Pursuant to Section 11 of the Uniform Fire Safety
Act, P.L. 1983, c. 383 (N.J.S.A. 52:27D-202), the New Jersey Uniform
Fire Code shall be locally enforced in the Borough of Shrewsbury.
The local enforcing agency shall be the Bureau
of Fire Prevention, which is hereby created in the Borough of Shrewsbury.
The local enforcing agency shall enforce the
Uniform Fire Safety Act and the codes and regulations adopted under
it in all buildings, structures and premises within the Borough of
Shrewsbury, other than owner-occupied one- and two-family dwellings,
and shall faithfully comply with the requirements of the Uniform Fire
Safety Act and the Uniform Fire Code.
The local enforcing agency established by §
118-2 of this article shall carry out the periodic inspections of life hazard uses required by the Uniform Fire Code on behalf of the Commissioner of Community Affairs.

The local enforcing agency established by §
118-2 of this article shall be part of the Administrative Department of the Borough and shall be under the direct supervision and control of the Fire Marshal who, in turn, shall report to the Mayor and Council of the Borough.
Pursuant to Sections 15 and 17 of the Uniform
Fire Safety Act (N.J.S.A. 52:27D-206 and 52:27D-208), any person aggrieved
by any order of the local enforcement agency (or agencies) shall have
the right to appeal to the Construction Board of Appeals of Monmouth
County.

In addition to the inspection and fees required
pursuant to the Act and the regulations of the Department of Community
Affairs, the following additional inspections and fees shall be required:
A. Mercantile businesses shall be inspected yearly with
a fee schedule of:
(1) Forty-five dollars for the first 1,000 square feet.
(2) Ten dollars for each additional 1,000 square feet.
B. Factories shall be inspected yearly with a fee schedule
of:
(1) Fifty dollars for the first 1,000 square feet.
(2) Sixty dollars for 1,001 to 3,500 square feet.
(3) Seventy dollars for 3,501 to 6,000 square feet.
(4) Eighty dollars for 6,001 to 10,000 square feet.
(5) One hundred dollars for in excess of 10,000 square
feet.
C. Warehouses shall be inspected yearly with a fee schedule
of:
(1) Fifty dollars for the first 2,000 square feet.
(2) Seventy-five dollars for 2,001 to 5,000 square feet.
(3) One hundred dollars for in excess of 5,000 square
feet.
D. Repair shops and service businesses shall be inspected
yearly with the same fee schedule as that pertaining to mercantile
businesses.
E. Business offices (lawyers, doctors and other professional
offices, barbershops and insurance offices) shall be inspected yearly
with a fee schedule of:
(1) Forty-five dollars for one professional.
(2) Ten dollars for each additional professional.
F. All other types of structures and facilities not otherwise described or included in this §
118-8 shall be inspected yearly with the same fee schedule as that pertaining to mercantile businesses.

A. The smoke detector and carbon monoxide alarms certificate
fees shall be as follows:

(1) More than 10 business days with a scheduled appointment:
$45.
(2) Four to nine business days with a scheduled appointment:
$90.
(3) Less than four business days with a scheduled appointment:
$161.
B. If a scheduled appointment is not met by the owner/appointee
and/or there is a failure to have properly installed or have operating
smoke detectors in accordance with the Uniform Fire Code, a fee of
$15 will be added for each reinspection.

As used in this article, the following terms
shall have the meanings indicated:
BUILDING and/or STRUCTURE
Any building and/or structure which has an automatic fire
suppression system or fire alarm system, except one-family residential
dwellings.
The owner, tenant, and/or occupant of said buildings
and/or structures as defined in this article are required to have
installed on the same a rapid entry box and key system to allow access
to the same and access to boiler rooms, sprinkler control valves,
electrical rooms, elevators and elevator control rooms, and other
locked areas of the premises as may be required by the Shrewsbury
Bureau of Fire Prevention, the said Bureau to make said determination
on the basis of immediate need for access in the event of a fire alarm
or what appears to be a possible fire emergency.
The Bureau of Fire Prevention shall prescribe
specifications as to the required rapid entry box and key system and
location.
The rapid entry box may be required to contain
any or all of the following, as shall be determined by the Fire Marshal:
A. Keys to locked points of egress, whether on interior
or exterior of such buildings;
B. Keys to the locked mechanical rooms;
C. Keys to the locked elevator rooms;
D. Keys to the locked elevator controls;
E. Keys to any fence or secured area;
G. A floor plan of the rooms within the building.

All newly constructed buildings for which a
certificate of occupancy has not been issued, or buildings currently
under construction, shall comply immediately.
Any person, firm or corporation violating any
provision of this article shall, upon conviction, be subject to a
fine of not less than $50 nor more than $1,250, a term of imprisonment
not exceeding 90 days or a period of community service not exceeding
90 days, or any combination thereof. Any fines collected shall be
forwarded to the Borough of Shrewsbury Uniform Fire Safety Trust.
