and/or charges are subject to the approval of the Borough of Brentwood at least one week prior to the date of the permit.
E. 
Public gatherings.
(1) 
Meetings, assemblies, parades or related forms of public gatherings will be permitted upon possession and presentation of a written authorization signed by the Borough of Brentwood.
F. 
Use of permit facilities.
(1) 
Permits are required to reserve buildings, pavilions, athletic fields and other facilities.
(2) 
Permits are issued in compliance with the Borough's Facility Rental Policy.
G. 
Alcoholic beverages.
(1) 
Consumption of alcoholic beverages shall be limited to those areas where a permit has been issued in accordance with Chapter 70 of the codified ordinances of the Borough of Brentwood, entitled "Alcoholic Beverages."
A. 
Penalties.
(1) 
Violation of prohibited activities: motor vehicles. Any person who violates or fails to comply with § 155-4(A), concerning prohibited activities in the parks involving motor vehicles, shall receive a parking ticket in the amount of $50 to be paid within seven calendar days of the issuance of the ticket. Failure to pay the ticket within the seven-day period will result in the issuance of a citation in accordance with the Pennsylvania Rules of Criminal Procedure. Upon conviction, the violator shall be guilty of a summary offense, and shall be subject to a fine of not less than $100, nor more than $300, and costs equivalent to the costs established by the governing authority as provided in the Judiciary Code, 42 Pa. C.S.A. § 1725.1.
(2) 
Other violations. Any person who violates or fails to comply with any other part of § 155-4, concerning prohibited activities in the parks, shall receive a citation in accordance with the Pennsylvania Rules of Criminal Procedure and upon conviction, shall be guilty of a summary offense, and shall be subject to a fine of not less than $100, nor more than $600, plus costs equivalent to the costs for summary offenses established by the governing authority as provided in the Judiciary Code, 42 Pa.C.S.A. § 1725.1.
B. 
Revocation of permits. Should any holder of a permit issued by the Parks and Recreation Director be convicted of violating any provision of this Chapter, such conviction shall be cause for revocation of any current permits. The Parks and Recreation Director may, at his or her discretion, also consider such convictions when evaluating applications for future permits.
C. 
Separate offense. Each violation hereunder shall constitute a separate offense, subject to the penalties provided in Subsections A and B of this section.
