No person shall place any permanent and/or temporary object, including
but not limited to a basketball hoop structure, hockey net, and skateboard
ramp, which obstructs traffic on any right-of way within the Borough
of Newfield.
No person(s) playing basketball, hockey, or any other recreational
activity on a right-of-way within the Borough of Newfield activity
shall impede the flow of traffic.
This section shall not apply to the temporary placement of garbage and/or recyclable containers and/or materials placed in compliance with Chapter 241, Solid Waste. Nor does this section apply to the placement of mail or newspaper receptacles that are positioned in accordance with all applicable laws and regulations governing same.
No person shall store or leave unattended a basketball hoop structure,
hockey net, skateboard ramp, or any other object regulated by this
article within any roadway located within the Borough.
Playing basketball, hockey, or any other recreational sport in any
right-of-way within the Borough of Newfield is prohibited between
30 minutes after sunset and 9:00 a.m.
Playing basketball, hockey, or any other recreational sport is prohibited
at all times on the roadways set forth in Schedule A attached to and
made a part of this article.
Any person violating any provision of this article shall be subject
to a warning for the first violation. Any person convicted by the
Municipal Court Judge of the Borough of Newfield of the violation
of any provision of this article shall, after receipt of a warning
and upon conviction thereof, be subject to a fine not exceeding $100.
Any object obstructing traffic in violation of this article shall
be presumed to be controlled by the private property owner upon which
such object is situated or, if within a public right-of-way, the closest
private property owner.
