RECREATIONAL MOTORIZED VEHICLE
Any wheeled device having a gasoline, electric, or similar motor capable of carrying one or more persons for recreational purposes. Such term includes, but is not limited to, dirt bikes, electric bicycles ("e-bikes"), motorized scooters and skateboards, minibikes, all-terrain vehicles (ATVs), go-carts, and snowmobiles. Such term excludes vehicles utilized for business operations, private property maintenance, or governmental and law enforcement purposes.
A. 
No person shall operate a recreational motorized vehicle on any public street or sidewalk within the Borough.
B. 
No person shall operate a recreational motorized vehicle on any property owned by the Borough of Brentwood.
C. 
No person shall operate a recreational motorized vehicle within the bed of any stream, creek, pond, ditch, or similar body or channel, whether natural or artificial, that conveys surface water.
D. 
No person shall operate a recreational motorized vehicle on any private property without the written consent of the property owner.
A. 
Recreational motorized vehicles shall be operated only on privately owned parcels with an area of one acre or larger.
B. 
Recreational motorized vehicles shall be operated only on all-weather surfaces.
C. 
Recreational motorized vehicles shall be operated at a minimum of 100 feet from any property line and 400 feet from any inhabitable structure.
D. 
Recreational motorized vehicles shall be operated only between the hours of 9:00 a.m. and 7:00 p.m. prevailing time.
E. 
Recreational motorized vehicles shall not produce noise in excess of 80 decibels as measured on the A-weighting scale at a distance of 25 feet from the source of such noise emission.
Any person who violations any provision of this chapter shall, upon conviction thereof before a District Justice or other court or competent jurisdiction, be sentenced to pay a fine of not less than $300 and not more than $1,000, plus the costs of prosecution.
