As used in this article, the following terms
shall have the meanings indicated:
DOG
Any dog, bitch or spayed bitch.
KENNEL
Any establishment wherein or whereon the business of boarding
or selling dogs or breeding dogs for sale is carried on a regular
basis, except a pet shop. Every place where five or more dogs are
kept or maintained for commercial purposes shall be considered a "kennel."
OWNER
When applied to the proprietorship of a dog, includes every
person having a right of property in such dog and every person who
has such dog in his keeping.
POUND
An establishment for the confirmation of dogs seized under
the provisions of this article or otherwise.
SHELTER
Any establishment where five or more dogs are received, housed
and distributed without charge.
No person shall operate a kennel, pound or shelter
without obtaining a license. Any person holding such license shall
not be required to secure individual licenses for dogs owned by the
licensee and kept at such establishments. These licenses shall not
be transferable to another owner or different premises.
The application for a license shall be submitted
to the Borough Clerk and shall contain the following information:
A. The name and permanent address and local address of
the applicant.
B. The street address where the establishment is located
or proposed to be located, together with a general description of
the premises.
C. The purposes for which it is to be maintained.
D. The maximum number of animals and dogs to be accommodated
by such establishment at any one time.
No license shall be issued unless the Borough
Health Officer inspects the premises and states that the establishment
complies with local and state rules governing the location of and
sanitation of such establishment.
Licenses issued for kennels, pounds and shelters
shall state the purpose for which the establishment is maintained,
and all licenses shall expire on the last day of June of each year.
Annual fees for licenses under this section
shall be as follows:
A. Kennel accommodating dogs, cats or other animals:
(1) For 10 or fewer animals: $10.
(2) For more than 10 animals: $25.
B. Pound or shelter: no fee (nonprofit).
C. All establishments that provide additional services for animals including, but not limited to, grooming services and day care services: same as established under Chapter
152 of the Code of the Borough of Shrewsbury.

The Clerk shall forward to the State Department
of Health a list of kennels, pounds and shelters within 30 days after
the licenses therefor are issued, which list shall include the name
and address of each licensee and the kind of license issued.
No dog kept in a kennel, pound or shelter shall
be permitted off the premises, except on leash or in a crate or other
safe control.
Any person, firm or corporation violating any
provision of this article shall, upon conviction, be subject to a
fine of not less than $50 nor more than $1,250, a term of imprisonment
not exceeding 90 days or a period of community service not exceeding
90 days, or any combination thereof.
