This chapter shall be known and may be cited as the "Recreation and Canal Trails Law of the Village of Newark."
The purpose of this chapter shall be to preserve and protect the public peace and good order in the various public parks and canal trails of the Village and to contribute to the public welfare, safety and good order of the residents of the Village by establishing certain regulations and restrictions on the use of motor vehicles, alcohol and glass containers in the Village parks that are consistent with the rights and privileges of other residents of the Village. This chapter shall apply to all parks of the Village, except Colburn Park.
As used in this chapter, the following terms shall have the meanings indicated:
CANAL TRAILS
Includes walking paths adjacent to the canal, the Edgett Street Bridge, the gazebo, parking areas and access drives.
MOTOR VEHICLE
Includes only automobiles and trucks.
PARK
Includes a park or any other area owned or used by the Village of Newark and devoted to active or passive recreation.
PERMIT
Any written license issued by or under the authority of the Village of Newark permitting the performance of a specified act or acts or the conduct of a particular function, program or activity.
PERSON
Any natural person, corporation, company, association, joint-stock association, firm, copartnership or other entity or form of association.
SMOKING
Inhaling, exhaling, burning, or carrying any lighted cigar, cigarette (including an electronic cigarette), pipe or other lighted instrument or product that emits smoke or vapor, in any manner or in any form.

The Chief of Police is hereby empowered and instructed to post any and all signs of directional or other nature, at such places as he or she deems advisable and necessary, and also to mark and establish designated parking areas within Perkins Park and along the canal trails consistent with this chapter. All such signs and markings required hereunder shall, as far as practicable, be uniform as to type and location with similar signs and markings already in existence throughout the Village.
A. 
The Board of Trustees may from time to time by rule or regulation further limit, prohibit and regulate traffic and the parking of motor vehicles upon the roadways and premises, or parts thereof, within the Village parks' areas.
B. 
The Board of Trustees may from time to time by rule or regulation further limit, prohibit and regulate the possession and consumption of alcoholic beverages in Village parks.
