In the event this franchise is not renewed at the expiration
of its term or is terminated for any reason, and the City has not
provided for alternative utility service, the company shall have no
right to remove any company facilities or discontinue providing utility
service unless otherwise ordered by the PUC, and shall continue to
provide utility service within the City until the City arranges for
utility service from another provider. The company further agrees
that it will not withhold any temporary utility services necessary
to protect the public. The City agrees that in the circumstances of
this article, the company shall be entitled to monetary compensation
as provided in the company’s tariffs on file with the Public
Utilities Commission and the company shall be entitled to collect
from residents and shall be obligated to pay the City, at the same
times and in the same manner as provided in the franchise, an aggregate
amount equal to the amount which the company would have paid as a
franchise fee as consideration for use of the City’s streets.
Only upon receipt of written notice from the City stating that the
City has adequate alternative utility service for residents and upon
order of the PUC shall the company be allowed to discontinue the provision
of utility service to the City and its residents.
