It shall be unlawful for any person, firm or corporation to distribute or cause to be distributed by throwing, handing or placing any papers, handbills, circulars or other advertising matter or devices or wastepaper in or upon any street, sidewalk or alley or poles of the Borough of Brentwood or to distribute or cause to be distributed by throwing or placing any papers, handbills, circulars or other advertising matter or devices or wastepaper in or upon any lawn, yard, porch or vestibule of any building in the Borough of Brentwood.
Nothing in this chapter shall apply to the sale and delivery of newspapers or to the distribution of any papers on a paid circulation list or the distribution of addressed envelopes, nor to the distribution of any advertising matter by charitable institutions or by any church organization or by the Borough School District.
A. 
No person, firm or corporation shall distribute or cause to be distributed any advertising matter, circulars, papers, handbills or other advertising matter or devices within the Borough of Brentwood without first having obtained a permit for same from the Borough Secretary.
B. 
No permit shall be issued unless the applicant shall have paid to the Borough Secretary the required fee. The amount of the fee shall be fixed from time to time by resolution of Council.[1]

C. 
No permit shall be issued except upon the condition that the distribution of said advertising matter, papers, handbills, circulars or other advertising matter or devices shall be conducted in conformity with this chapter.
Any person, firm or corporation who or which shall violate any provision of this chapter shall, upon conviction thereof, be sentenced to pay a fine of not more than $600 and costs of prosecution or, in default of payment of such fine and costs, to undergo imprisonment for not more than 30 days. In addition, any permit issued to a convicted violator shall be revoked and no further permit granted.
